REAL ESTATE MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

This deed made and executed by and between:

_____________________________of legal ages, Filipino Citizens, and with residence


address at _________________________, hereinafter referred to as the MORTGAGOR;

- in favor of -

_______________, married, of legal age, Filipino, and a resident of


_____________________, hereinafter referred to as MORTGAGEE;

W I T N E S S E T H:

That MORTGAGORS are the registered owner of that certain land covered and
embraced by TRANSFER CERTIFICATE OF TITLE No. _______________ situated in
_____________________________, containing an area of NINETY EIGHT (98) Square
Meters, a copy of which is hereto marked and attached as ANNEX “A”, hereof.

That for and in consideration of the loan of _________________________


(P________________), Philippine Currency, which the MORTGAGOR have obtained and
received from the MORTGAGEE, and to secure the payment of the same, the
MORTGAGOR hereby transfer and convey by way of first mortgage unto the
MORTGAGEE, his successors and assigns, the above-described property containing an area of
NINETY EIGHT (98) Square Meters , more or less, free from any lien and encumbrance
whatsoever and from any adverse claim of whomsoever.

That to secure their obligation, the MORTGAGORS, do hereby constitute as collateral


and for this purpose convey and deliver by way of real estate mortgage to the MORTGAGEES,
the above-described parcel of land and all improvements existing thereon which are in the
present possession of the MORTGAGORS.

That in case of non-payment or violation of the terms of this mortgage or any provisions
of Act No. 3135, as amended by Act. No. 496 as amended, this mortgage shall be immediately
foreclosed, judicially or extra-judicially as provided by law, and the MORTGAGEES, is
hereby appointed Attorney-in-fact of the MORTGAGORS with full power and authority to
take possession of the mortgage property, without the necessity of any judicial order or any
other permission or power, and sell the same at public auction, and take any legal action that
maybe necessary to satisfy the mortgage debt but if the MORTGAGOR shall well and truly
fulfill the obligation above-stated, according to the terms thereof, then this mortgage shall
become null and void;

That if by reason of incurable defects, this mortgage cannot be recorded in the office of
the Provincial Assessor and/or the Register of Deeds for Benguet, the obligation herein secured
shall immediately become due, payable and defaulted;

There is no other instrument affecting the property described above pending registration
or already registered in the Office of the Register of Deeds and/or Provincial Assessor
concerned

That in case of judicial or extra-judicial execution of the obligation herein secured part
thereof, the MORTGAGORS waive all rights under the provision of Rule 39 of the Rules of
Court;

WHEREAS, the parties have agreed to record this instrument with the Register of
Deeds for Benguet in compliance with Act No. 3135, as amended. The Provisions of the New
Civil Code of the Philippines have also been complied with.

same persons who executed the foregoing instrument referring to a Real Estate Mortgage and

voluntary act and deed of the cooperative herein represented.

this Acknowledgment is written each and every page hereof is duly signed by the parties and
their instrumental witnesses.
