I, IVY MAE ADOBAS-ALAGASI, of legal age, married, and living at Maa, Davao City, plaintiff
in this case, after having been duly sworn, hereby attest that:
PRELIMINARY STATEMENT
The person examining me is Atty. Leo Artemio Puertos with office address at Lagundi St., Block
47, Lot. 12, Narra Park Residences, Tigatto, Davao City. I am answering his questions fully
conscious that I do so under oath and may face criminal liability for false testimony or perjury.
PURPOSE:
This affidavit of plaintiff is being offered to prove that the defendant was psychologically
incapacitated to perform and comply with the essential marital obligations at the time of the
celebration of their marriage. This was manifested by his immaturity and irresponsibility
towards Ivy and their children during their cohabitation. Further, this affidavit is offered to
prove that defendant was suffering from Maladaptive day dreaming, a psychological disorder,
at the time of the celebration of marriage as examined by Dr. Jan Sevilla, hence, their marriage is
void.

been living separately for three years)

A. Uu sir. Naa mi duha ka anak (Yes sir. We have two children)

A. Dli na nako kaya sir, akong gi testingan ug salba among kaminyuon pero wala
gihapon. Si Norman immature kay sige ra siya ug salig sa iyang ginikanan ug
suporta ug mas gusto niya uban iyang mga amigo kaysa sa akoa nga iyang
asawa ug among mga anak. Sige mi ug lalis ug away atubangan sa among mga
anak, nalouy nako sa akong mga anak kay makita nako sila mohilak kung mag
away mi. Maong naka desisyon nako nga mas mayo nga mag bulag nalang mi. (I
cannot take it anymore sir, I really tried to save this marriage but to no avail. Norman is
immature since he always relied to his parents support and he wanted to be with his
friends rather than his own wife and children. We frequently argue and quarrel in front
of our children; I pity my children sir since they cried upon seeing us fight. This leads me
to finally decide that it is better for us to separate.)
6. Q. Palihug ug klaro kung unsa ang mga higayon nga naka ingon ka nga immature
imong bana. (Can you please elaborate, what particular instance/s you concluded that
your husband is immature.)
A. Cge ni ug kahitabo sir, sige mi ug away. Si Norman walay trabaho, akoa siya
giingnan ug kadaghan na nga mangita ug trabaho para matabangan ko niya ug
buhi sa among mga anak. Pero, sa mga higayon nga ako siyang ingnan, iya
rakong tubagon nga responsibilidad sa iyang ginikanan nga suportahan among
pamilya. Ug isa pa, dili siya kadesisyon sa iyang kaugalingon kung dili siya
mokonsulta sa iyang ginikanan. (This happened frequently sir, we argue on this very
often. Norman is jobless, I asked him several times that he should find a job to help me
support our children. However, in all those instances that I asked him to find a job, he
will just answer me that it is his parents responsibility to support our family. Moreso, he
cannot decide in his own without consulting his parents.)

A. Uu sir. Akong bana mas gilabi ang iyang mga amigo kay sa iyang pamilya.
Panan-aw niya ulitawo gihapon siya ug sige ug dula ug Dota uban iyang mga
amigo gikan gabii hangtod kadlawon. Naa toy isa ka higayon nga iyang
nakalimtan ang birthday sa among anak kay sige siya ug hunahuna sa umaabot
nga Dota Tournament. Mao na mga senyales nga immature siya sir (Yes sir. My
husband values his friends more than his own family. He still thinks that he is single; he
played DOTA with his friends from dusk to dawn. There is one time that he even forgot
the birthday of our son since he was occupied thinking of his upcoming DOTA
tournament. These manifestations are signs of being immature sir.)

the reason, why your husband is having these Negative characteristics?
A. Ang akong bana naga antos sa Maladaptive day dreaming, usa ka psychological
disorder (My husband sir is suffering from Maladaptive day dreaming, a psychological
disorder.)
9. Q. Asa man ka kabalo nga imong bana naga antos ana nga psychological
disorder? (Where did you know that your husband is suffering from that kind of
psychological disorder?)
A. Akong bana kay gi examine ni Doctor Jan Sevilla (My husband was examined by
Doctor Jan Sevilla, a Psychologist.)

Annex A, mao ba ani ang findings ni Dr. Jan Sevilla (Showing you a medical report,
attached as Annex A, can you confirm if this is the findings of Dr. Jan Sevilla?)
A. Uu sir, mao na ang medical report ni Dr. Sevilla (Yes sir, that is the medical report
of Dr. Sevilla.)
17. Q. Unsa man imong ginapangayo sa korte bahin ani nga kaso? What are you
asking this court with respect to this case?
A. Akong gina-ampo sa Honorable nga Korte nga iyang ihatag ang akong petisyon
para sa Declaration of Nullity of Marriage kay Norman Alagasi tungod kay
