EXTRA-JUDICIAL SETTLEMENT
AND WAIVER OF RIGHTS
KNOW ALL MEN BY THESE PRESENTS:
This Extra-Judicial Settlement of Estate of the Late Pepito M. Joyosa (decedent)

was made and entered into by and between:
GLADY V. JOYOSA, of legal age, Filipino Citizen,

widow, and with residential address Block 20, Lot
10, Gladiola Street, Adelina 3 Phase 3 Extension,
Brgy. Sto Tomas Calabuso, Biñan City, Laguna;
PATRICK V. JOYOSA, of legal age, Filipino

Citizen, single, and with residential address Block
20, Lot 10, Gladiola Street, Adelina 3 Phase 3
Extension, Brgy. Sto Tomas Calabuso, Biñan City,
Laguna; and
ABIGAIL V. JOYOSA, of legal age, Filipino Citizen,

single, and with residential address Block 20, Lot 10,
Gladiola Street, Adelina 3 Phase 3 Extension, Brgy.
Sto Tomas Calabuso, Biñan City, Laguna.
WITNESSETH:
WHEREAS, on 16 October 2020, PEPITO V. JOYOSA died intestate at Ospital ng

Biñan, Biñan City, Laguna, leaving behind his two (2) Forest Lake South Manila,
Inc. properties covered by Purchase Agreement No. 41061 with Certificate of
Ownership No. 22332, and Purchase Agreement No. 12-13-A with Certificate of
Ownership No. 01292.
WHEREAS, the decedent died intestate without leaving any Last Will and
Testament, and without any outstanding obligations or debts.
WHEREAS, the following are the compulsory heirs of the above-named

decedent. His surviving spouse, GLADY V. JOYOSA, and his children, namely:
PATRICK V. JOYOSA and ABIGAIL V. JOYOSA.
WHEREAS, the compulsory heirs did not have any knowledge of the decedent’s
updaid debts or existing creditors.
WHEREAS, the compulsory heirs agreed to equally divide the remaining

interest of the decedent on the subject properties considering that it is the best
interest of the herein parties to divide, partition, and adjudicate between
themselves the entire interest of the decedent extra-judicially in the manner
and form hereinafter set forth.

WHEREAS, the compulsory heirs PATRICK V. JOYOSA and ABIGAIL V.
JOYOSA hereby waive their rights over the subject properties in favor of
GLADY V. JOYOSA.
NOW THEREFORE, for and in consideration of the foregoing premises, and

invoking the provision of Section 1, Rule 74 of the Rules of Court, the parties
hereto have agreed as they hereby so agree to divide, partition, and adjudicate
the decedent’s interest in the above-described subject properties equally to
themselves, subject however, to contingent liabilities to known creditors, heirs or
other persons who at the time of the execution of this instrument might have
been deprived of lawful participation in the estate of the decedent for a period of
two (2) years from and after the settlement and distribution hereof, in accordance
with the provision of Section 4, Rule 74 of the Rules of Court.
That in the remote event that any other property of the decedent should ever be
found, which is not included herein above, the compulsory heirs hereto further
agree as they do agree to settle and distribute the same in the like manner as they
may agree upon later.
Pursuant to Section 1, Rule 74 of the Rules of Court, the parties hereto shall cause
the publication of the Notice of Extra-Judicial Settlement of the Estate of the Late
Pepito V. Joyosa, once a week for three (3) consecutive weeks in a newspaper of
general circulation.
IN WITNESS WHEREOF, the parties have hereunto set their hands at the City of
Muntinlupa on 19th October 2020.
