CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:
This CONTRACT TO SELL is made and executed by and between:

GOMERCINDO ENIEGO ARANAS, of legal age, Filipino, married, and with
residence at Lower Camanjac, Dumaguete City, Negros Oriental, hereinafter
referred to as the VENDOR;

-AND-

BONNEFIE VILLANUEVA PACLIPAN, of legal age, Filipino, single, resident of
Jawa, Valencia, Negros Oriental, hereinafter referred to as the VENDEE.
WITNESSETH;

WHEREAS, the VENDOR is one of the co-owners by inheritance of a parcel
of land known as Lot No. 2527, with the improvements thereon, situated in the
Barrio of Magatas (presently Calabnugan), Municipality of Sibulan, Province of
Negros Oriental, under Original Certificate of Title (OCT) No. O-V 768, containing an
area of NINE THOUSAND FOUR HUNDRED FORTY -SIX (9, 446) SQUARE METERS,
more or less, which is more particularly described as follows, to wit:

Lot No. 2527
“A parcel of land ( Lot No. 2527 of the Cadastral Survey of

Sibulan, Cadastral Case No. 15, L.R.C. Cadastral Record No. 358),
with the improvements thereon, situated in the Barrio of Magatas,
Municipality of Sibulan, Province of Negros Oriental. Bounded on the
NE. by Lots Nos. 2518 and 2520; on the SE., by Lot No. 2526 and
Okoy River; on the SW. by Lot No. 2528; and on the NW. by Lot No.
2790, containing an area of NINE THOUSAND FOUR HUNDRED AND
FORTY-SIX (9, 446) SQUARE METERS, MORE OR LESS.”
WHEREAS, the VENDEE has offered to buy and the VENDOR have agreed to
sell a portion of the above mentioned Lot 2527, known as Lot 3-F-1 consisting an
area of TWO HUNDRED ONE (201) SQUARE METERS, more or less, under the
terms and conditions herein set forth below;

NOW THEREFORE, for and in consideration of the total sum of ONE
HUNDRED TWENTY THOUSAND SIX HUNDRED PESOS (Php 120,600.00)
Philippine Currency, and of the covenants herein after set forth the VENDOR agree
to sell and the VENDEE agrees to buy the aforesaid portion of Lot 2527, known as
Lot 3-F-1 consisting an area of TWO HUNDRED ONE (201) SQUARE METERS,
more or less, subject to the following terms and conditions:

1. The total consideration shall be ONE HUNDRED TWENTY THOUSAND
SIX HUNDRED PESOS (Php 120,600.00) Philippine Currency, payable as follows:
a) Upon execution of this instrument, the VENDEE shall pay the

VENDOR a partial payment of Twenty Thousand Six Hundred Pesos
(Php 20,600.00);
b) The remaining balance of ONE HUNDRED THOUSAND PESOS (Php:

100,000.00) shall be paid by the Vendee to the Vendor every 17 th of
the month in an amount of TWENTY THOUSAND PESOS (Php: 20,
000.00) each month starting from September 17, 2020 and the
last payment will be on January 17, 2021;

2. Upon full payment of the total purchase price, the VENDOR shall sign
and execute a DEED OF ABSOLUTE SALE in favor of the VENDEE and shall
deliver the necessary papers and documents necessary and available hereto.
3. That the VENDEE shall bear all the expenses of the payment of capital
gain Tax, Documentary Stamp Tax and shall also bear the expenses of the
processing for the eventual transfer of the title in their favor;

day of August 2020 at Sibulan, Negros Oriental, Philippines.
