The Secretary-General of the United Nations, acting in his capacity as depositary,


communicates the following:

On 28 November 2003 , the Parties 10 the Convention on the Protection and Use of
Transboundary Watercourses and International Lakes adopted amendments to anicles 25 and 26 of the
Convention by decision n Ul, following a proposal by the Government of Switzerland dated 20 August
2003 (see MP.WAT/2003 /4).

The amendments will enter into force for those Panies to the Convention which have accepted
them on the ninetieth day after the date on which two thi rds of those Parties have deposited their
instruments of acceptance with the Secretary-General of the United Nations.

In this connection, it is recalled that the procedurc for the amendment of the Convention is set
forth in Artic lc 21 , paragraphs I , 2, 3 and 4 of the above Convention, which read as follows:

"I . Any Party may propose amendments to this Convention.

2. Proposals for amendments to this Convention shall be considered at a meeting of the


Parties.

3. The text of any proposed amendment to Ihis Com'cntion shaH be submitted in writing
to the Executive Secretary of the Economic Commission for Europe, who shaH
communicate it to all Panies at least ninety days before the meeting at which it is
proposed for adoption.

4. An amendment to the present Convention shall be adopted by consensus of the


representatives of the Panies to this Convention present at a meeting of the Parties,
and shall enter into force for the Parties to the Convention Wllich have accepted it on

For the sake of convenience a model instrument of acceptance is also attached.

Le 28 novembre 2003, les Parties ilia Convention sur la protection et I'utilisation des cours
d'eau transfrontieres et des lacs inlemationaux om adopte des amendements aux anicles 25 el26 de la
Convention par la decision ITIlI, suivant une proposition du Gouvemement suisse dalee du 20 aoul
2003 (voir MP.W AT/2003/4).

Les amendemenls entrerant en vigueur a I' egard des Panies a la Convention qui les ont
accePles le quatre-vingt-dixieme jour qui suit la date it laquel.1e les deux tiers d'entre elles ont depose
leurs instruments d'acceplation avec le Secretaire general des Nations Unies.

A eel egard, il est it rappeler que la procedure d 'amendement la Convention est prevue a a
l'anicle 21, paragraphes 1,2,3 el4 de la Convention susmentionnee, qui se lil comme suit:

" I. Toute Panic peut proposer des amcndemcnls a la presente Convention.

2. Les propositions d'amendements a la presente Convention sont examinees lors d'une


reunion des Parties.

3. Le texte de toute proposition d'amendement a la pn!sente Convention est soumis par


eent au Secretaire e"eculif de la Commission economique pour I'Europe, qui le
communique a toutes les Parties quatrc-vingt-dix jours au mains avanl Ja reunion au
cours de laquelle l'amcndement est propose pour adoption.

4. Tout amendement a la presenle Convention est adopte par consensus par les
representants des Parties a la Convention presents it ulle reunion des Parties et entre

Ai\IE~DMENT TO THE WATER CONVE NTION

The Meeting o f the Parties,

Express lIlg the firm belief that coopcration among ripa rian Stales on transbounda ry
watercourses and intemational1 akes contributes 10 peace and sec urity and la sustainable
wa te r management. and is to everyone' s benefit,

Desiring to promote ri ver basi n cooperation throughout the world a nd to s hare its
experience with other regions in the world,

Wishing therefore to allow States situated outside the UNECE region to become
Pa rti es to the Convent ion, as is already fo reseen undeT other U NECE envi ronmental
conve ntions (i.e. the Convention 011 Access to rnfonnation.
Pu blic Partic ipation in Deci sion-making and Access to Justice in Environmenta l Malfers and
the Convention on Environmental Impac t Assessment in a Transboundary Context) as we ll as
unde r the Protocol on Civil Liabili ty and Co mpensation for Damage Caused by the
Tra nsboundary Effects of Industrial Acc idents on Tran sboundary Walers.

I. Adopts the following amendments to the Convention :

(a) In article 25 , aller pa ragraph 2, insert a I1t.!W paragraph reading

AMENDEMENT A LA CONVENTION SUR L ' EAU

de la CEE relatives a l'environnement (a savoir la Convention sur I'acces a l'infonnation,
la parti cipation du public au processus dec isionnel et l'acces it lajustice en matiere
d'cnvironnement. et la Convention sur J'evaluati on de I' impact sur I'cnvironnemc nt dans un
contex te transfrontiere) ainsi que dans le Protocolc sur la responsabil ite c ivi le et l'inde mni sation
en cas de dommages causes par les erfets transfrontieres d ' acciden ts industricls sur les eall x
transfronticres,
