Producer and Consumer


Producer and consumer are the two participants of the
market system. A producer is the one who produces
goods and services. Consumer is the one who buys or
purchases the goods and take the services.
As a part of the market system both must have equal
rights, for the system to balance. These rights are
provided to us in the form of consumer rights.

Malpractices in Marketplace
Exploitation in market place happens in various ways-
Cheating on weight and measurement.
Selling Sub-Standard products.
Indulging in adulteration and adding impurities.
False information is passes on through the media and
other sources to attract consumers, etc.

As a result of all these malpractices and exploitation of


the consumers the consumers rights were introduced.

Consumer Movement
In India, the consumer movement as a ‘social force’
originated with the necessity of protecting and promoting
the interests of consumers against unethical and unfair
trade practices.
Till the 1970s consumers’ organizations were largely
engaged in writing and holding exhibitions. They formed
consumers’ groups to look into the malpractices in ration
and overcrowding in the road of passenger transport.

A major step was taken in 1986 by the Indian government


was the enactment of the Consumer Protection Act 1986,
popularly known as COPRA.

Consumer Rights
The term consumer right can be defined as certain
privilege given to the consumer, to save them from
exploitation.

These rights are given to each and every citizen of our


country.

Right to Safety: - It is the right that provides the


consumer protection against the marketing of goods and
services which are hazardous to life and property. The
purchased goods and services availed of should not only
meet their immediate needs, but also fulfil long term
interests.
Before purchasing consumers should insist on the quality
of the products as well as on the guarantee of the
products and services. They should preferably purchase
quality marked products.

Right to be Informed: - It is the right that is provided


to the consumer to be informed about the quality,
quantity, potency, purity, standard and price of the goods
so as to protect the consumer against unfair trade
practices.

Consumer should insist on getting all the information


about the product or service before making a choice or a
decision. This will enable him/her to act wisely and
responsibly and also enable him to desist from falling
prey to high pressure selling techniques.

Right to choose: - It means right to be assured of


satisfactory quality and service at a fair price. It also
includes right to basic goods and services. This is because
unrestricted right of the minority to choose can mean a
denial for the majority of its fair share. This right can be
better exercised in a competitive market where a variety
of goods are available at competitive prices.
Right to Seek Redressal: - Consumers have the right to
seek redressal against unfair trade practices and
exploitation. It also includes right to fair settlement of the
genuine grievance of the consumer.

Consumers must make complaint for genuine grievance.


Many a times their complaint may be of small value but
its impact on the society as a whole may be very large.
They can also take the help of consumer organizations in
seeking redressal of their grievance.

Right to Represent: - It is the right to guide a consumer


on how to file cases in consumer court and exercise their
right to represent their cases or grievance in consumer
court.

Right to Information: - In October 2005, the


Government of India enacted a law popularly known as
the RTI Act, which ensures its citizen all the information
about the functions of government departments.

Consumer Forums
Consumer Forums are the organizations formed to guide
consumers rights. They are also called as Consumer Protection
Councils. They guide a consumer in filing the cases at the
consumer courts. They can also represent individual consumer
at the consumer courts, if required. They create awareness
among people regarding consumer rights. For this, they also
receive financial support from the government.

Consumer Protection act-1986: -


The Consumer Protection Bill, 1986 seeks to provide for
better protection of the interests of consumers and for
the purpose, to make provision for the establishment of
Consumer councils and other authorities for the
settlement of consumer disputes and for matter
connected therewith. It was replaced by the Consumer
Protection Act, 2019.

Three Tier Judicial System: -


District Level Courts- This level of court deals with the
consumer disputes involving claims up to Rs. 20 lakhs.
State Level courts- This level of court deals with the
consumer disputes involving claims between Rs. 20 lakhs
to Rs. 1 crore.

National Level Courts- This level of court deals with the


consumer disputes involving claims exceeding Rs. 1
crore.

Conclusion

The Consumer Protection Act is complicated, covers multiple


jurisdictions, and can change constantly. Despite all of this, by
following the advice described in this Research Guide, a lawyer
or new attorney can understand the area. The government
came into existence in 1986. It gives the user six fundamental
rights.

 The primary goal is to ensure that consumers get their


cash worth of goods / service.
 Consumers are allowed to protect products and services
that are hazardous to their lives and property from marketing
cost fixes.
 The right to obtain information on the quantity,
consistency, purity, strength, and quality of products and
services is the rights of the customer.
 It is also the consumer’s responsibility to purchase goods
at fair prices.
