ASSIGNMENT - DEED

THIS ASSIGNMENT DEED IS MADE AND EXECUTED AT


PIMPRI ON THIS 9 th DAY OF OCTOBER IN THE YEAR 2000.

HEREINAFTER CALLED “ THE VENDOR/ TRANSFERER.”

HEREINAFTR CALLED “ THE PURCHASER / TRANSFEREE “


( which expression shall unless it be repugnant to the context or
meaning thereof be deemed to include his heir , executors
administrators and assigns. etc]

TOTAL CONSIDERATION : 4,80,000/-


{Rs. FOUR LAKHS EIGHTY THOUSAND ONLY . }

GOVT. VALUATION : 2,96,000/-


{Rs. TWO LAKHS NINETYSIX THOUSAND ONLY . }

WHEREAS the Vendor is absolutely seized and possessed of all


that piece and parcel of said SHOP in the RAMNAGRI ,
BHOSARI, Pune -39 situated at Survey No. 207/1 , C. T. S. NO.
4380 Village Bhosari, Tal : Haveli, Dist : Pune, SHOP No. 1,
situated on the GROUND Floor admeasuring 299.689 sq. fts. i.e.
27.85 sq. mtrs. and within the local limits of Pimpri Chinchwad
Municipal Corporation, & P.C.N.T.D.A.

AND WHEREAS the Vendor herein have purchased the said


SHOP from M/S D. R. GAVHANE PROMORWE & BUILDER
Having office at RAMNAGARI, ALNANDI ROAD, BHOSARI,
PUNE - 411039. Got the peaceful and vacant possession of the said
Flat and particularly described in schedule hereinunder.

AND WHEREAS the VENDOR is the actual and peaceful


possession of the said flat more particularly described in the
Schedule hereunder written and holds shares of the said flat shares
and a shares Certificate to that effect has been issued by the said
society.

AND WHEREAS the Vendor herein described to sale all his


rights, title and interest in the said flat and the purchaser is in search
of Residential accommodation approached the Vendor and offered
to pay and amount of TOTAL CONSIDERATION : 4,80,000/-
{ Rs. FOUR LAKHS EIGHTY THOUSAND ONLY . } towards
the said sale and the said flat offer was agreed by the purchaser.

AND WHEREAS the Vendor and the Purchaser have entered


into an Agreement For sale on 10/8/2000 and said agreement for
sale has been registered before the Sub- reg. Haveli No. V pimpri
Pune Bearing Regd. No. 6742/2000 dated 10/8/2000. In pursuance
of the said agreement for sale . The vendor herein has agreed to
transfer the property described in the schedule ‘I’ & ‘II’ to the
terms and conditions mentioned hereunder.

NOW THIS AGREEMENT WITNSSETH AND IT IS HEREBY


AGREED BY AND BETWEEN THE PARTIES AS FOLLOWS.:-

1] That the vendor herein has received the total consideration in


respect of the property described in the schedule ‘ I & II ‘ hereunder
written and the vendor hereby admits and acknowledge the receipt
of Rs. TOTAL CONSIDERATION : 4,80,000/- {Rs. FOUR
LAKHS EIGHTY THOUSAND ONLY . } on execution of these
presents as per the mode of payment given below.

2] That the vendor hereby transfers the said property described in


the schedule ‘ I & II‘ hereunder written by way of Assignment deed
to the purchaser free from encumbrances and have consented to
transfer all the rights, liberties and easement, appurtenant there to
without any interruption for obstruction from any person to use and
to hold same by the purchaser, his heirs, executors, administrators,
and assigns etc., absolutely and forever.

3] That the vendor hereby covenant and declare that the


vendor is having absolute ownership of the property and therefore
the vendor is having full power and absolute right to deal with the
property according to his own will.
4] That the vendor hereby covenant with the purchaser that not
withstanding any act, deed or things herein before contained
executed done or omitted by the vendor to the contrary are now
lawfully seized and possessed of the said property free from all
encumbrances like charge, lien; attachment , mortgage or any other
defect in the title whatsoever and the vendor hereby undertakes to
clear all the defect in the title in the future.

5] That the vendor hereby assures to the purchaser that the


vendor has not entered into any agreement for sale in respect of the
property described in the schedule I & II hereunder written and the
property has not become the subject matter in any court proceedings
or libations in any court of law.

6] That the vendor herein has already transferred the actual


and physical possession of the property in the schedule ‘ I & II‘
described hereunder and the purchaser is at liberty to deal with the
said property to his own will as the exclusive owner thereof.

7] That the vendor hereby further covenant and declare that in


case of any claim or other demand by any person from the vendor or
on his behalf or in trust of the vendor being made, the vendor shall
always keep the purchaser harmless, indemnified from all such
demands etc and or call of whatsoever nature in respect of the
property hereby transferred to the purchaser and the vendor hereby
further covenant and declare that the vendor has paid all the taxes to
the competent state & Local authorities till the date of execution of
these presents and all the taxes from the date of purchase are to be
paid by the purchaser, however, if the purchaser is required to pay
any of the dues prior to the date of purchase the vendor shall made
good such sum or dues paid by the purchaser and keep harmless and
indemnified at all times.

8] That the vendor herein undertakes to sign and submit the


applications papers, documents etc, to the competent authorities for
the effectual transfer of the property described in the schedule
hereunder written in the name of the purchaser.

9] That the stamp duty, Registration charges, advocate fees and


incidental expenses relating to agreement for sale and Assignment
deed shall be borne by the purchaser.

10] That the property described in the Schedule I hereunder


written is which is incorporated and registered under the provisions
of Maharashtra Societies Act and this Agreement shall always be
subject to the provisions of Maharashtra Ownership Flat Act, 1963
and Rules made thereunder as amended and applicable from time to
time.

11] The electricity meter stands in the name of the Vendor and the
transferor undertakes to sign. and verify all such documents
necessary to transfer the electricity in favour of the purchaser at the
Purchasers cost. And the said society/builder has given NOC to the
said transaction.

12] The Vendor will give all the necessary papers, signs. Affidavits
for entering the name of the present purchase in all there records P.
C. M. C. and in all Government records.

13] MODE OF EXECUTION:-


A] Rs. 1,000.00 Paid be Cash as earnest Money.
B] Rs. 1,56,000.00 Paid by cheque bearing No.

SCHEDULE -- I

All that piece and parcel of the situated at S.No. 207/1 CTS
No. 4380 Bhosari, Pune, within the registration District Pune Sub -
District Taluka Haveli & situated within the limits of Pimpri
Chinchwad Municipal Corporation and Pimpri Chinchwad New
Town Development Authority, Admeasuring 3000 sq. metr. each
bounded as under. :-
On or towards East : S. NO. 207/1.

On or towards West : S. NO. 207/1.

On or towards South : BHOSARI - ALANDI ROAD.

On or towards North : S. NO. 207/1.

SCHEDULE – II

All that piece and parcel Shop No. 1, GROUND Floor, BUILDING
NO ‘C’ , Built up Admeasuring about 299.689 Sq. ft. i.e. 27.85
Sq. mtrs. in building known as RAMNAGRI, WING - C. and
bounded as under.
LOCATION :- OTHER THAN BHOSARI GAOTHAN.

IN WITNESS WHEREOF THE PARTIES HERETO HAVE


HEREUNTO AND SUBSCRIBED THEIR
RESPECTIVEHANDS. AND SEALS ON THE DAY AND
DATE HEREIN ABOVE FIRST WRITTEN.
