EXTRAJUDICIAL SETTLEMENT With Absolute Sale
This Agreement made and entered into in City of Santa Rosa, Laguna by and
between/among:
Heirs of the late SUSANA ESPENIDO TUPAS, who died on October 28, 2017 at Brgy.
San Rafael, Mandurriao, Iloilo City, Iloilo:
Heirs:
NILO JINON TUPAS, widower/husband
RUSTOM NIEL ESPENIDO TUPAS, single
All of legal ages, with residence and postal address at Valencia St., Poblacion Leganes, Iloilo,
hereinafter referred to as the VENDORS.
and
WITNESSETH:
That the above named parties/vendors are the legitimate husband, children and legal
heirs of the deceased SUSANA ESPENIDO TUPAS;
That said deceased died intestate, without Will or Testament, and without any
outstanding debts in favor of any person o entity;
That the deceased a parcel of land situated in Brgy. Tagapo, City of Santa Rosa,
Laguna covered by Transfer Certificate of Title No. T-225435, more particularly described as
follows:
“A parcel of land (Lot 12, Blk.6, of the subd. plan, Psd-04-006859, being a portion of
Lot 2217, Sta. Rosa, Estat LRC. Rec. No.), situated on the Bo. Tagapo, Mun. of Sta. Rosa,
Prov. of Laguna. Bounded on the NW., along line 1-2 by Lot 14; on the NE., along line 2-3-4
by Rd. Lot 1; on the SE., along line 4-5 by Rd. Lot 5; on the SW., along line 5-6 by Lot 10,
on the NW., along line 6-1 by Lot 13 all of the subd. plan. x x Containing an area of ONE
HUNDRED TWENTY SEVEN (127) SQUARE METERS. x x
That pursuant to Sec. 1, Rule 74 of the Revised Rules of Court of the Philippines, and
all of legal ages being with full capacity to contract, we do hereby adjudicate unto themselves
the parcel of land described above, in equal shares.
WHEREAS, the Vendors have offered to sell the ONE HUNDRED TWENTY
SEVEN (127) SQUARE METERS the portion of above-described property situated in
Brgy. Tagapo, City of Santa Rosa, Laguna known as Lot 12, Blk. 6 unto the Vendee;
That we hereby warrant our title unto the said NESTORA VERIDIANO CHAN,
likewise of legal age, married to JACINTO MANALO CHAN JR., and that henceforth,
they shall have exclusive right of ownership and possession over the ONE HUNDRED
TWENTY SEVEN (127) SQUARE METERS the portion of above-described property
situated in Brgy. Tagapo, City of Santa Rosa, Laguna known as Lot 12, Blk. 6, free from all
liens or encumbrances.
IN WITNESS WHEREOF, We have hereunto signed our names this 5 th day of October,
2020 at the City of Santa Rosa, Laguna.
