PETITION
Petitioner, through the undersigned counsel, after having duly sworn

to in accordance with law do hereby depose and say :
1. That petitioner, of legal age, Filipino, widower and residing at

Purok 2-B, Barangay Barucboc, Quezon, Isabela;
2. That the petitioner got married to Susana C. Roadilla(Susana for

short) on 1 May 1997 at Jesus is Lord Church, Caloocan City. A copy of
Certificate of marriage[1] is attached hereto and made an integral part of
this petition;
3. That during the period of their cohabitation as husband and

wife, on 4 June 2007, they were blessed with their first child named
SHEKINAH CHLOE PADIN y ROADILLA and registered before the
Office of the Local Civil Registrar of Quezon, Isabela wherein the
petitioner and his wife Susana as the father and mother respectively. A
Certificate of Live Birth[2] is attached hereto and made an integral part of
this petition;

4. After a couple of years, their second child named SETH
ANGELO PADIN y ROADILLA was born and later registered before the
Local Civil Registrar on 5 June 2009. A Certificate of Live Birth[3] is
attached hereto and made an integral part of this petition;
5. Since then up to present, both SHEKINAH CHLOE PADIN y

ROADILLA and SETH ANGELO PADIN y ROADILLA were under
their proper care, moral and spiritual guidance, financial and emotional
support and custody. They established and raised their family home and
actually resided at District 2, Reina Mercedes, Isabela;
6. But an unfortunate turn of event had happened on 5 May 2017

when Susana succumbed into illness that leads to her untimely death
evidenced by the attached Certificate of Death;[4]
7. During their cohabitation as husband and wife, they acquired

real and personal properties enumerated as follows:
7.a Seven hundred(700 sq,m) square meters Residential Lot

situated at Barucboc, Quezon Isabela
7.b Insurance Policy at Sunlife of Canada Inc evidenced by
Certification Letter[5];
8. Due to the minority of the said minors, it is necessary and

convenient that a guardian over their person and property be appointed;
9. Letters of guardianship are prayed for by petitioner, with

whom the minor is at present residing, and as guardian, it is for their best
interest;

PRAYER
WHEREFORE, it is respectfully prayed that, after due notice and

hearing, petitioner be appointed guardian over the person and estate of
both SHEKINAH CHLOE PADIN y ROADILLA and SETH ANGELO PADIN
y ROADILLA and that the corresponding letters of guardianship be issued in his
favor, and for such reliefs as are provided for in the Rule of Guardianship of
Minors.

Barucboc, Quezon, Isabela, after having been duly sworn to in accordance
with law do hereby deposes and states:
1. That I am the petitioner in this case and that I caused the

preparation of the foregoing PETITION FOR GUARDIANSHIP OF
MINORS; that all the allegations therein are true of my own personal
knowledge based on authentic documents;
2. That I hereby certify that I have not commenced any other

action or proceeding involving the same issue in the Supreme Court, the
Court of Appeals, the Regional Trial Court or any other Tribunal or
Agency;
3. That there is no other such action or proceeding presently

pending or terminated in the Supreme Court, the Court of Appeals, the
Regional Trial Court or any Tribunal or Agency;

4. That if I should thereafter learn that a similar action or
proceeding has been filed or is pending before the Supreme Court, the
Court of Appeals, the Regional Trial Court, or any other Tribunal or
Agency, I undertake to report the fact within five (5) days there from to the
Court or Agency wherein the original pleading and this sworn certification
has been filed.
