INFORMATION

The undersigned accuses WALTER CENIDOZA y CAPILI, VICTORIA


CENTENO y CASTILLO and LERMA HERMIDA y CORTEZ of the crime of
Attempted Estafa, committed as follows:

That on or about June 4, 2004, in the City of Manila, Philippines, the


said accused, conspiring and confederating together and helping one
another, with intent to defraud, did then and there willfully, unlawfully and
feloniously commence the commission of the crime of Estafa, directly by
overt acts, to wit: the said accused, by means of false manifestation and
fraudulent representations which they made to EVANGELINE VILLANUEVA
y DELA CRUZ to the effect that the diamond was sold to her if she could
give an additional P50,000.00 as a final payment for the delivery of the said
diamond, and by means of other similar deceits, induced and succeeded in
inducing her to give and deliver, as in fact she gave and delivered to the said
accused the amount of P50,000.00, but the said accused did not, however,
perform all the acts of the execution which should have produced the crime
of estafa as a consequence, by reason of some cause or causes other than
her own spontaneous desistance, that it the timely discovery of the fraud
and caused the arrest of the said accused.

INFORMATION

The undersigned accuses EFMER GONZALES y SY of the crime of


Attempted Estafa, committed as follows:

That on or about July 3, 2006, in the City of Manila, Philippines, the


said accused, with intent to defraud, did then and there willfully, unlawfully
and feloniously commence the commission of the crime of Estafa, directly by
overt acts, to wit: the said accused, by means of false manifestation and
fraudulent representations which they made to MERALCO herein
represented by CHERYL CUSI y MANALANSANG to the effect that the
Chinabank Check NO. BMT A0000884609 dated July 3, 2006 in the
amount P7,500.00 payable to MERALCO, a manager’s check, which he
represented to said bank for payment for the MERALCO bill of Marivic
Macaraeg in the amount of P4,215.50 and Andres Herrera in the amount of
P1,088.35 or in the total amount of P5,303.85, and by means of other
similar deceits, induced and succeeded in inducing the said bank, but the
said accused did not, however, perform all the acts of the execution which
should have produced the crime of estafa as a consequence, by reason of
some cause or causes other than his own spontaneous desistance, that it
the timely discovery of the fraud, that is, the said check was not funded and
reported stolen, which caused the arrest of the said accused.
