Weekly Legal Updates Feb Week 2 2019

The Triple Talaq Bill, Citizenship (Amendment) Bill, and Aadhaar and Other Laws (Amendment) Bill will all lapse as the Rajya Sabha adjourned sine die on February 13, 2019. These three bills passed by the Lok Sabha but were pending in the Rajya Sabha, which will dissolve before the next general election in June 2019. As a result, bills pending between the two houses will automatically lapse. Additionally, a book on former Chief Justice of India PN Bhagwati was inaugurated by the current CJI. Finally, the second circuit bench of the Calcutta High Court will open in Jalpaiguri on March 9, 2019.

1. Aadhar, Citizenship and Triple Talaq bills Lapse after RajyaSabha Adjourns Sine Die:

The Triple Talaq Bill [Muslim Women(Protection of Rights on Marriage)Bill], Citizenship(Amendment) Bill
and the Aadhaar and Other Laws (Amendment) Bill, all these three significant bills shall lapse as the
RajyaSabha was adjourned sine die on 13th February 2019. All these three bills were passed by the LokSabha
and were pending in RajyaSabha but since this was the last session of Parliament before the 16thLokSabha
would be dissolved before June 2019 these bills would automatically lapse.

If a bill has been passed in LokSabha but is pending before the RajyaSabha and during its pendency in
RajyaSabha the LokSabha gets dissolved, then the bill gets lapsed. On the contrary if a bill has been
introduced and passed in the RajyaSabha and is pending before LokSabha and if during that pendency
LokSabha gets dissolved, then the bill would not get lapsed, it would be considered as valid and and can be
passed in the LokSabha in the next session of Parliament when a New LokSabha is constituted as Rajya is a
permanent house and it never gets dissolved.. (According to Article 107 of the Indian Constitution).

2. 'Law, Justice and Judicial Power Justice PN Bhagwati's Approach' – A book written on former
Chief Justice of India Justice P N Bhagwati by Mool chand sharma inaugurated by CJI RanjanGogoi.

3. Second Circuit Bench of Calcutta High Court to be opened at Jalpaiguri:

The second circuit bench of Calcutta High Court would start functioning from 9th March 2019 at Jalpaiguri.
The Calcutta High Court has its principal bench at Kolkata, a circuit bench at Port Blair, Andaman and
Nicobar Islands and the second circuit bench would start at Jalpiguri.
