DEED OF DONATION
KNOW ALL MEN BY THESE PRESENTS:
This DEED OF DONATION, entered into by and between THONG M. ESMAIL, of legal age, Filipino, married and a resident of Tamar, hereinafter referred as DONOR;
-and-
JACK S. AMBAK, of legal age, Filipino, married, and a resident of Barangay Tamar, Talayan, Maguindanao, hereinafter referred as DONEE;
WITNESSETH:
1. That the DONOR is the lawful owner, occupant and possessor of a portion of land known as P-04174 (EP-11294), situated at Barangay Tamar, Talayan, Maguindanao, containing an area of Twenty-Eight Thousand Five Hundred Nine (28, 509) square meters , more or less , and evidence by Tax Declaration No. 313, issued in the name of ABDULAWI H. EBRAHIM;
2. That for and in consideration and as part of the DONOR’s act of liberality and generosity, the DONOR hereby voluntarily and freely gives transfers and conveys by way of donation, unto said DONEE, a portion of the above-described land, containing an area of 10, 000 square meters to be used as site of KAPYANAN Infrastructures Project, and all rights, title and interest which said DONOR has in the above-described parcel of land, with the condition that all KAPYANAN beneficiaries attached as Annex “A” who is being represented by the DONEE have equal rights over the above-mentioned land with the DONEE.
3. That the DONOR hereby states, for the purpose of giving full effect and validity to this donation, that he has reserved to himself property sufficient to answer for his debts contracted prior to this date;
4. That the DONEE hereby receives and accepts this gift and donation made in his favour by the DONOR, and hereby expresses his appreciation and gratefulness for the kindness and generosity of the DONOR;
5. That the DONEE and the KAPYANAN beneficiaries shall not convey-transfer or lease the above-mentioned land except for hereditary purpose. IN WITNESS WHEREOF, the DONOR and the DONEE have hereunto affixed their signatures this 16th day of November 2020 at Talayan, Maguindanao.
