WITHIN THE CITY OF PORTLAND ) Police Bureau to Facilitate
DECLARED FOR APRIL 22-26, 2021 ) Peaceful Demonstrations

WHEREAS, on May 25, 2020, George Floyd was killed by police in Minneapolis, Minnesota;
and

WHEREAS, in March and April 2021, former Officer Derek Chauvin was put on trial for the
death of Mr. Floyd, with the verdict of guilty on all counts issued on April 20, 2021; and

WHEREAS, on April 20, 2021, I issued an emergency declaration effective through Noon
on April 21, 2021, and during the evening of April 20, 2021, an unlawful assembly was
declared in downtown Portland as a result of violence and criminal activity, including an
assault on a police officer and damage to public and private property; and

WHEREAS, on April 21, 2021, I issued an emergency declaration effective through Noon
on April 22, 2021, and during the evening of April 21, 2021, a group of about 40 people
gathered in downtown, lit a fire in the street, blocked traffic, engaged in graffiti, and
damaged crosswalk signals; and

WHEREAS, over the coming days, the City anticipates peaceful demonstrations to
advance the racial justice movement in the country, as well as additional criminal activity
seeking to take advantage of the circumstances created by the peaceful demonstrations;
and

WHEREAS, the City requires the flexibility to quickly respond to any emergency situation
that might evolve during the course of any demonstrations or criminal activity, including
the possibility of violence; and

WHEREAS, the City and the Portland Police Bureau support demonstrators’ rights to
peacefully exercise their First Amendment rights, and an Emergency Declaration will
enable the Police Bureau to effectively facilitate demonstrations by allowing the bureau
to make emergency procurements of food, supplies or other resources, and will allow the
City to exercise other flexibility that is only available under an emergency declaration.
Accordingly, I have determined it is in the best interest of the City to declare an
emergency.

THEREFORE, pursuant to my authority under the Portland City Charter, City Code, and any
other applicable law, I hereby Order as follows:

1. State of Emergency. A State of Emergency exists within the City of Portland under
Portland City Code Section 15.04. The intent of this declaration of emergency is
to help the City facilitate the peaceful exercise of First Amendment rights,
preserve order in the City, and respond to violence as necessary.

2. Other Provisions.

a. In addition to any other power that may lawfully be exercised by local


government, the powers listed in PCC 15.08.020.B are vested in the Mayor,
and further delegated to the Police Chief and Deputy Police Chief.

b. For the duration of this emergency, unless otherwise specified by the


Mayor, the current bureau assignments to the members of the City Council
shall remain in effect as delegated authority under PCC 15.08.020.A.

c. This State of Emergency shall remain in effect through Noon on Monday,


April 26, 2021, unless otherwise extended, modified, or terminated.

d. If any provision of this Declaration of Emergency, or any Emergency


Orders, directives, commands, or other orders issued under the authority
of the Declaration, or their application to any person or circumstance is
held to be invalid, then the remainder of the duly exercised authority,
including the application of such part or provision to other persons or
circumstances, shall not be affected and shall continue in full force and
effect. To this end, the provisions of the Declaration of Emergency, or any
Emergency Orders, directives, commands, or other orders issued under
the authority of the Declaration, are severable.
