Assignment on “Wages and Payment Wages Board Application in Bangladesh”

Bangladesh Labour Act 2006 was enacted for amending and consolidating the laws relating to
employment of workers, relations between workers and employers, determination of minimum
rates of wages, payment of wages, compensation for injuries to workers during working hours,
formation of trade unions, raising and settlement of industrial disputes, health, safety, welfare
and working conditions and environment of workers and apprenticeship and matters adjuvant
thereto. In order to make the labour law more efficient, amendments have been made to it several
times and finally the latest amended law was enacted in the year 2013 as “Bangladesh Labour
Act 2006”.

Role of Labour Law in protecting Labour Rights:


The labour law is very much important in Bangladesh perspective. It is highly important for the
industrial development of Bangladesh. We know that labour is a most important part of an
industry. So, we cannot think an industry without labour. Labour right is most essential in
Bangladesh. But the labours are in ignorance about their right. They don’t know properly about
labour laws and education. Bangladesh Labour Law 2006 and Amendment 2013 are important to
protect their Labour Rights.

Wages and Responsibility for payment of wages


What is wages?

According to the Section 120 of the Bangladesh Labor Act, 2006 specifies that A fixed regular
payment, typically paid on a daily or weekly basis, made by an employer to an employee,
especially to a manual or unskilled worker.

Wages

 Any bonus or other additional remuneration


 Remuneration payable for holiday
 Money payable for lay-off or temporary dismissal

Responsibility for payment of wages

According to the Section 121 of the Bangladesh Labor Act, 2006 specifies that Every employer
shall be liable to pay to workers employed by him all wages required to be paid under this Act.

 In case of persons employed


 In case of Contactor
Fixation of wage – periods
According to the Section 122 of the Bangladesh Labor Act, 2006 specifies that

 Every person liable for the payment of wages under section 121 shall fix wage periods in
respect of such payment.
 No wage period shall exceed 1 (one) month

Time of payment of wages


According to the Section 123 of the Bangladesh Labor Act, 2006 specifies that

 Payment should be paid before the expiry of the seventh day of the wages period
 If any person is terminated, his/her payment should be paid within 30 days from the day
of termination
 payment shell be made on working days
 Wages to be paid in current coin or currency notes(section 124)

Deduction from Wages


According to the Section 125 of the Bangladesh Labor Act, 2006 specifies that

 Absence from duty


 Damage or loss of goods
 House - accommodation supply
 Recovery of advances
 Income tax payable
 Payment to co - operative society
 Contribution to any fund or scheme
 Contribution to CBA union through check off procedure
 Deduction for Absence from duty (section - 126)
 Deduction for Damage or loss (Section - 127)
 Deduction for service rendered (section - 128)
 Deduction for recovery of loans or advances (Section 129)
 Payment of unpaid wages in case of death of workers (Section 131)

Claims for deductions from wages or delay in payment of wages


According to the Section 132 of the Bangladesh Labor Act, 2006 specifies that

 If any wages is delayed then the employee can apply in the Labor court
 Application should be under the jurisdiction of the labor court- All the information must
be collected accordingly, where they worked, there salary sheet, methods of payment
 Any Application under sub-section 1 –After taking Necessary steps and given an
opportunity of being heard, they can direct the employer on the person responsible for
the payment of wages to refund to the employed person of the amount deducted.
 No direction for the payment of compensation shall be made in the case of delayed
wages if the labor court is satisfied that the delay was due to:
(1) Boniface Dispute as to the amount payable to the employed person
(2) Failure of the employed person to apply to accept the payment
 If the Lab our court finds a malicious act then they will fine two hundred to the applicant
or the Payer.

Conditional attachment of property of the person responsible for payment of


wages
According to the Section 136 of the Bangladesh Labor Act, 2006 specifies that

1 Where at any time-


A. Application has been filed under section 132.
B. Appeal has been filed under section 135.
 Pay wages under sections 121 is likely escape under sections 132 or 135.
 May give opportunity of being heard. Provided before giving any opportunity of being
heard, attach the property.

Provided shall attach so much of the property as is required to meet the direction of payment.

2 All provisions of the Code of Civil Procedure, 1908 (V of 1908), relating to attachment
before judgment, apply to any order for attachment

WAGES BOARDS:
Establishment of Minimum wages Board:

1) The Government shall establish a board to be called the minimum wages board.
2) the minimum wages board, hereinafter referred to in this chapter as the wages board, shall
consist of-
a) a chairman;
b) one independent member;
c) one member to represent the employers, and
d) One member to represent the workers.
Fixation of wages for newspaper workers:

In fixing rates of wages in respect of newspaper workers the Newspaper wage board shall take
into consideration the cost of living, The Newspaper wage board may fix rates of wages for time
work and for piece-work.

Minimum wages to be binding on all employers:

The minimum tares of wages declared under section 140 or published under section 145 shall be
binding on all employers concerned and every worker shall be entitled to be paid wages at a rate
which shall, in no case, be less than the rate of wages so declared or published.
