ORDER
Filed before this Court on 15 April 2015 is an information for
Reckless Imprudence Resulting in Damage to Property signed by Deputy City Prosecutor Cefelene R. Goco against the accused Archie Bucas y Lacatan of Bgy. Sabang, Pinamalayan, Oriental Mindoro.
After conducting a through evaluation of the record particularly the
sworn statements of private complainant Rowena Baculo Fabicon and her witnesses, the undersigned finds reasonable ground to believe that the crime charged has been committed and that the above-named accused might be guilty thereof.
Considering that the instant criminal action is penalized by fine
only, the Court will not issue a Warrant of Arrest pursuant to Section 6, paragraph (c) of Rule 112 which reads:
(c) When warrant of arrest not necessary- A warrant of
arrest shall not issue if the accused is already under detention pursuant to a warrant issue by the Municipal Trial Court in accordance with par. (b) of this section, or if the complaint or information was filed pursuant to section 7 of this Rule or is for an offense penalized by fine only.
ACCORDINGLY, let the arraignment of the accused be set on 03
June 2015 at 1:30 o’clock in the afternoon.
