I.
A. Request for relief.
Comes now Ulysses T. Ware, the Petitioner, and moves the District Court for
an emergency order directed to the United States Attorney (SDNY) Damian
Williams, et al., and the United States Attorney General Merrick Garland, Lisa
Monaco, Vanita Gupta, and Jeffrey R. Ragsdale to immediately, not later than 12:00
noon on October 27, 2021, time of the essence, to file into the record of the District
Court, United States v. Ware, 05cr1115 (SDNY), and United States v. Ware,
04cr1224 (SDNY) all Brady, Giglio, Rule 16 materials, letters, the actual “5k” letter1,
memoranda, notes, emails, faxes, text messages, or other communications related
to or concerning all concealed, covert, secret, suppressed, and covered up “5K”
negotiations, agreements, promises, favors, gratuities, things of value, benefits, or
favorable conditions given or promised to government “principal witness” Jeremy

I Ulysses T. Ware, hereby this 25th day of October 2021 in the city of Brooklyn, in the State of New
York, while under oath, set my hand and seal, subject to the penalty of perjury, having personal
knowledge of the facts, pursuant to 28 USC 1746, hereby have made this sworn Declaration in
my personal and individual capacity, and set forth the following facts that are true, correct, and
indisputable. I hereby incorporate by reference herein and make the same a part hereof as if
attached hereto, the Government’s trial exhibits, 1224 and 1115 PSIs in heac verba, briefs,
motions, memoranda, transcripts, orders, judgments, and dockets from the 02cv2219 SDNY, 03-
93031-mhm (BC NDGA), 03-0831-kjd (D. NV), 04cr1224 SDNY, 05cr1115 SDNY, and related
proceedings, jointly (the “Ware Cases”).
Fact 1
The official docket in United States v. Ware, 05cr1115 (SDNY)3, does not contain any entry
or record of any Rule 5K letter awarded to “principal witness”4 Jeremy Jones for his known
perjured and fabricated testimony on behalf of the Government in 05cr1115.

Quoting Circuit Judge Amalya L. Kearse in her August 18, 2009, opinion for the Court in United States v.
Ware, 07-5222cr (2d Cir. 2009). Jones was labeled and designated as the Government’s “principal
witness” by the Court of Appeals. Accordingly, the Government was required to have disclosed all
agreements, actual or imminent, or benefits promised or to be awarded to Jones in exchange for his trial
testimony. The Government’s prosecutors, Audrey Strauss, John M. McEnany, Melissa Childs, Alexander
H. Southwell, Steven D. Feldman, Nicholas S. Goldin, Maria E. Douvas, Andrew L. Fish, Michael J. Garcia,
David N. Kelley, Joon Kim, Preet Bharara; and District Judge Edgardo Ramos and Chief District Judge Laura
Taylor-Swain have knowingly and deliberately colluded and conspired with Jones, Marlon G. Kirton, Esq.,
the SEC, and Judges William H. Pauley, III, and Michael H. Dolinger to obstruct justice and to commit a
fraud on the federal courts by denying Mr. Ware his constitutional right to challenge the credibility and
veracity of Jones and the other government stooges; and all have conspired and/or aided and abetted the
willful resistance, 18 USC 401(2) and 401(3), criminal contempt, of the Brady Court Orders in a risible
attempt to continue to conceal and suppress the facts regarding Jones’ concealed and suppressed Rule
5K letter. A clear cut and indisputable fraud on the federal court by officers of the court and criminal
contempt of Brady Court Orders.

government “principal witness” Jeremy Jones, did, in fact, receive a Rule 5K letter from the
Government for his known perjured and fabricated testimony in 05cr1115.

