AFFIDAVIT OF PROBABLE CAUSE
‘The undersigned deposes and says upon information and belief that David S. Huneck has
committed the offenses of Child Seduction, a level 6 felony; Sexual Battery, a level 6
felony; Battery, a Class B Misdemeanor; Contributing to the Delinquency of a Minor, a
Class A Misdemeanor; and Furnishing Alcohol to a Minor, a class C misdemeanor.
Affiant states that this Affidavit of Probable Cause is not a complete recital of all
material facts relevant to this investigation but is made solely for the purpose of
establishing probable cause.
On September 23, 2021, Officer Hunter LaRue of the Columbia City Police Department
responded to a complaint of a potential sex crime. The report came from a staff member
at St. Paul of the Cross Catholic Church, located at 315 South Line Street in Columbia
City, Indiana,
The complainant informed the officer that Father David Huneck (age 31), a priest at St.
Paul of the Cross, had allegedly groped two (2) young women, one aged seventeen (17)
years and one aged nineteen (19) years. LaRue became aware that the Department of
Child Services (“DCS”) had been notified and that organization had responded and
prepared a report on September 21, 2021. LaRue obtained a copy of their report prior to
proceeding with the investigation. Given that one of the alleged victims was an adult and
the other was nearly eighteen (18) years old at the time the initial contact was made, DCS.
determined it did not have jurisdiction,
Officer LaRue was able to determine from the DCS that the nature of the complaint
involved two (2) young females and that the initial allegation stemmed from an incident
in the early morning hours of June 30, 2021. The location of the alleged incident was
identified as the home provided to Fr. Huneck in his role as a priest by St. Paul of the
Cross and is located in Columbia City, Indiana. The information obtained from DCS
further indicated there was a separate and subsequent incident on September 17, 2021.
‘The officer thereafter made contact with church staff and was able to determine the
‘names and contact information for the two young women involved, Following that,
LaRue determined that Huneck had been removed from the parish by the CatholicDiocese as well as the residence associated with the Church. At all times, both the
Diocese of Fort Wayne-South Bend and St. Paul of the Cross were prompt and helpful in
providing information requested by investigators,
Officer LaRue contacted the Columbia City Police Department detective bureau and
relayed the information. Given that the situation did not involve imminent or immediate
danger to the alleged victims, interviews were scheduled for the following day,
September 24, 2021 at 11:00 a.m.
Victim #1 and Ms. SS0NRINP were interviewed separately. During those initial interviews,
the officer was able to determine that the conduct giving rise to the allegations occurred
on two (2) different dates: June 30, 2021 and September 17, 2021. Both incidents
occurred in Whitley County at the 315 South Line Street address.
Officer LaRue then interviewed Victim #1 and Ms. MMI about the incidents. Victim
#1 indicated that on June 30, 2021, she was seventeen (17) years old, while Ms, @USRamge
stated she was 19 years of age during both incidents. Victim #1 knew Huneck from his
time as Chaplain at Bishop Dwenger High School in Fort Wayne, Indiana. Ms. Yolevich
acknowledged the same and indicated that she had looked up to Fr. Huneck as a role
model. Huneck had invited and encouraged Victim #1 to join the church.
During the first incident, both young ladies were invited by Fr. Huneck to his residence to
celebrate his birthday and eat cake. Victim #1 stated that she and Ms. Yolevich arrived at
approximately 10:30 p.m, and that they were the only two people present other than Fr.
Huneck. After arriving at his residence, Huneck offered them alcohol which they
accepted. Neither became intoxicated. Both Victim #1 and Ms, (QUI were clear that
they did not bring alcohol to the residence but both admitted to consuming the alcohol
provided by Fr. Huneck.
Both Ms. S00@@@liand Victim #1 stated that Huneck became seriously intoxicated
during their time at his home. Both described the following factors in making this
assessment: he consumed alcohol in front of them, had slurred speech, was stumbling,
pale, sweaty and vomiting.
After becoming intoxicated, Huneck repeatedly grabbed Ms. SIRI’s breasts through
her clothing, despite her efforts to slap his hands away. Huneck asked Yolevich about
‘whether she had other sexual encounters and whether she could do sexual things to him.
Huneck further asked if he could touch QImlmiy’s breasts and whether she would “suck
his dick.”
Ultimately, Huneck became so intoxicated he was lying on the kitchen floor. Both young
women helped him up and assisted him to his bedroom and put him to bed. While
providing water and assistance, Huneck pulled Victim #1 into bed with him and touched
her stomach and then her breast. According to Ms, I Huneck at some point said
that Victim #1 had “the best boobs.” Victim #1 told Huneck to stop touching her and hethen did so. Victim #1 and Ms. @9MMMMipgave Huneck water and stayed with him until he
fell asleep at which point the two left
Following the vents of June 30, 2021, both women had several, normal interactions with
Fr, Huneck. Huneck had apologized and both women were willing to forgive his conduct
as out-of-character and as the result of intoxication, Both indicated that while they were
very concerned the night of the incident, both considered Fr. Huneck a friend and
spiritual advisor. They wanted to believe his conduct would not happen again and Ms,
‘Wa indicated that she was capable of forgiving but “would not forget.”
However, on September 17, 2021 Huneck again invited Victim #1 and Ms. [>
back to his home. Given his apologies and his normal behavior over the preceding weeks,
both young ladies agreed that they would go together. Both continued to regard Fr.
Huneck as a central figure in their faith,
As soon as they arrived, however, Huneck again provided them alcohol again and invited
them to watch a movie. Both women accepted the alcohol. While watching the movie and
consuming the alcohol, Huneck again became intoxicated. Huneck then began grabbing.
and groping Ms. (MB's buttocks. Specifically, Ms. SII explained that he was
grabbing her buttocks through her clothes and grabbed hold of her underwear to pull her
back down to him, At some point during this physical assault, both women describe
Huneck as exposing his penis to them. One of the girls yelled: “Father David, no!” while
this was occurring. Both left shortly thereafter
Following the interviews, Ms. NINN provided text messages to Officer LaRue, These
text messages were sent to her phone from “Fr. David.” In the texts, Huneck apologizes
for his behavior and states that he may be relegated to the “bad priest list.” She also
provided text messages Huneck sent to her on September 18, 2021 in which he again
apologizes for his behavior,
