C. How can the PNP ensure that they are providing equal service in the

B. On the shooting incident that was mentioned on your first activity( the
shooting incident of a retired soldier in Quezon City), were the guidelines
respecting human rights implemented? Looking at the conducts of the
police officers involved, is there any misconduct exhibited?
* as to the PNP Revised Operational Procedure, such guidelines were
substantially met. As I saw it in the video, there was a repeated prior verbal
caution by the PNP given to the victim in which he said “dapa”. Though
unfortunately, the victim did not follow the caution. As a freshman student
in the criminology, it is in here where I realized that theory are best but may
deviate when applied. As a reflection, as long as there is no big difference in
the theory and its application, the essence of the theory still remain.
Perhaps, for every aspiring police officers, the lessons we learn in school
should also be coupled with the mastery of the skill needed in different
kinds of operations. Lastly, I can hardly see any misconduct from the police
officers considering all the circumstances that surrounds the issue.
C. For the issues regarding insubordination with the PNP force, how does
the PNP deal with it? Are the punishments given to the offenders/ if there
are, specify.
*in cases regarding insubordination in the PNP, administrative cases
can be filed against the offender in the PNP Internal Affairs Service.
Whereby, the PNP IAS will conduct Pre-Charge Investigation and when such
offender is found to have probably committed such offense, the PNP IAS will
issue a formal charge.
The penalty for offense of insubordination depends whether it will fall
under less grave neglect of duty or grave neglect of duty. Hence, the
circumstances when the offense is committed is important.
If it fall under less grave neglect of duty, the following penalties will be
imposed:
1. Withholding of privileges; restriction to specified limits; restrictive
custody; suspension or forfeiture of salary; or any combination thereof from
thirty-one (31) days to forty (40) days (minimum)
2. Withholding of privileges; restriction to specified limits; restrictive
custody; suspension or forfeiture of salary; or any combination thereof from
forty-one (41) days to fifty (50) days (medium)
3. Withholding of privileges; restriction to specified limits; restrictive
custody; suspension or forfeiture of salary; or any combination thereof from
fifty-one (51) days to fifty nine (59) days (maximum)

B. How does abuses and excessive use of force by the police officer make their
task more difficult?
C. Case: a man, long unemployed and desperate for money, has broken into an
electronic store and stolen a television set. The television set in one hand, and
a large knife in the other, he runs from the store as the alarm sound and
threatens several bystanders who attempt block his escape. Breaking through
the crowd, he spots two police officers approaching in response to the alarm.
He turns and runs to an open field dropping the knife as he clutches the
television set in fight. One of the officers draw his gun and shoot the thief in
the back, killing him instantly. Did the police officer violate the Code of
Conduct for Law Enforcement Officials? Why? Explain your answer.
Yes.
In the facts given, the thief was already in an open field and dropped the
knife. It can be geared from the scenario that the thief was unarmed
when he was shot at the back by one of the responding police officer. The
force used by the PNP personnel should have been in equal extent with
the weapon or unlawful aggression of the thief in order for the Police
officer to be justified in his act or be considered as proper in the
performance of his duty.
