W I T N E S S E T H:
That MORTGAGORS are the registered owner of that certain land covered and
embraced by TRANSFER CERTIFICATE OF TITLE No. _______________ situated in
_____________________________, containing an area of NINETY EIGHT (98) Square
Meters, a copy of which is hereto marked and attached as ANNEX “A”, hereof.
That in case of non-payment or violation of the terms of this mortgage or any provisions
of Act No. 3135, as amended by Act. No. 496 as amended, this mortgage shall be immediately
foreclosed, judicially or extra-judicially as provided by law, and the MORTGAGEES, is
hereby appointed Attorney-in-fact of the MORTGAGORS with full power and authority to
take possession of the mortgage property, without the necessity of any judicial order or any
other permission or power, and sell the same at public auction, and take any legal action that
maybe necessary to satisfy the mortgage debt but if the MORTGAGOR shall well and truly
fulfill the obligation above-stated, according to the terms thereof, then this mortgage shall
become null and void;
That if by reason of incurable defects, this mortgage cannot be recorded in the office of
the Provincial Assessor and/or the Register of Deeds for Benguet, the obligation herein secured
shall immediately become due, payable and defaulted;
There is no other instrument affecting the property described above pending registration
or already registered in the Office of the Register of Deeds and/or Provincial Assessor
concerned
That in case of judicial or extra-judicial execution of the obligation herein secured part
thereof, the MORTGAGORS waive all rights under the provision of Rule 39 of the Rules of
Court;
WHEREAS, the parties have agreed to record this instrument with the Register of
Deeds for Benguet in compliance with Act No. 3135, as amended. The Provisions of the New
Civil Code of the Philippines have also been complied with.

ACKNOWLEDGMENT
BEFORE ME, a Notary Public for and in the PROVINCE OF______________, this
___________________, personally appeared the above-named persons all known to me to be the
same persons who executed the foregoing instrument referring to a Real Estate Mortgage and
that they acknowledged to me that the same is their free and voluntary acts and deeds and the
voluntary act and deed of the cooperative herein represented.
I hereby certify that this instrument consists of two (2) pages including this page in which
this Acknowledgment is written each and every page hereof is duly signed by the parties and
their instrumental witnesses.
