MAGNA CARTA FOR DISABLED PERSONS


“Republic Act No. 9442”

I. SUMMARY

PWDs are defined in the RA 10754 as individuals with long-term physical,


mental, intellectual or sensory impairment which in interaction with various
barriers may hinder their full and effective participation in society on an
equal basis with others.

As provided in the Magna Carta of Disabled Persons, the state is duty-bound


to recognize the rights, protect, and support Persons With Disabilities
(PWDs) through various social systems. PWDs are granted benefits and
privileges such as 20% discounts at restaurants and hospitals, to
transportation benefits.

Republic Act 7277 is a consolidation of Senate Bill No. 1286 and House Bill
35091, was finally passed by the Senate and the House of Representatives
on January 22, 1992 and was approved on March 24, 1992 by President
Corazon C. Aquino.

In April 30, 2007, Republic Act 9442 was signed into law, by President Gloria
Macapagal- Arroyo amending and expanding the Magna Carta of Disabled
Persons, granting more benefits for PWDs.

II. REQUIREMENTS

1. Filled out application form, either by applicant or care-giver

Forms may be obtained in any of the following offices:


 Office of the Mayor
 Office of the Barangay Captain
 National Council on Disability Affairs (NCDA) or its regional counterpart
 DSWD Offices
 Participating organizations with memorandum of agreements with the
Department of Health
2. Two 1×1 ID pictures
3. A duly signed clinical abstract by any licensed private, government clinic, or
hospital-based physician

III. PROCEDURE

1. Applicant or care-giver must fill up the application form, attaching the 2 1×1
ID pictures and signed clinical abstract.
2. Applicant, care-giver, or registration center personnel must then bring or
upload the application to the nearest City of Municipal Health Office or its
satellite offices or stations at the barangay for verification.

Note: If PWD is not ambulatory, the receiving health officer shall do a home
visit to validate the entries and disability. Applications that were
disapproved shall be advised regarding the deficiencies and shall be
allowed to reapply until complied.
3. Once verified, the forms will be sent to the Health Officer of the Main City or
Municipal Health Center. The Health Officer will then fill up a certification
form, affix a control number, and upload the information to the Philippine
Registry for Persons with Disabilities that can be downloaded from the DOH
National Office Website.
4. Applicant must bring the duly approved application form and certificate of
disability to the City or Municipal Social Welfare Office or NCDA for issuance
of the identification card.

IV. PRIVELEGES AND INCENTIVES

1. 20% Discount

At least twenty percent (20%) discount from all establishments relative to


the utilization of all services in hotels and similar lodging establishments,
restaurants and recreation centers for the exclusive use or enjoyment of
persons with disability.

2. Discounts for purchase of medicines

At least twenty percent (20%) discount on the purchase of medicine for the
exclusive use and enjoyment of persons with disability. All drug stores,
hospital, pharmacies, clinics and other similar establishments selling
medicines are required to provide at least twenty percent (20%) discount
subject to the guidelines issued by DOH and PhilHealth.

3. Admission fee privileges

A minimum of at least twenty percent (20%) discount on admission fees


charged by the following establishments:
a) theaters,
b) cinema houses and concert halls,
c) circuses, carnivals, and other similar places of culture, leisure
and amusement such as but not limited to museum, exhibit halls,
fairs, parks like theme parks and shall be granted for the
exclusive use or enjoyment of persons with disability.

4. Medical and dental services in government and private hospitals

The person with disability shall be provided at least twenty percent (20%)
discounts on the following services in all government and private hospitals,
subject to guidelines issued by the DOH in coordination with the Philippine
Health Insurance Corporation (PhilHealth):
a) Medical and dental services
b) Including diagnostic and laboratory fees such as, but not limited
to, x-rays, computerized tomography scans and blood tests

c) Professional fees of attending doctors in all private hospitals and


medical facilities.

5. Transportation privileges

a) Travel by air or sea

At least twenty percent (20%) discounts in fare for domestic air, and sea
travel based on the actual fare except promotional fare. If the
promotional fare discount is higher than the twenty percent (20%)
discounts privilege, the persons with disability may choose the
promotional fare and should no longer be entitled to the twenty percent
(20%) discounts privilege.

b) Travel by land

At least twenty percent (20%) discounts in bus fares such as ordinary,


aircon fares and on public railways such as LRT, MRT, PNR, and such
other similar infrastructure that will be constructed, established and
operated by public or private entity. Toll fees of skyways and
expressways are likewise subject to at least twenty percent (20%)
discounts, however, this privilege can be availed only by a person with
disability owning the vehicle.

V. EXPANDED BENEFITS

1. At least 20% Discount and VAT exemption on the following:

availment of the PWD.

a) Fees and charges relative to the utilization of all services in hotels and
similar lodging establishments; restaurants and recreation centers;
b) Admission fees charged by theaters, cinema houses, concert halls,
circuses, carnivals and other similar places of culture, leisure and
amusement;
c) Purchase of medicines in all drugstores
d) Medical and dental services including diagnostic and laboratory fees
such as, but not limited to, x-rays, computerized tomography scans and
blood tests, and professional fees of attending doctors in all government
facilities
e) Medical and dental services including diagnostic and laboratory fees, and
professional fees of attending doctors in all private hospitals and medical
facilities
f) Fare for domestic air and sea travel
g) Actual fare for land transportation travel such as, but not limited to,
public utility buses or jeepneys (PUBs/PUJs), taxis, asian utility vehicles
(AUVs), shuttle services and public railways, including light Rail Transit
(LRT), Metro Rail Transit (MRT) and Philippine National Railways (PNR)
h) Funeral and burial services for the death of the PWD.

i) The person who shouldered the funeral and burial expenses shall claim
the discount upon the presentation of the death certificate of the
deceased PWD.
j) Expenses include purchase of casket or urn, embalming, hospital
morgue, transport of the body to intended burial site in the place of
origin.It excludes obituary publication and the cost of the memorial lot.

2. Educational Assistance for PWD

Includes primary, secondary, tertiary, post tertiary, as well as vocational or


technical education, in both public and private schools.

How: Scholarships, grants, financial aids, subsidies and other incentives to


qualified PWD, including support for books, learning materials, and uniform
allowance to the extent feasible

Requirement: PWD shall meet the minimum admission requirements

3. Continuance of Social Security Benefits

To the extent practicable and feasible, the continuance of the same benefits
and privileges given by the GSIS, SSS, and Pag-IBIG, as the case may be, as
are enjoyed by those in actual service.

4. Special Discounts on Purchase of Basic Commodities

To the extent possible, the government may grant special discounts in


special programs for PWD on purchase of basic commodities, subject to the
guidelines to be issued by DTI and DA

5. Express lanes / priority lanes

Provision of express lanes for PWD in all commercial and government


establishments; in the absence thereof, priority shall be given to them.
