Article 134 of Indian Constitution - Appeal in Supreme Court against High court

Sec 225 – Trial begun by state prosecution

Sec 154 –FIR

Sec 375- Medical test or Treatment of victim in any Govt. or Pvt. hospital.

Sec 157 – process of investigation by investigating officer (I O)

Sec 158 – Police report submitted to magistrate

Sec 161- Taken evidence from witnesses.

Sec 172- A diary maintain by office of investigation.

Sec 62/63 of evidence act deals with – Primary and secondary evidence.

Sec 101 of evidence act- Burden of prove always on prosecution.

Sec 137 of evidence act- Examination in chief, Cross- examination, Re- examination of witnesses

Sec 141 of evidence act- Leading question

Sec 32 of evidence act – Dying declaration.

Questions
A State Prosecutor will ask from defense witnesses (2 witnesses are there)

1st witness- ie Doctor of Accused

1- How long have you know the accused?


2- How was the condition when he first came to you for his treatment?
3- Do you think, a person can do wrong in this kind of disease?
4- You were treating the accused for so long, did you notice any improvement or not?

2nd withness- ie His brother

1- When you realized that your brother has been suffering from the disease?
2- How he behaved with family member when he was stay at home?
3- Have you ever taken your brother to the doctor for his treatment before this?
B Defense counsel will ask from defense witnesses ( 3 witnesses are there)

1st witness- ie Eye witness (neighbor)

1- How far do you live from the accused house?


2- What time was it, when you heard screaming or noise?
3- Have you ever heard all these noises and screaming before this?
4- If yes- then tell the court how often it happens?
5- If you usually saw them fighting with each other, do you ever tried to inform the police?
6- What do you see, when you reached at crime scene?
7- When you saw the criminal, how was his expression and body gesture/
8- Is that person was scared or normal? Is he tried to escape or not?
9- And last one, where was her daughter? Have you seen her there?

2nd witness- Doctor of victim

1- How was the condition of victim when you saw her?


2- How much injuries are there on her body?
3- After seeing the injuries, can you tell the court that it was a brutal murder or not?
4- Acc. To you report was the time of murder?
5- What was her mental condition during the dying declaration? Is she was conscious?

3rd witness- ie Investigation officer (SHO)

1- When you get informed about murder and by whom?


2- What did you see when you reached at crime scene?
3- Did accused made any attempt to escape?
4- From where you discovered the weapon which was used in murder?
