1. In the Northern Territory, Occupational Health & Safety is covered by


which Act?

The Work Health and Safety (National Uniform Legislation) Act 2011-the WHS
(NUL) Act- covers the Occupational Health and Safety in Northern Territory.

2. What is the standard of proof in court for a conviction for breaching the
Act?

The standard of proof for a breach of the Act or regulations is beyond reasonable
doubt- the criminal standard.

Role of the Employer

3.List the employer’s duties as defined under the act


a. shall provide and maintain so far as is reasonably practicable
I. a safe working environment
ii. safe systems of wok
iii. plant and substances in a safe condition

b. shall provide adequate facilities of prescribed kind for the welfare of


employees

4. An employer shall also:

a. Keep information and records relating to work related injuries

b. Provide information to employees in relation to health, safety and welfare in


the workplace

c. Ensure that proper information, instruction and training is given.

5. Explain ‘vicarious liability’ in your own words.

Vicarious Liability means holding one person liable for the actions (which can be
damages and harms) of another person. Considering job, it can be elaborated that
employer will take legal responsibility for the action of employees during employment
tenure.

6. The occupier must ensure that there is safe access and safe

egress from the premises.

7. Adequate fires standards must be met which includes:

a. Fires extinguishers

b. Fire blankets and sometimes

c. Fire training

8. What sort of facilities need to be provided?

Toilet and wash facilities, supplies of drinking water, adequate lighting, ventilation
space and meal accommodation

9. Who is responsible for the safety of work systems?

10. An employer or a self-employed person shall take reasonable care to:

a. Select and maintain safe palant ad equipment. This would include such
things as vehicles and firearms

b. Relevant safety equipment must be maintained at the premises. This could


include earmuffs, ear plugs, glasses and hard hats.

MAINTAIN WORKPLACE SAFETY SCENARIO

You are working security in a large night-club. The music is extremely loud in the
venue and you notice that at the end of your shifts your ears are often ringing.

You have also noticed several other issues in your workplace including loose tiles at
the front steps, glass on the floor from broken glasses and severe overcrowding.

In addition, you have also noticed that the fire exits are locked to prevent under-age
customers sneaking in.

17. What could you do to alleviate the loud music problem?

It is better to use earmuffs or earpiece. If problem persists, I will discuss the problem
with other security guard whether they are having same issue or not. If all guards are
having same problem, then reservations can be given to supervisor

18. Who would you report your concerns to?


I would report my concerns to supervisor.

19. What could you do as a security officer to reduce the problem of glass
on the floor?

First, I will put the signboards indicating broken glass. After that I would ask the
management to send cleaning staff to clear the floor with complete precautions.

19. Can you identify any protective equipment that may be relevant to the
