    COMES NOW, the accused Juanito Postanes thru the undersigned


    counsel and to this Honorable Court respectfully manifests:

    1. That in addition to the documents provisionally marked as


    Exhibits “1” to “15” and its submarkings for the accused Juanito
    Postanes and in accordance with the order of the court dated
    September 1, 2010, the following documents are requested to be
    also provisionally marked as follows:

    Exhibit “16”- the counter affidavit of Juanito Postanes


    dated December 18, 2009 subscribed and sworn to before
    Prosecutor Charles Concon on the same date.

    Exhibit “16-A”- the affidavit of Juvy P. Dizon dated


    December 18, 2009 subscribed and sworn to before
    Prosecutor Charles Concon on the same date which is
    Annex “A” to the said Counter Affidavit, Exhibit “16”.

    Exhibit “17”- the Traffic Accident Investigation Report


    dated May 30, 2009 prepared by SP02 Clemencio Miguel,
    the Investigating Officer.

    2. That the said Exhibits “16”, “16-A” and “17” will form mainly the
    direct testimony of the accused and his witnesses.

    WHEREFORE, premises considered, it is most respectfully prayed of


    this Honorable Court that the foregoing manifestation be noted.
