INTRODUCTION TO CRIMINAL LAW (LEA1393)

TUTORIAL QUESTIONS

Instructions: Answer ALL questions.

1. What is serious offence and non-serious offence? Provide examples for each
offence. (4 marks)

2. Explain the meaning of robbery and its punishment. (4 marks)

3. Briefly discuss THREE (3) situation where a man is said to have committed rape.
(6 marks)

4. Zoro owed Hiro a sum of money. One day, Hiro came to Zoro’s house to ask him
to pay the debt. Zoro refused as he did not have any money. Dissatisfied with
Zoro’s excuse, Hiro, who at that time was holding his mobile phone, hit Zoro at the
face while shouting “minggu depan bayar, kalau tidak mati kau!!” Zoro then
suffered serious bruises on his left eye and cannot see properly for a period of 5
days.

Based on the situation above, answer the following questions:

a) Explain the offence that have been committed by Hero. (4 marks)

b) Identify the actus reus and the mens rea of the offence. (2 marks)

5. Along finds a necklace belonging to Adik in the kitchen of Adik’s house. Along then
took the ring and kept it in his pocket without informing Adik. Explain the possible
offence that has been committed by Along. (5 marks)

6. Jahat and Samseng went into a bookstore where Jahat held up Manis, the cashier,
whilst Samseng emptied the cash box. Jahat and Samseng then fled the scene
with RM 1000 cash. Explain the offences that has been committed by Jahat and
Samseng. (5 marks)

7. Mamat, 24 years old, love to socialize using BeeTalk application. One day, he gets
to befriend with Nina, 16 years old girl through the application. After 2 weeks of
becoming friends, Mamat asked Nina to go out in which Nina agrees to it. During
the meeting, Mamat then asked Nina to have sex with him in the nearby hotel. Nina
refused at first but after listening to Mamat’s words, she consented to have the
sexual intercourse with Mamat on the reason that she already fell in love with
Mamat. Discuss whether Mamat can be charged for any criminal offences.
