ORDER

A Motion was filed by Atty. of the Public Attorney’s Office praying


that: 1.) to amend the formal defect in the “Information” to reflect the
correct name of the accused, which is; 2.) to amend the Order of
Release earlier issued, to reflect the said and true name of the
accused; and 3.) other just and equitable remedies. Public Provincial
Prosecutor, , posted “No Objection” on the Motion and submits to the
sound discretion of this Court.

It appears from the records that the accused has entered into a
plea bargaining on July 20__ and had been in detention since his arrest
on May 20__. He was sentenced to suffer the penalty of () year
imprisonment and a fine of Thousand Pesos (P,000) for each case,
subject to subsidiary imprisonment in case of insolvency. The Court
directed the accused to undergo the mandatory requirement of Drug
Dependency Examination (DDE) at the Center for Mental Health, City
or any Department of Health (DOH) accredited facility. On __ January
20__ the Court received the DDE Certificate of the above-named
accused which yielded a “_______” result.

WHEREFORE, in view of the foregoing premises, the Motion is


hereby GRANTED. This Court admits the amendment by changing the
name of the accused. The Court amends the previous Order of Release
dated June __, 20__ to reflect the said correct and true name of the
accused

The Jail Warden of the District Jail, City/the Chief of Police,


Municipal PNP Station, , is hereby directed to release from custody
accused, unless the said accused is being held for some other lawful
cause/s.

In accordance with the memorandum issued by the DILG to


prevent the spread of COVID-19, the accused is hereby ordered to
undergo Mandatory COVID-19 testing. Likewise, his/her release is
made subject to quarantine requirements that may be imposed by the
District Jail/PNP City Police Station, and The City Health Office of City.

SO ORDERED.
