RA 7920 ART. IV SECTION 33

Personnel Required . – Except as otherwise provided in


this Act, every electric plant, industrial plant or factory,
commercial establishment, institutional building, watercraft,
electric locomotive or in any other installation where persons
and properties are exposed to electrical hazards shall not
have less than the following complement of professional
electrical engineer, registered electrical engineer, and
registered master electricians.

Electric plants, industrial plants, factories, commercial establishments, institutional
buildings, watercrafts or electric locomotives having a capacity;
a.) Greater than 500KVA and 600V
- one (1) PEE or REE

b) 500 KVA and 600V below


- one (1) RME

c) not applicable to any installation which has a capacity of 50KVA


and 250V or less,
- maintenance and repair by registered personnel
- yearly inspection & certification of safe operating
condition by PEE, REE or RME
Note: Item c is not requiring the certificate of electrical compliance .
The LGUs should implement this law as a requirement for the renewal of
business permit
application ( Certificate of Electrical Compliance see slide 32 or Annual Electrical
Certificate

• *** Additional qualified personnel shall be employed to


ensure safe operation and safeguard public welfare

• *** For twenty-four (24) – hour operation


• - one (1) qualified personnel in each shift

• EX. Hospital or Manufacturing Plant requires 3 qualified


electrical practitioners if 24 hrs operation.
TYPE OF BUILDINGS/ ESTABLISHMENT

COMMERCIAL BUILDINGS - refer to office buildings and


all buildings which are intended for use primarily in
wholesale, retail and service trades; i.e. stores, hotels,
restaurants, banks, disco houses, etc.
INDUSTRIAL BUILDINGS -are all buildings used to
house the production, assembly and warehousing
activities of industrial establishments; i.e. factories,
plants, mills, repair shops, machine shops, printing
press, storage plant, electric generating plants, power
substation/distribution.

INSTITUTIONAL BUILDINGS -are buildings which primarily


engaged in providing educational instructions and
hospital/health care; ports, airports and other government
buildings; i.e. educational facilities, museums, libraries, sanitaria,
hospitals, railway station, military bases.
AGRICULTURAL BUILDINGS- are buildings used to house
livestock, plants and agricultural products such as barn, poultry
house, piggeries, stables, greenhouses and grain mill.

• I. COMPOSITION OF INSPECTION TEAM
• A.) Metro Manila
• Three (3) National Officers and/ or Former National President or any combination thereof.
• Anyone of the team members can be designated as a team leader.
• B) Regions
• The Regional Governor shall act as a team leader with the incumbent Chapter Presidents
• and/ or Immediate Former Chapter Presidents or any combination thereof shall be
• designated members.
• C) Appointment Process
• Regional Governors to submit/recommend to Board of Governors for endorsement to the BEE their identifies
jurisdiction or area of responsibilities and qualified assistance/inspection team. Upon approval of endorsement,
• the BEE shall issue appointment letters to the Regional Assistance/Inspection Team.
• D.) List of Establishment ( Additional Proposed Recommendation By The Committee )
• Identified list of establishments should be attached along with the list of inspection team being
• recommended/submitted by the Regional Governors and copy furnish to the committee for monitoring purpose.
• Note:
• A. The designated inspection team should only expedite their function upon received of the appointment letters.
• B.The Inspection team - has a (1) one year term.

• INSPECTION PROCEDURE
• 1.) REQUIRED VISITATION LETTER ( see sample )
• 2.) To wear official IIEE Regional/Chapter uniforms
• 3.) Observe company's rule and regulation.
• 4.) Explain the importance of the law, the procedures for application of electrical compliance
and leave them the copy of Letter from BEE Chairman, 3 Nos of BEE forms ie. BEE-SID-01
• BEE-SID-03 AND BEE- SID 04. ( See sample)
• 5) Fill up the inspection report and let the company's representative to sign it and leave 1 copy
for them. Technical or audit inspection is not required.( Report should be emailed to
[email protected] for monitoring purpose)
• 6) Have a group picture with them for documentation purpose and submit to the committee.
• Note:
Avoid entering or inspecting company's facilities ie. substation, power room etc. as our
main objective is to assist and help them to comply and not to police.

the nearest PRC Regional Offices. (Baguio Ciy, Legaspi City, Lucena City, Cagayan De Oro City,

• TO STRICTLY ENFORCE THE SECTION 33 OF RA 7920, THE OFFICERS OF
THE LAW ie. NATIONAL GOVERNMENT, CITY OR MUNICIPAL
GOVERNMENT SHALL IMPLEMENT THE PROVISIONS OF THIS LAW BY
REQUIRING ALL BUSINESS ESTABLISHMENT AS PRE REQUISITE OR
MANDATORY REQUIREMENT FOR THE RENEWAL OF BUSINESS PERMIT

RA 7920 Article IV, Section 36.

Posting of Certificates . – The owner, manager or the


person in charge of an electric plant, industrial plant or
factory, commercial establishment, institutional building,
watercraft, or electric locomotive shall post or cause to be
posted in a conspicuous place within such plant or
establishment the certificate of registration of the engineers
or electricians employed in such plant or establishment, in a
frame protected by transparent glass of equivalent,
RA 7920 Article IV, Section 39.

Enforcement of the Act by Officers of the Law . – It


shall be the duty of all constituted officers of the law of the
national government, or any provincial, city or municipal
government or of any political subdivision thereof to
prosecute any person violating the provisions of this Act. The
Secretary of Justice or his assistant shall act as legal adviser
of the Board and render such legal assistance as may be
necessary in carrying out the provisions of this Act.
RA 7920 Article IV, Section 40.

Penalty Clause. – Any person who shall violate any of the


provisions of this Act shall be guilty of misdemeanor and shall,
upon conviction, be sentenced to a fine of not less than Ten
thousand pesos (P10,000.00) nor more than Fifty thousand
pesos (P50,000) or imprisonment for a period not less than six
(6) months nor more than five (5) years or both at the
discretion of the court.
