The plaintiff’s
parents passed
away on
1/07/2010, here
after the death
of his parents
the plaintiff
along with his
sister being the
sole surviours
inherited and
succeeded the
above referred
property as co-
owners and later
plaintiff’s sister
relinquished all
her rights in the
said property in
favour of the
plaintiff by
executing and
registering a
release deed in
his favour. So
the plaintiff
becomes the
absolute owner
of the property.
The plaintiff
submits further
on 30th June
2001.
Defendants
entered into a
lease agreement
and occupied a
portion in the
above
mentioned
property.
Monthly rent
was 5.500/-, for
the period of 11
months. Later
that the lease
passed away
after her death
her children and
in laws
continued the
occupation of
the premises as
tenants, without
giving proper
rent to the
plaintiff so the
legal notice was
issued seeking
recovery of rents
due, to the
defendants.
Since the
defendants
failed to comply
with the
requirements of
said notice
Plaintiff
proceeded with
by filing a suit for
ejectment
against the
defendants, so
that the
defendants are
due rents to
plaintiff a sum of
Rs. 3,13,500/-
being the arrears
of rent.