(i) The Government’s prosecutors and federal judges Edgardo Ramos and Laura Taylor-
Swain have without interruption to the present day have knowingly, deliberately, and in bad faith
lied, committed perjury, omitted to perform and conduct required judicial procedures, fabricated
documents, and evidence, committed mail and wire fraud, grand jury fraud, frauds on the court,
bribery, money laundering, obstructed justice, conspired to obstruct justice, committed willful
civil and criminal contempt of the Brady Court Orders and Court Judgments, abused the judicial
process, misrepresented the law and the facts, practiced knowing deceit, abused Local Rule
District Court (SDNY) Rule 1.5(b)(5) and suppressed and concealed indisputable crimes and
ethical violations committed by lawyers that actually or constructively appeared before the
District Court (SDNY), 04cr1224 (SDNY), 02cv2219 (SDNY), and 05cr1115 (SDNY). Done as overt
acts in furtherance of the Jim Crow racially-motivated hate crimes committed against Ulysses T.
Ware, Esq. in retaliation for Mr. Ware’s refusal to criminally violate Section 5 of the 1933
Securities Act and issue fraudulent and criminal Rule 144(k) legal opinions to the “Civil Plaintiffs”
named in paragraph 8 of the 04cr1224 (SDNY) indictment.
(ii) The 02cv2219 (SDNY) “Civil Plaintiffs” are confirmed Section 2(a)(11) statutory
underwriters and; and confirmed on May 17, 2021, by FINRA as unregistered broker-dealers
legally ineligible for Rule 144(k) exemption to Section 5. See SEC Release 33-7190 n. 17 (1995).

The Government’s prosecutors were ordered by written Brady Court Orders to disclose
“all” Brady exculpatory and impeachment materials5 to Ulysses T. Ware “before trial”6 or “prior
to the start of trial.”7

was never and has never been complied with by the Government’s prosecutors. Willful civil and criminal

The Government’s prosecutors, Marlon G. Kirton, Esq., federal judges William H. Pauley,
III, (deceased), Edgardo Ramos and Laura Taylor-Swain, and others have knowingly colluded,
conspired, aided, abetted, and racketeered to obstruct justice, violate ethical requirements of
the District Court (SDNY), commit civil and criminal contempt of the Brady Court Orders, and all
have knowingly and in bad faith conspired to commit crimes against the United States by
obstructing the due administration of justice in the federal courts by concealing and suppressing
Jeremy Jones’ “5K’ letter awarded by the Government’s prosecutors for known perjured and
fabricated trial testimony in 05cr1115 (SDNY).

(i) On October 25, 2021, Ulysses T. Ware discovered that the Government’s “principal
witness” in 05cr1115 (SDNY), Jeremy Jones, had received a Rule 5K letter from the Government
for his known perjured and fabricated trial testimony in 05cr1115.
(ii) On October 25, 2021, Ulysses T. Ware discovered that CJA lawyer Marlon G. Kirton, Esq.,
an officer of the court, subject to Local Rules District Court (SDNY), Rule 1.5(b)(5), was aware that
his client, Jeremy Jones, had received a secret, concealed, suppressed, and covered up Rule 5K
letter from the Government for Jones’ known perjured trial testimony in 05cr1115 (SDNY).
(iii) On October 25, 2021, Ulysses T. Ware discovered that the Government’s prosecutors,
Judges William H. Pauley, III, Edgardo Ramos, Laura Taylor-Swain, Merrick Garland, Lisa
Monaco, Vanita Gupta, Damian Williams, Jeffrey R. Ragsdale, Audrey Strauss, John M.
McEnany, Melissa Childs, and other DOJ senior officials all knew and were aware that Jones had
received a Rule 5K letter from the Government for his known perjured trial testimony in 05cr1115
(SDNY); all knew that the Rule 5K letter was never filed or docketed in the official record; all knew
and/or were recklessly ignorant and incompetent in not knowing of the existence of the Rule 5K
letter; and all knew that the Rule 5K letter was willfully, in bad faith, and intentionally not
disclosed to Ulysses T. Ware as required by the written Brady Court Orders entered in 04cr1224,
Dkt. 32, and 05cr1115, Dkt. 17.

2, Underlying counts are dismissed on the motion of the US; Pleaded
guilty to Count(s) 1s, 2s, Probation for a term of 3 Years concurrent on
counts 1 and 2. The defendant shall comply with the conditions of home
confinement for a period of six months. During this time, the defendant
shall remain at his place of residence except for employment and other
activities approved by his probation officer. The defendant shall maintain
a telephone at his place of residence without call forwarding, a modem,
caller ID, call waiting or a portable cordless telephone for the above
period. If the defendant's probation officer determines that it is
necessary, the defendant shall wear an electronic monitoring device and
