WHEREAS, the City of Brookhaven was created in 2012 and utilized estimates for the creation
of district lines at time of the City’s formation; and
WHEREAS, 2020 marked the first official United States Census conducted since the formation
and incorporation of the City of Brookhaven;
WHEREAS, 2020 was also marked by the first global virus pandemic in 100 years that
adversely impacted the ability and timing for conducting the Official Census;
WHEREAS, the United States Government has announced on or about February 12, 2021 that
Census figures will not be available to cities, counties, and states for purposes of
reapportionment until September 2021, nearly 5 months later than usual;
WHEREAS, pursuant to State law, the City of Brookhaven announced August 18 to 21 as the
dates for qualifying documents to be filed with the City Clerk for purposes of the
General Election of Representatives for Council Districts 2 and 4 to be held in
November;
WHEREAS, the Census data will not be available until after municipal election qualifying
occurs;
WHEREAS, the City Council reasonably believed that the population of the City has grown
since 2012 and that in particular the population of District 4 has changed due to
annexations south and east of Interstate 85;
WHEREAS, the City retained a demographic and population firm known as FLO-Analytics
who specializes in analyzing available data and information to describe
population growth and change;
WHEREAS, FLO-Analytics has established that the City has grown substantially since being
founded in 2012 and that population in District 4 has grown disproportionately to
other districts in part due to annexations;
WHEREAS, the United States Constitutions requires that voting districts be drawn to give
maximum effect to one-person/one-vote as required by the 14th Amendment to the
Constitution;

WHEREAS, Georgia law also establishes that each reapportioned district shall be formed of
contiguous territory with boundary lines the center of streets or other well-defined
boundaries, that variations in populations among the districts created comply with
the one person-one vote requirements of the Constitution, and the
reapportionment is limited to the extent necessary to establish one person-one
vote limits and that the number of representative districts may not be changed,
O.C.G.A. § 36-35-4.1(b);
WHEREAS, the data obtained and analyzed by FLO-Analytics, using criteria and methods that
are generally accepted in the field of demography and relying on data that are
generally relied upon by demographers, establishes that the current district lines
likely violates the one person-one vote mandate of the United States Constitution
and also likely violates the requirements of O.C.G.A. § 36-35-4.1(c).
WHEREAS, due to the fact the census data will not be available until after the time set for
qualifying for municipal elections and the fact that the Council knows that the
current district lines likely violate the United States Constitution and State law,
redistricting is required to have lawful elections in the Fall.
WHEREAS, the Council has conducted reapportionment in the most efficient, transparent,
lawful, and reasonable manner possible during the continuation of the National,
Statewide, and Local Declarations of States of Emergency due to the COVID-19
global pandemic;
WHEREAS, final action on this reapportionment Ordinance is taken more than 180 days prior
to the election scheduled for November 2, 2021, in accordance with
O.C.G.A. § 36-35-4.1(e); and
NOW THEREFORE, the Mayor and Council for the City of Brookhaven, at consecutive
Regular meetings of the Governing Authority for the City of Brookhaven, does HEREBY
DECLARE AND ORDAIN as follows:

1. The statements and conclusions contained in the “Whereas” paragraphs above are made
the findings of fact of the City Council.
3. A new Appendix B is hereby enacted and described as shown in the attached Exhibit 2
describing the new district lines.
4. The City Attorney is directed to provide notice of this redistricting to the Georgia
Secretary of State and to the Legislative Reapportionment Office within 30 days of this
Ordinance, and to the Office of the United States Attorney General, to the extent the law
requires such communication.
