Philippine South China Sea Conflict: Territorial Arbitration
The relationship of the two countries has long and profound history. China has been a wide contributor on the Philippine economy and vise versa. The bond ties the two nations and both has a mutual benefit concerning the industry. The Philippines has an increase in tourism aspect and there is a growing of trade industries between the two nations. Philippines and China are fortunes in terms of economy and fast-growing nations. However, on April 2012, Philippines and China relations was dominated by Territorial Dispute in the west Philippine sea. The Philippines must be empowered in this issue. It must fight for what it owns in spite of economic relations built for a more developed country. The term” west Philippine sea was used during the admiration of former president Benigno Aquino last 2011. Its institutions were to dispute the china’s sovereignty claim over the Whole South China sea. In September 2012, the Philippine Government announced that it would start using the name to refer to waters west of the Philippines as “West Philippine Sea”. It is challenging for the Philippines to overcome China which is a powerful country. on January 2013, the Philippine government filed an arbitration case against china under the United National Convention on the law of the Sea (UNCLOS) challenging the legality on 1987 “the state shall pursue an independent foreign policy. In its relations with other states the paramount consideration shall be national sovereignty, territorial integrity, national interest and the right to self-determination. Based on the law, the Philippines has control on its territory and the “the state shall protect the nations marine wealth in its archipelagic waters. Territory Sea, and Exclusive Economic Zone and reserve its use and enjoyment exclusively to Filipino Citizens”. Indicated is the EEZ part of the south china sea wherein the eastern within the Philippine exclusive zone. However, Philippines-China relations quickly went from bad to worse. At around the same time, Aquino face early challenges in his presidency that were coincidentally directly or indirectly link to the Philippines-China relations, for example the botched rescue operation to save a bus filled with Hong Kong tourist in Manila in 2010, the shooting of the Taiwanese fishermen by the Philippine Coast Guard in mid-2013, and the Chinese execution of Filipino drug-mules despite appeals for clemency by the Philippine president. The permanent court of the Philippine government ruled in favor of the Philippines. On July 12, 2016, the tribunal ruled that china has “no historical rights” base on the nine-dash line map. According to former President Benigno Aquino III “we will not be push around because we are a tiny state compared with theirs” The former President is ready to fight for our territory. Thus, it is a powerful one that motivate every Filipino that we should fight for our own territory. China has nothing to do with west Philippine sea as it was under the nine-dash line map of the Philippines.
