Narrative:
On Sunday, August 1, 2021, I was assigned to Squad 3 Motor Patrol, patrolling Post 4 West in SUV #14. At
approximately 4:04 AM, Officer J. Meyer #340 and Officer S. Gonzalez #357 responded to the intersection
of Suffern Road and Wilson Avenue on a report of a sport utility vehicle that was located in the area with its
lights activated for over an hour. See Officers J. Meyer's supplemental report (21-041217A) for further
information.
Sgt. R. Boswell #308, Officer J. Cano-Vanegas #348, Officer Donejia Somerville #368, Officer N. DeCarlo
#373 and I arrived on scene to assist.

The driver of the vehicle was identified as Mr. Gregory Martin, who is the registered owner of the Chevrolet
Avalanche. While interviewing Mr. Martin, his motor functions were slow. He had difficulty keeping his
balance and needed to place his hands on his vehicle to stand upright. He was also unresponsive to some
questions that were asked by responding officers on scene. During this time I detected a strong smell of an
alcoholic beverage emanating from his breath.
Due to these circumstances, Mr. Martin was suspected of driving under the influence of alcohol. Mr. Martin
was walked to an open flat area on Wilson Avenue in front of SUV# 15. During this time, I guided Mr.
Martin to the area by holding his arm. I could feel his weight shifting in my hands as if he were going to fall
with out my aid. He also had difficulty comprehending my directions to walk to the area of SUV #15.
After we arrived to the designated area, I informed Mr. Martin that he was under investigation for driving
under the influence of alcohol and he was subject to field sobriety testing. Mr. Martin stated to me that he
refused to participate in the sobriety tests. Due to the odor of alcoholic beverages on his breath, his
physical condition, and his refusal to perform field sobriety tests, Mr. Martin was subsequently informed
that he was under arrest for driving under the influence of alcohol.
I asked Mr. Martin to place his hands behind his back. At first Mr. Martin did not wish put his hands behind
his back and he tensed his arms from being moved. After speaking with him in regard to the matter he did
comply and he was handcuffed.
He was subsequently searched and placed into the rear seat of SUV #15. While attempting to sit him in
the rear seat he stood in the door way of the vehicle for approximately 1-2 minutes and would not sit down.
He also would not respond to Officer directions to sit down. He eventually decided to sit down in the
vehicle seat and the seat belt was secured.
While preparing to leave the scene, it was discovered that the arbitrator camera system of SUV #15 was
not functioning properly. Due to these circumstances, Mr. Martin was removed from the interior of SUV
#15 and placed in the rear seat of SUV # 14. Mr. Martin was transported to Teaneck Police Headquarters
by myself in SUV # 14. During transportation, Officer Gonzalez followed in SUV # 15.
Officer J. Meyer remained on scene with the Chevrolet Avalanche so it could be towed for impound.
Tumino's Towing service arrived on scene and subsequently impounded the vehicle to their lot without
incident.
Upon our arrival at Police Headquarters, Mr. Martin was brought into the Sally Port. All officers stored their
weapons in the designated lock boxes.

While removing Mr. Martin from the rear seat of SUV #14, he was unresponsive to directions. He would
not move when he was asked to get up from the vehicle seat. I asked him several times to get up and
informed him that the process would take longer if he remained in the vehicle. He eventually removed
himself from the vehicle and he was brought into the processing area.
Mr. Martin was released from handcuffs and searched upon entering the processing area. He was again
asked if he would participate in field sobriety testing and he refused to do so.
Mr. Martin was subsequently read his Miranda Rights. During this time, Mr. Martin replied no to all
questions asked during the Miranda warning. He also refused to sign the Miranda Warning document.
The New Jersey Attorney General's Standard Statement for Motor Vehicle Operators was read to Mr.
Martin. During this time he refused to participate in the submission of breath samples by replying, "no"
when initially asked if he would provide breath samples. I then read him the additional paragraph, and he
responded by belching. As a result, Mr. Martin was charged with refusal to submit to chemical testing.
After refusing the submission of breath samples, Mr. Martin requested to go to the bathroom. Mr. Martin
was asked to wait so processing procedures could be completed. He then implied that he was going to
urinate in his pants if he was not taken to the bathroom immediately. Mr. Martin was subsequently taken to
the Male Cell 2 where he was able to relieve himself.
After returning to the processing area, Mr. Martin refused to answer any questions required for the Drinking
Driver/Operator Questionnaire and Driving While Impaired- Last Drink Location Report. He also refused to
answer any questions pertaining to the kinds of alcoholic beverages he consumed, the quantity of
beverages consumed, where he consumed beverages and the time. He also refused to answer the last
time he ate.
Mr. Martin would not answer any questions pertaining to the prisoner arrest log. During processing he
repeatedly stared at Officer Gonzalez and me when we asked him questions. He also stated that he had
been working as a Police Officer for 35 years which may have been a form of intimidation towards Officer
Gonzalez and me.
Mr. Martin was asked if there was anyone who could take custody of him while he was intoxicated. He
replied that he had a 5 year old son who was in Africa with his wife and that Officer Gonzalez and me
ruined his life because we arrested him.

