Employment Contract

This contract, dated on the __ day of ________ in the year 20____, is made by
and between ______________ herein referred to as “Employer” and
___________________________________________, of legal age and permanently
residing at ________________________________ herein referred to as the
“Employee”.

-WITNESSETH-

WHEREAS, this document shall constitute as the employment


agreement between the parties (Employer and Employee) and is
governed by Philippine Labor Laws.

WHEREAS, the Employer desires to retain the services of the


Employee, and the Employee desires to render such services, these terms
and conditions are set forth.

NOW, THEREFORE and in consideration of this mutual


understanding, the parties agree to the following TERMS AND
CONDITIONS:

Employment
The Employee agrees that he or she will faithfully and to the best of their ability carry
out the duties and responsibilities communicated to them by the Employer. The
Employee shall comply with all company policies, rules and procedures at all times as
provided by the Company's Employees Handbook.

Position
As a ______________, it is the duty of the Employee to perform all essential job
functions and duties as enumerated in the Company's Employees Handbook. From time
to time, the Employer may also add other duties within the reasonable scope of the
Employee’s work.

Compensation
As compensation for the services provided, the Employee shall be paid a wage of
_________________ (per month) and will be subject to a(n) [quarterly or annual]
performance review. All payments shall be subject to mandatory employment
deductions (Tax, Philhealth, SSS and other Deductions Mandated by Law).

Probationary Period
The Employee shall be under probation for six (6) months to commence upon signing of
this Contract of Employment. The Employer shall at the commencement of the
Employee’s engagement, inform him of the company standards, qualifications and
policies based on the Company’s Employees Handbook which he/she needs to meet
and comply to qualify for permanent position.

During the six (6) months probationary period, the Employee shall be under observation
and review. The Employee’s skill, competence, attitude and fitness for work shall be
examined by the Employer.

The Employee shall enjoy security of tenure during the probationary period and shall not
be terminated except for just and authorized causes or when fails to qualify as a regular
employee. In the event that the Employee failed to meet the company standards and
policies, a Notice shall be issued to him/her at least two (2) weeks before the end of the
six (6) month probationary period.

If an employee is allowed to report to work after the end of the probationary period,
he/she is presumed to have passed the probationary period.

Renewal of Contract
It is the intention of both parties to form a long and mutually profitable relationship. The
Employee agrees that this employment contract shall only last for a period of one (1)
year and shall be subject to renewal one (1) month before the end of the employment
contract.

Termination
An employee may be terminated for just and authorized causes under the Philippine
Labor Laws and for violations of the Company’s Employees Handbook. Due process for
the termination of this Employment Contract shall be observed by both parties.

The Employee shall return any and/or all property/ies entrusted to him/her by the
Employer upon termination of his/her employment. The Employee shall pay and fully
settle any damage caused by him/her to the property/ies of the Employer before he/she
terminates this Employment Contract. Settlement for the damage done may be
deducted to the last month salary of the Employee.

Non-Competition and Confidentiality Clause


As an Employee, you will have access to confidential information that is the property of
the Employer. You are not permitted to disclose this information outside of the Company
during the time of your engagement whether as probationary or regular employee.

During your time of employment with the Employer, you are not permitted to engage in
any type of work for another company that is related to or in competition with the

Company. You are required to fully disclose to the Employer any other employment
relationship/s you may have during the existence of this Employment Contract.

The Employee shall only be permitted to seek other employment provided that:

a. It does not detract from the Employee’s ability to fulfill his/her duties, and;
b. The Employee is not assisting another organization in competing with the
Company.

Entirety
This contract represents the entire agreement between the two (2) parties and
supersedes any previous written or oral agreement. This agreement may be modified at
any time, provided the written consent of both the Employer and the Employee are
obtained.

Severability
The parties agree that if any portion of this contract is found to be void or
unenforceable, it shall be struck from the record and the remaining provisions shall
retain their full force and effect.

IN WITNESS WHEREOF, the Parties hereby agree to the terms and conditions
set forth in this Employment Contract and such is demonstrated by their signature as
