PETITION

PETITIONER, Earnswell P. Tan and unto this Honorable Court, most


respectfully states that:

1. He was born in Maasin City, Southern Leyte on July 17, 1985, is


married, a Filipino citizen, presently residing at #22 Matahimik Street,
Brgy. Malaya, Quezon City with Telephone No. (02) 3433 2987 and
has been a resident of the Philippines since birth.

2. He maintains a regular place of work in Quezon City, where the


notarial commission is to be issued. At present, he is designated as an
Internal Affairs Investigator of the Bureau of Fire Protection and
holds office at 6th Floor, BFP-NHQ, Agham Road, Brgy. Bagong Pag-
asa, Quezon City with Telephone No. (02) 8426 0195 local 607.
Should the petitioner transfer to another office later on, he undertakes
to notify the Office of the Executive Judge of such change of office
address within ten (10) days from date of transfer.

3. He took and passed the 2018 Bar Examinations and was admitted to
the Philippine Bar on June 14, 2019 with Roll No. 72209. A copy of
his Certificate of Membership in the Philippine Bar is attached as
Annex “A” and made integral part of this Petition;

4. He is an Internal Affairs Investigator and is authorized to practice his


legal profession as per Authority given by Mr. Eduardo M. Año,
Secretary of the Department of the Interior and Local Government
dated 14 January 2020, herein attached and marked as Annex “B” and
made an integral part hereof;

5. He is a member of the Philippine Bar in good standing and has no


pending administrative and disbarment cases against him. Copies of

certifications relative thereto are attached and made integral parts
hereof:

a. Office of the Bar Confidant of the Supreme Court (Annex “C”);

b. Integrated Bar of the Philippines (IBP), Annex “D” and the


Integrated Bar of the Philippines, Quezon City Chapter, Annex
“E”;

6. He has never been charged nor convicted in the first instance of any
crime involving moral turpitude and has no pending civil cases against
him, per copy of the Certificate of Clearance from the Office of the
City Prosecutor of Quezon City, dated February 26, 2020, MeTC
Clearance dated Feb 28, 2020, RTC Clearance dated February 26,
2020, and NBI Clearance dated February 26, 2020, which are herein
attached and marked as Annex “F”, “F-1”, “F-2” and “F-3”,
respectively and made integral part hereof;

7. He has paid the professional tax for lawyers, per copy of the Official
Receipt No. 9894207, issued on February 26, 2020, which is herein
attached and marked as Annex “G” and made an integral part hereof;

8. He has paid the Integrated Bar of the Philippines yearly dues, as per
copy of Official Receipt No. 100717 dated January 03, 2020, which is
herein attached and marked as Annex “H”

9. Attached herein as Annexes “I”, “J”, “K” and “L” are petitioner’s
specimen signature; impression of dry seal; photo where petitioner is
holding office; and three (3) recent color photographs of the petitioner
signed at the bottom part thereof, which picture was taken within
thirty (30) days from the filing of this petition, respectively;

10.He is compliant with his Mandatory Continuing Legal Education


requirement, as per copy of his MCLE Certificate of Compliance No.
VII-0001049 given on the 1st day of October 2019, which is herein
attached and marked as Annex “M”

11.He has not applied for notarial commission in any other courts of the
Philippines.

12.Petitioner possesses all of the qualifications and none of the


disqualifications of a Notary Public.

PRAYER

WHEREFORE, foregoing premises considered, it is most respectfully
prayed of this Honorable Court that after due notice, publication and
hearing, the petitioner be granted a Notarial Commission and appointed as
Notary Public who may perform notarial acts in any place within the
territorial jurisdiction of this commissioning court, within a period of two (2)
years.

I caused the preparation and filing of the above Petition;

I have read and understood and I certify that the contents of the
Petition are true and correct based on my personal knowledge and available
records;

No other similar action or proceeding has been commenced in the


Supreme Court, the Court of Appeals, or any other tribunal or agency; and to
the best of my knowledge, no such action or proceedings is pending in the
Supreme Court, the Court of Appeals, or any other tribunal or agency;

Should I thereafter learn that a similar action or proceeding has been


filed or is pending before the Supreme Court, the Court of Appeals, or any
other tribunal or agency, I undertake to report that fact to this Honorable
Court within five (5) days therefrom.
