SUBJECT : Drug Free Workplace

In pursuant to Section 4 of the Memorandum Circular No. 89, dated December


17, 2015 issued by the Office of the President which states that all government
offices shall formulate and adapt their own drug-free workplace programs and
conduct authorized drug testing among officials and personnel.

To ensure that all officials and employees entering the government service and
achieving the vision of a national drug-free workplace in accordance with Civil
Service Commission (CSC) Memorandum Circular No. 13, s. 2010, re:
“Guidelines for a Drug-Free Workplace in the Bureaucracy” and in pursuant to
Republic Act No. 9165, otherwise known as the Comprehensive Dangerous Drugs
Act of 2002, the following guidelines are hereby adopted:

A. Coverage

These guidelines shall apply to all officers, regular, contractual, and job order
employees.

B. Mandatory Drug Test

It shall be mandatory to all government officials and employees to undergo a


drug test, to wit:
1. In accordance with CSC MC No. 34, s. 1997 all officials and employees
entering the government service shall be required to undergo the
mandatory drug test;
2. For pre-employment of all Contractual and Job Order Personnel, valid
Drug Test Report are required to submit from authorized and accredited
DOH testing center before signing in Job Order Agreement. The valid Drug
Test Report shall not exceed six (6) months prior for signing the Job Order
Agreement;
3. If necessary, or in case of a workplace-related accidents, excessive
unexplained absenteeism or tardiness and/or poor work performance in
the workplace, an employee may be submitted for drug testing;
4. Annual Drug Testing – all officers and employees are required to undergo
the annual drug testing; and
5. Random Drug Testing – officers and employees may be selected at
random for drug testing at any interval or as necessary.

C. Accredited Drug Testing Center – a duly recognized and accredited by


the Department of Health (DOH) is allowed and may be selected as
authorized to conduct drug testing.
D. Testing Fee/s – costs for drug testing of the personnel shall be charged
against local funds subject for usual government accounting rules and
regulations except for pre-employment.
E. Penalties and Sanctions – any officer or employee who refuse to submit
for drug testing shall be administratively charged accordingly. For officer
and employee found positive for use of dangerous drugs shall be dealt
with in accordance with the pertinent laws, rules and regulations.

This order, issued in the interest of public service, shall take effect
immediately and will remain in force unless revoked by the undersigned. If for
any reasons, any part or provisions of this order shall be held unconstitutional or
invalid, other parts or provisions thereof which are not affected shall remain in
force and effect.
