ARCHITECTURAL DESIGNS SERVICES CONTRACT TERMS &
CONDITIONS FOR TH E PROPOSED EDUCATIONAL FACILITY AT
BANDO,K.E.E.A-CENTRAL REGION
For and on behalf of PKO ENGINEERING SERVICES LIMITED, hereinafter referred to as
the Architectural Designs Consultants, shall undertake the design of PROPOSED FOUR (4)
STOREY EDUCATIONAL COMPLEX WITH ANCILLARY FACILITIES at the above
mentioned location, based on the following terms and conditions:
1 We are to commence the Services as described in the Schedule attached, with effect
from the date of Initial 30% funds transfer for administrative charges has been
effected.
2 We shall carry out our part of this contract to deliver full scale working drawings to the
Client, herein as Mr. Holdbrook Macarthur within a Fifty-Two (52) working days’
period from the day of transfer of initial 30% of total service cost, upon which complete
working designs are to be handed over to the Client.
3 We shall always in the performance of the Services and your other obligations under this
contract, exercise all the reasonable skill and care to be expected from our qualified and
competent Architects in carrying out services in relation to works of a similar nature,
size, scope and complexity to this Project.
4 We shall liaise with any other consultants whom we appoint and notify to you.
5 We shall keep all information concerning the Project confidential unless you receive
our written permission to disclose information.
6 Your contact at this company is Arc. Emmanuel Siaw and you shall liase with him in
relation to this Services only from him unless the company appoints anyone to you prior
further notification in any communication channel.
7 The above-named person shall provide you with such information, consents, and
decisions as you may reasonably request within a reasonable time to aid him carry out
design tasks pertaining to this work scope.

8 We shall procure and maintain professional indemnity insurance of sufficient cover
throughout the period of this design phase and we shall provide a copy of such insurance
when required by the client.
9 Failure to deliver within the stipulated delivery time frame on our part as Design
Consultants for the above mentioned work scope in Clause 2 will attract a design penalty
with written notice to the Client of 15% design service fee to be refunded to client.
10 We may require you to enter into a further agreement in relation to the Project if the
scope of services which we wish you to undertake increases. If such further agreement is
entered into any work undertaken and any payments made under this contract will be
deemed to have been made and undertaken under that agreement.
11 Any dispute or difference arising out of this contract may be referred by either party
at any time to arbitration under the laws of Ghana.
12 This Contract Agreement shall be governed by the laws of Ghana.

FEES SCHEDULE AND SCOPE OF WORKS FOR ARCHITECTURAL DESIGNS
SERVICES
The agreed fee for Architectural designs services for the above project is Eight thousand Ghana
Cedis (GHC 8000.00). Below is the breakdown for the
charges.

Service to commence upon receipt of first payment
Duration of service to be 52 working days after commencement
DELIVERABLES
1. Soft copy of Working drawings documents for all buildings.
2. 4 sets of certified printed copies of drawings.
