EX PARTE URGENT MOTION FOR RESETTING

THE ACCUSED, by himself, and unto the Honorable Court, most


respectfully states that:

1. This case is scheduled for arraignment and pre-trial on May 22,


2018 at 1:30PM o’clock in the afternoon.

2. However, on May 21, 2018, just a day before the said scheduled
hearing of this case, the undersigned will be appearing in the
MCTC – Tuburan, Cebu to testify as a witness in the case entitled
Inocencio Cometa vs. Brgy. Council of Putat, Tuburan, Cebu,
docketed as civil case No. 403 – TUB. A copy of the pertinent
Notice of Hearing is hereto attached as Annex “1” for your
reference.

3. Due to the distance involved and advanced age, it will be


extremely difficult and dangerous for the undersigned to appear
before the Honorable Court on said date.

4. Hence, the undersigned most respectfully asks for the resetting of


his arraignment.

5. This is not filed in good faith and not to delay the proceedings of
the Honorable Court.
