I. Scope of work
The term of this contract include the services specifically listed below and includes the
entire terms of the agreement between the parties. Following is the list of services which
come under this contract
1. Architectural plans and working drawings
2. Consulting Drawings
3. BOQ
4. Specifications
5. Construction schedule
6. Schedule of allowance
7. Schedule of site visits

The Owner and the Architect agree as set forth below:

II. Architect’s Responsibilities


1) Field measuring and observation. The architect shall not perform any tests which can
damage the site.
2) The architect shall review the program given by the owner to understand the requirements
of the project.
3) The architect shall review the alternative approaches to design and construction of the
project, with the owner.
4) Preparation of final design, in accordance with the owner’s response towards the design.
The design phase generally consists of 2-3 design revisions, design changes beyond this
number will result in additional architectural fee.
5) The following services are not normally included in the standard service works called as
supplementary services and will be charged separately i.e. energy conservation, market
surveys, art works and graphics, purpose made items, landscape etc.
6) The top-supervision will be charged extra and will come under Supplementary services.
7) Preparation of detailed construction documents for obtaining bids from contractors, for
obtaining building permit and for use by the contractor to construct the project.
8) Construction documents include:
Drawings: plot plan, foundation plan, floor plans, window & door schedule and detail as
required, finish schedules, elevations, sections, interior elevations and sections if required,
electrical plans, plumbing plans, miscellaneous sections and details.
Specifications: site work, concrete, masonry, metals, wood and plastics, thermal and
moisture protection, window and doors, finishes, mechanical, electrical and plumbing.
9) Heating, ventilation and air conditioning design shall be completed by the mechanical
engineers and not included in architect’s scope of work
10) At the request of the owner, the architect will submit copies of these documents to the
builders of owner’s choice for a construction bid estimate and assist the owner in
evaluating these estimates by the reference of BOQ.
11) Architect will visit the construction site according to schedule interpreting the construction
documents (for further information or clarification) and reviewing and approving the
contractor submittals and shop drawings.
12) Architect can reject or change non conforming work and contractor’s drawings
13) Architect is not responsible for any damage to the structure due to natural disaster.
III. Client’s responsibilities:
1) The client shall provide full information regarding requirements for the project including a
program, which shall set forth the client’s design objectives, constraints and criteria,
including space requirements and relationships.
2) The information should be so perfect that the architect may rely on the accuracy and
completeness of the information provided by the client.
3) If the client provides a budget for the project, it shall include the changes in work during
construction and other costs which are responsibilities of the client.
4) If the client observes or become aware of any fault or defect in the project or non-
conformance with the construction document, written notice will be given by the client to
the architect.
5) The cost associated with any structural modification/re-design because of the unforeseen
conditions uncovered during construction/demolition, will be responsibility of the client.
6) It is the responsibility of the client to furnish required information, service, approvals and
decisions for the orderly progress of the architect’s services and the work.
7) Client will pay the architect:
1. for the services and reimbursable expenses provided in accordance with this
agreement.
2. for additional services in the event that they are required after the execution of
this agreement on the basis of the time charge rates set out in this agreement,
including when changes are made which require redesign or redrawing of existing
documents.

IV. Extent of Agreement


This agreement represents the entire and integrated agreement between the client and the
architect and supersedes all prior negotiations or agreements, either written or oral. This
agreement may be amended only by a written instrument signed by both owner and
architect.
V. Fee schedule
1) The fee service will be taken according to project cost based fee system.
2) General payment schedule:
a) Initial payment: initial payment will be paid on the signature of this document.
b) Design phase: Payment at the completion or near the completion of the design
phase.
c) Construction/bid document phase: Payment at the completion of this phase.
d) Supplementary services: such as letters, changes, construction site visits etc are
billable expenses and are due at the completion of the service.
3) The payment according to the progress of project:
a. Mobilization advance ___%
b. On the completion of Schematic plans ___%
c. ON Handing over Architectural Drawings ___%
d. ON Handing over Electro Mechanical Drawings ___%
e. On Handing Over B.O.Q ___%
f. During Construction ___%
4) Architect will charge 8-10% of the total project cost.
5) Architect will charge 60% of his amount during the design phase.
6) Architect will charge 40% during construction.
7) The visits will be charged extra.
8) Architect will visit the site 4 times per month, one by himself and rest by his draft man.
9) Top-Supervision will be charged Rs.________ per month.
VI. Payment
1) The payment will be given in cash
2) If it is given in form of cheque then the check will be cross-chequed.