Officers prepared to place Mr. Martin's personal belongings in a locker for storage so he could be moved to
a prisoner cell. During this time, while standing, Mr. Martin bent over, lowered his head and physically
accelerated himself into the laundry machines using his head as a point of impact. As a result, Mr. Martin
became unresponsive to communication.
The Teaneck Volunteer Ambulance Corps. (TVAC) was contacted to respond to Police Headquarters to
treat Mr. Martin's condition. While waiting for TVAC to respond, Mr. Martin became responsive. Mr. Martin
was told to lay flat on the ground and wait for TVAC to arrive and examine him.
During this time, Mr. Martin became aggravated and did not want to lay on the ground. He was advised by
Officers to relax and stay still to prevent possible further injury to his neck. Mr. Martin also asked if this
incident was being recorded. He subsequently remained on the floor until TVAC arrived.
Upon TVAC's arrival to Police Headquarters, Mr. Martin repeatedly stated that his head hurt to medical
personnel. He also stated that the present officers "smashed" his head into a wall. He repeatedly made
statements that his head hurt but he appeared to be reluctant to want to go to a hospital for medical care.
He was advised to go to a hospital to have his injuries evaluated however he did not respond.
Mr. Martin was subsequently lifted off the floor by TVAC personnel and officers and placed on to a
stretcher. During this time Mr. Martin crossed his arms across his forehead. He was instructed to release
one arm so that it could be handcuffed to the stretcher. Mr. Martin refused to do so, and continued to hold
his arms tight around his forehead. Officer Meeks and I subsequently grabbed his left arm and forced it
towards the rails of the stretcher to be handcuffed. Use of force reports were completed in regard to the
incident.
Mr. Martin was subsequently wheeled out to the ambulance located in the parking lot of Police
Headquarters. Upon arriving in the rear vicinity of the ambulance, Mr. Martin appeared to have a mental
episode where he tried to get off the stretcher by flipping it over. He was subsequently held down by TVAC
personnel, Officer Meeks, Officer Meyer, Officer Gonzalez and I. Officer Meeks held both of his legs.
Officer Meyer held his right arm. Officer Gonzalez held his right leg. I pressed his left shoulder, chest and
forehead to the stretcher. Use of force forms were created in regard to this incident.
His free arm was then handcuffed to the stretcher. During this time Mr. Martin opened and closed his
mouth toward the direction of my forearm, implying that he was going to bite me.
Upon their arrival, Mr. Martin was placed in the care of the Emergency Room staff while still in police
custody. He was examined and subsequently treated for his injuries by hospital staff.
Mr. Martin was issued the following summonses in regard to this incident:
-E21 00468 in violation of 39:4-50, Operating Under the Influence of Liquor or Drugs.
After Mr. Martin was cared for by the hospital staff, Mr. Martin contacted his friend, Mr. Fred Pulice, to take
custody of him. Mr. Pulice agreed to come to to take custody of Mr. Martin.
Upon his arrival, I read the Potential Liability Warning to Mr. Pulice aloud. He subsequently agreed to take
custody of Mr. Martin by signing the Potential Liability Warning.
While at the hospital, Mr. Martin was served his respective summonses and his personal property was
returned to him. Mr. Martin signed a Detainee Property Sheet acknowledging that his property was
returned to him.
Due to Mr. Martin's sudden behavior and need for medical attention during processing, Officer Meyer was
assigned to accompany Mr. Martin to the hospital. As a result, Officer Meyer was unable to complete the
Alcohol Influence Report Form during Mr. Martin's time in police custody. In addition to these
circumstances, a shift change in police personnel occurred and another prisoner was brought into the
processing area at police headquarters. The Alcotest Machine was unavailable for use at this time. Officer
Meyer subsequently completed the Alcohol Influence Report Form resulting from Mr. Martin's refusal to
participate in a breath test later that evening during his next tour of duty of duty on August 1, 2021, at 7:00
PM.
