    I, AURELIA B. JABAGAT of legal age, married and a resident of Sra.


    Ascion, San Jose, Negros Oriental and after having been duly sworn to in
    accordance with law, hereby deposes and states:

    Preliminary Statement

    The person interrogating me is Atty. Mary Rose D. Magsayo, with office


    address at Provincial Capitol, Kagawasan Avenue, Dumaguete City, Negros
    Oriental. The interrogation is being held at the same address. I am answering
    her questions fully conscious that I do so under oath and may face criminal
    liability for false testimony and perjury.

    Purpose of Testimony

    The testimony of the witness is being offered to prove that she issued a
    Barangay Certification dated June 30, 2017, to prove that Brix Ferraris is a
    resident of Brgy. Sra. Ascion, San Jose, Negros Oriental, and to prove other
    matters relevant and material to this case.

    Questions and Answers

    Q1 Do you remember issuing a Barangay Certification dated June 30,


    2017?

    A1 Yes, ma’am. I issued a Barangay Certification on the said date upon the
    request of Brix A. Ferraris. I have a copy of the said Barangay
    Certification.

    Manifestation: Affiant hands the attorney a copy of Brix A. Ferraris’


    Barangay Certification that she issued on June 30, 2017.

    Q2 We will have this document marked as our Exhibit “1”, will you confirm
    my action?
    A2 Yes, ma’am.

    Q3 In this Brgy. Certification that we just marked as Exhibit “1”, there is a


    signature on top of the name Aurelia B. Jabagat as the Punong
    Barangay, can you confirm whose signature is this?
    A3 The signature on top of the name Aurelia B. Jabagat, the Punong
    Barangay is my signature, ma’am.

    Q4 In what year did you become a barangay captain of Brgy. Sra. Ascion?
    A4 In 2010, ma’am.

    Q5 How long have you known the plaintiff Brix A. Ferraris?


    A5 I have known him since February of 2016.

    Q6 How did you know him?


    A6 He moved in to the house beside ours. Thus, I got to know him.

    Q7 What other encounters did you have with the plaintiff Brix A.
    Ferraris?
    A7 Since he is living in the house beside ours, I see him every day doing his
    morning and afternoon walk in the beach.

    Q8 Aside from those encounters, did you have any other encounters with
    the plaintiff?
    A8 Yes, he buys cooked food every morning and early evening from my
    store. Another encounter was when he went to my office and
    requested for a Brgy. Certification of Residency.

    Q9 What time does he usually go to your store and buy cooked food?
    A9 In the morning it is about 7:00 - 7:30 in the morning and in the
    afternoon it is usually about 6:30 - 7:00.

    Q10 How about the morning and afternoon walks that you
    mentioned? What time does he usually do that as far as what you have
    observed is concerned?
    A10 In the morning it is usually about 6:00 - 6:30 and in the
    afternoon it is usually 5:30 - 5:45pm.

    Q11 Do you have anything else to say?


    A11 Nothing else, ma’am.
