EMPLOYMENT CONTRACT

KNOW ALL MEN BY THESE PRESENTS:

This PART-TIME EMPLOYMENT CONTRACT (“Contract”) is executed this ___

WITNESSETH:

WHEREAS, the EMPLOYER is

WHEREAS, the EMPLOYER requires the services of part-time employees to


work as __________________;

WHEREAS, the PART-TIME EMPLOYEE is willing to perform such services for


the EMPLOYER and to accept the responsibilities arising therefrom, subject to the terms
and conditions hereinafter provided;

WHEREAS, the PART-TIME EMPLOYEE unconditionally agrees to be engaged


strictly on a part-time basis;

NOW THEREFORE, for and in consideration of the foregoing premises, the


parties bind themselves as follows:

SECTION I
Details of Employment

1.1. Position:

The PART-TIME EMPLOYEE is engaged by the EMPLOYER as a _____________


and shall satisfactorily perform the work as such according to the terms of this
Contract.

SECTION II
Compensation and Benefits

2.1. Salary

The PART-TIME EMPLOYEE shall be entitled to receive a salary equivalent to


the _________________ PESOS (Php___________.00) for each hour of actual work,
which shall be payable every ____ and _____of the month.

2.2. Allowable Deductions:

The PART-TIME EMPLOYEE agrees that the EMPLOYER shall calculate and
deduct from the salary such personal income taxes and premiums payable by the
PART-TIME EMPLOYEE pursuant to mandatory government regulations and
programs including, but not limited to, income tax/es, and Social Security,
PhilHealth and HDMF contributions.

2.3. Benefits

The PART-TIME EMPLOYEE is entitled to receive all payments and benefits


provided under the existing company policies and regulations, under existing
laws and government circulars, as well as those that may be subsequently issued
by competent authorities, and those that may be extended to him by the
EMPLOYER from time to time.

SECTION III
Conditions of Employment

3.1. Term of Employment:

The PART-TIME EMPLOYEE shall commence his employment with the


EMPLOYER on _________________ until _________________, unless extended by

the Parties and/or unless the EMPLOYER absorbs the PART-TIME EMPLOYEE
as a regular employee.

3.2. Work Schedule:

3.3.1 The PART-TIME EMPLOYEE shall be required to work at least ____ hours
a week. The work schedule will be subject to the PART-TIME
EMPLOYEE’s availability and class schedule.

The EMPLOYER may adjust the work schedule of the PART-TIME


EMPLOYEE during examination weeks in school, with prior request by
the latter.

3.3.2 Depending on the availability of the PART-TIME EMPLOYEE, the


EMPLOYER may, from time to time, request for extension of working
hours on weekends and holidays, as the exigencies of the service requires.

3.3.3 The PART-TIME EMPLOYEE shall be willing to be assigned anywhere as


may be required by the EMPLOYER and as the exigencies of service may
require.

3.3 Sick Leaves

If the PART-TIME EMPLOYEE will not be able to go to work because of sickness,


he/she must promptly notify the EMPLOYER or his/her immediate supervisor.

3.3. Termination of Employment:

3.4.1 In addition to the grounds specified by law, the EMPLOYER may


terminate the employment of the PART-TIME EMPLOYEE, at any time,
for violation of the EMPLOYER’s rules and regulations.

3.4.2 The PART-TIME EMPLOYEE may likewise terminate the Contract by


serving a written notice to the EMPLOYER at least thirty (30) days from
the intended date of his/her resignation.

3.4.3 The PART-TIME EMPLOYEE, upon the termination of his employment


with the EMPLOYER, shall return, surrender, deliver and turn over to the
EMPLOYER any and all properties, items and supplies issued to him in
the course of his employment. The PART-TIME EMPLOYEE shall pay the
EMPLOYER the replacement cost of any property or item, which is lost,
damaged or which he fails to surrender or return. The EMPLOYER may
deduct the said cost from the PART-TIME EMPLOYEE’s salaries,
severance pay and/or other emoluments and pecuniary benefits.

SECTION FOUR
Others

4.1. Non-exclusivity:

The PART-TIME EMPLOYEE may accept any other employment, whether full-
time or part-time, or engage in any occupation, trade, business or profession.

However, the PART-TIME EMPLOYEE should disclose his/her other
employments to the EMPLOYER.

4.2. Confidentiality:

The PART-TIME EMPLOYEE binds himself not to disclose or make use of any
information or data acquired or gained in the course, or as an incident, of his
employment with the EMPLOYER. Such information includes, but is not limited
to the following:

(a) Sales and Marketing data;


(b) Company policies, processes, procedures and strategies;
(c) Financial Information;
(d) Pricing and costing of products and services;
(e) Profiles/Files of Clients;
(f) Other database files, information, communications, reports,
materials, queries, literature and procedures;

SECTION FIVE
General Provisions

5.1. Inclusions:

The PART-TIME EMPLOYEE shall comply with all the policies, rules and
regulations, orders and instructions that the EMPLOYER may issue hereafter
from time to time, which are deemed to be integral part of this Contract.

5.2. Performance Appraisal

The EMPLOYER retains the right to conduct periodic written appraisals of the
PART-TIME EMPLOYEE’s performance. The EMPLOYER and PART-TIME
EMPLOYEE agree that all performance appraisals shall be in writing.
