    ACCUSED, JAN RUSSEL MEJARES y YULO, unto this Honorable


    Court, hereby applies for probation under the provisions of Presidential Decree No.
    968, as amended, and further declares that:

    1. He is of legal age, Filipino and a resident of Brgy. Nangka, Bayawan


    City, Negros Oriental;

    2. He has been convicted of the crime for violation of Sec. 12, Article 2 of
    Republic Act 9165;

    3. He has not begun to serve the term of imprisonment imposed on him;

    4. The crime of which he was convicted is not an offense against the


    security of the state nor an offense against public order;

    5. He has not been previously convicted by final judgment of any offense


    punished by imprisonment of at least one (1) month and one (1) day
    and/or a fine of Two Hundred Pesos (Php.200.00) or more;

    6. He has not been on probation under the provisions of Presidential Decree


    No. 968, as amended.
