1. Research for a sample of a hotel or restaurant banquet agreement.


Examine the provisions in the agreement and analyze whether such
provisions are fair and justifiable. Can you suggest ways to improve the
banquet agreement? (Attach copy of the agreement when you submit the
assignment)

As a hospitality student, everything that’s given are fair and justifiable. But
they didn’t input every detail that must show on the paper. It is the simplest
banquet agreement yet it’s all clear what the contract is all about. They explain
the terms and conditions for the venue and for the event. In the contract, they talk
about the things that every guest and organizers shouldn’t do, like for example is
about the decorations, it says that any decorations shall not be attached to the
walls, ceilings, woodwork and other part of the venue. If that happens and some
facility has been scratched or broken, the company will be able to make them pay
for the broken part or they will make them fix it. Another important part of the
agreement is about the liability and security, the company will not be responsible
for the lost, stolen or left things in the event. The agreement has all the important
details that every contract should have but some other details about the venue and
food are not much discussed.

2. Research for a sample of an employment contract in the tourism, travel


and hospitality industry. Answer the following questions:

a. Is the compensation package clearly stipulated?

Yes. It shows all the compensation package that is concluded in the contract. The
Salary Evaluation and Performance Evaluation are clearly stated, they agreed to pay
the employee the annual salary and it will be payable in installments. There will be a
performance review for the employee once a year to see if he’s doing the job properly.
It also shows the bonus and the salary of the employee on holidays, vacation and
leave. All the benefits that the employee will receive are all written in the contract,
they give all the details including the retirement, health, welfare and pension. It also
shows the group life insurance of the employee, stating the amount of money he will
receive twice the annual salary.

b. How would you characterize the wording of the employment


contract?

They clearly stated all the details in the contract, especially the terms and
conditions for the employment. The contract contains all of the covenants and
agreement between the parties with respect to the employee. It also stated the that any
modification of the agreement will only be effective if it’s written and signed by both
parties. Everything are all acceptably concluded in the contract. The wordings are
very professional and only facts are surely written.

c. Are the grounds for termination explicitly mentioned? (Attach copy


of the agreement when you submit the assignment)
Yes. The termination and severance pay are clearly stated in the agreement. It
explains the termination without cause, which is the employee is being terminated by
the district without cause, and for that he will still be receiving his health insurance
coverage for a period of six months and will still pay him a cash payment of six
months of compensation based on his annual salary. And the Termination with Cause,
which can happen anytime during the term of agreement, the employee will only be
entitled to any unpaid compensation due to him as a matter of law. Lastly stated in
contract about the termination is if the agreement is terminated, any cash settlement
related to the termination that the employee may receive from the company will be
fully reimbursed to the company if the employee is convicted of a crime involving a
abuse on his position or office with the company.

3. The Case of the Disastrous Conference

In 2000, a major Philippine university hosted a three-day international conference on


environment and urban renewal with the Manila Hotel as official venue. It was hoping
to attract 500 to 700 participants. The university has paid the 50% required down
payment for the banquet meals. The hotel earmarked 6 complimentary guestrooms for
the conference organizers. A total of 50+ foreign delegates and 350+ Filipino
delegates were pre-registered. The organizers were also hoping for a good turnout of
walk-ins. On the eve of the conference, Manila was besieged by a strong typhoon
causing major streets and avenues to be under water. At exactly, 8:00 am on the first
day of the conference, invitations committee chair Isay Bradley started to call many
speakers and registered local participants confirming their attendance on the first day
despite the inclement weather. Half of the foreign participants were already checked-
in at the Manila Hotel. Less than 50 local and foreign participants showed up on the
first day. The hotel has prepared food good for 400 people.

Should the organizer be required to pay the full amount of the first day banquet
meals?
Yes. Because definitely it is surely stated in the banquet contract that whether
the participants will show up or not, the payment will still be exactly full amount. The
hotel is not responsible for any changes that the organizers will have at the moment,
because before the event happens, all has been settled in the hotel.

What concessions can the event organizer request from the hotel?

They can ask for a discount but it’s all in the hotel if they are willing to give
it or not. Surely the hotel will understand the problem because no one can stop the
inclement weather.

Can the hotel legally charge the organizers the full amount?

Yes, they can. Because it’s all in the contract after all. The food are already
prepared by the hotel and the venue is already used. The hotel can decide whether
they will make the organizers pay the full amount or not.

What are the obligations of an event organizer?


They are the ones who are responsible for planning the event, meaning they
should know the upcoming weather on the date of the event to prevent this kind of
situations.

What are the obligations of a venue host?

They are the ones who are responsible for managing the guests at the
conference. They ensure that everything is running smoothly, they also help the
organizers plan the event. One of its important obligations is to support the staff to
perform their duties.

What could be a possible consequence if the organizer refuses to pay for the excess
banquet meals and insists only on actual consumption?

The possible consequence for this situation is the hotel can sue the organizers
for not paying the full amount stated in the contract. The organizers know their
responsibilities and it includes paying the exact amount, and if they refuse to do so, it
will be a problem for both parties especially on the organizers part.
