Sir:
In light of the Memorandum issued by the Office of the President through the Executive
Secretary dated 16 March 2020 titled: Community Quarantine Over the Entire Luzon and
Further Guidelines for the Management of the Corona Virus Disease (COVID-19) Situation ,
shall be effective starting 12:00AM of 17 March 2020 and shall expire 12:00AM of 13 April
2020 (ECQ Period).
In this regard, may I request for the approval of Work Suspension Order No. 01 for the
project 20BD0060 - LOCAL PROGRAM - LOCAL INFRASTRUCTURE PROGRAM – BUILDINGS
AND OTHER STRUCTURES - MULTIPURPOSE/FACILITIES - REHABILITATION OF MULTI-
PURPOSE BUILDING, BRGY. ANDARAYAN NORTH, SOLANA, CAGAYAN under contract with
4MD JSL Construction Inc. in compliance with Memorandum dated 16 March 2020 issued by
Secretary Mark A. Villar, to quote:
“IV. Suspension of Construction Projects - All construction projects in Luzon are hereby
suspended to ensure strict compliance with the Enhanced Community Quarantine guidelines
during the ECQ Period, in accordance, with Annex E of the Implementing Rules and
Regulations of RA 9184. All implementing units in Luzon should prepare the necessary
documentation for the suspension of construction projects.” Unquote.

This request is in accordance with Sub-Section 9.1 Annex E of the Revised IRR of R.A.
9184, to quote:
“Sub-Section 9.1 - The procuring entity shall have the authority to suspend the
work wholly or partially by written order for such period as may be deemed
necessary, due to force majeure or any fortuitous events xxx”, Unquote.
Relative to the aforecited Memorandum, a letter dated 17 March 2020 for request of
approval of Suspension Order No. 01 for the above-mentioned project was submitted
by the Project Engineer, for the compliance with the imposed Enhanced Community
Quarantine over Entire Luzon, including National Capital Region effective 12:00AM of 17
March 2020 and expiring on 12:00 AM of 13 April 2020.

9. Remarks:
On the basis of the submitted documents included in the checklist, this Office finds the
request for Work Suspension Order No. 01 was found necessary for the strict
compliance with the imposition of Enhanced Community Quarantine Guidelines. Any
delay in the implementation of the project is hereby not default of the Contractor and
is beyond the control of the Implementing Office. The said request is in accordance with
Sub-Section 9.3 Annex E of the Revised IRR of R.A. 9184 as stipulated in the preceding
section.
In view of the above premises, the request for approval of Suspension Order No. 01 is
respectfully recommended for approval of the Regional Director pursuant to D.O. 144,
series of 2016, subject however to the condition that the approval of
suspension order is not an automatic extension of contract time.

This refers to my request for the approval of the Work Suspension Order No. 01 for the
above-mentioned project under contract with 4MD JSL Construction Inc. Dated 17 March
2020, which is in compliance with the Memorandum issued by Secretary Mark A. Villar
dated 16 March 2020 pursuant to the Memorandum issued by the Office of the President
through the Executive Secretary dated 16 March 2020 entitled: Community Quarantine Over
the Entire Luzon and Further Guidelines for the Management of the Corona Virus Disease
(COVID-19) Situation, quote:
“IV. Suspension of Construction Projects - All construction projects in Luzon are hereby
suspended to ensure strict compliance with the Enhanced Community Quarantine
guidelines during the ECQ Period, in accordance, with Annex E of the Implementing
Rules and Regulations of RA 9184. All implementing units in Luzon should prepare the
necessary documentation for the suspension of construction projects.” Unquote.
The proposed Work Suspension Order No. 01 is in conformity with Sub-Section 9.1 Annex E
of the Revised IRR of R.A. 9184, to quote:
“Sub-Section 9.1 - The procuring entity shall have the authority to suspend the work wholly
or partially by written order for such period as may be deemed necessary, due to force
majeure or any fortuitous events or for failure on the part of the contractor to correct bad
conditions which are unsafe for workers or for the general public, to carry out valid orders
given by the procuring entity or to perform any provisions of the contract, due to
adjustment of plans to suit field conditions as found necessary during construction. The
contractor shall immediately comply with such order to suspend the work wholly or
partially.”, Unquote.
Upon evaluation of the submitted documents relative to the work suspension order request
of the Project Engineer dated 17 March 2020, this Office recognizes the importance of the
said request considering the circumstances that will affect the implementation of the project
as verified by our technical personnel and hereby recommends the approval of this proposed
Work Suspension Order NO. 01 for the said project.
As stipulated under Section 9.1 of the Revised IRR of R.A. 9184, the procuring entity shall
have the authority to suspend the work wholly or partially by written order for such period
as may be deemed necessary, due to force majeure or any fortuitous events or for failure
on the part of the contractor to correct bad conditions which are unsafe for workers or for
the general public, to carry out valid orders given by the procuring entity or to perform any
provisions of the contract, due to adjustment of plans to suit field conditions as found
necessary during construction. The contractor shall immediately comply with such order to
