Should privacy be considered a human right? 


If so, what are the limits or terms to which commercial and state institutions have access
to our data?

According to Article 12 of the Universal Declaration of Human Rights (UN),

“No one shall be subjected to arbitrary interference with his privacy, family, home or
correspondence, nor to attacks upon his honour and reputation. Everyone has the right to the
protection of the law against such interference or attacks.”

That means privacy is already considered a human right and it should be protected and
respected by every human being. However, privacy, like other rights, is not absolute. As a
person moves into communal relations and activities such as business and social media
interaction, the scope of personal space shrinks. Since we are living in a ‘society of control’, all
our personal data is always under surveillance, particularly by commercial enterprises and by
state institutions. In this point, we find out the 7 key principles of data protection set out by
Guide to the UK General Data Protection Regulation (UK GDPR) including:

1.       Lawfulness, fairness and transparency

2.       Purpose limitation

3.       Data minimisation

4.       Accuracy

5.       Storage limitation

6.       Integrity and confidentiality (security)

7.       Accountability

In which, it was mentioned that personal data shall be (Picture 1)

These principles are currently widely applied (e.g.  Vietnam’s Law on Network Information
Security, picture 2)

Example:

 With the release of iOS 14.5 comes App Tracking Transparency, Apple's new endeavour
to give users discretion over how much of their data is aggregated and used for
advertising or other reasons by third parties. When you choose 'Ask App Not To Track,'
the app will not be able to access your IDFA (Identifier For Advertisers). The company
has stated that if they discover dishonest programs that do not adhere to these criteria,
they will be withdrawn from the App Store.
