With reference to the above‐mentioned valves are clarifications are as under:
A. Clauses in Particular Specifications PS6 Process Equipment state as below:
Clause PS 6.1 ‐ This section demonstrates only the minimum requirement for the works;
however, the EPC Contractor undertakes all things necessary for the design, construct,
commission and handover the project and ready for the use of the Owner/End User.
And
Clause PS 6.1.2 ‐ The following Particular Specifications detail the particular
requirements of the process equipment the Contractor shall provide for the Plant and
should be read in conjunction with other sections of these Particular Specifications, the
Haya Standard Specifications and the Haya Design Manual.
And
Clause PS 6.1.3 ‐ The Contractor’s process designs and equipment selections should
provide all the operational flexibility, functionality, and redundancies as shown in the
P&IDs that are included with the Contract Drawings and as described herein.
And
Clause PS 6.1.4 The Contractor shall be responsible for providing all structures,
buildings, civil works, materials, equipment, and instrumentation necessary for
completing the Plant to meet the required functionality of process equipment as
described herein.
And
Clause PS 6.1.5 This section demonstrate only the minimum requirement for the works;
however, the EPC Contractor undertakes all things necessary for the design, construct,
commission and handover the project and ready for the use of the Owner/End User.
And
All mechanical and process equipment installed in or on pipelines (air, water,
wastewater, sludge etc.) including but not limited to valves, pumps and flow meters
shall include dismantling joints to allow removal of the item without the requirement to
dismantle the adjacent pipework.

And
Clause PS 6.1.11 Apart from this specification, the detailed study and scope of works
shall be read and included from the attached Preliminary Design Report Rev – 07 for
Process Equipment and Tender Drawings.
Clause PS 6.1.12 the preliminary design and the engineering documents shall be
considered for guidance only.
B. Clauses in Particular Specifications PS7 ICA state as below:
Clause PS 7.1.1:
This specification describes the minimum requirement and generic in all required
facilities for ICA systems, the Contractor is responsible to ensure that all necessary
ICA hardware & software units are provided to make the system complete and meet
requirements and control functions for expansion of A’Seeb sewage treatment plant
and related pumping stations to support increasing plant capacity to 80,000 cum/d.
AND
ICA system shall be expanded to cover demands of Phase‐II in control and
monitoring of the A'Seeb STP, Main pumping stations (MPS‐l, MPS‐2) and two TE
pump stations (Al‐Khoudh and Mobellah) and other works listed under scope of
work section, in addition to all related ICA works resulted by
process/mechanical/operation requirements. The Contractor must consider any
related integration with Al Ansab existing STP to supervisory control and monitoring
process facilities for first & second phases.
AND
The contractor shall furnish all equipment, provide needed engineering to
accomplish the functional and technical requirements in all contract documents and
drawings, including but not limited to design assistance, coordination with on‐site
area, detailed system design, in addition to supply, shipment, storage, job site
delivery, programming and configuration, installation, commissioning, training,
calibration, testing, and start‐up works.
AND
It is not the intention to specify all details of design completely, construction and
installation herein. Nevertheless, the equipment and installation shall conform to a
high standard of engineering design and workmanship in all respects and shall be
capable of performing in a continuous operation. Items not specifically mentioned
but required to make the system complete shall be treated as included, supplied,
and installed under contractor scope of work.

C. Clause PS 7.1.2 Contractor scope is derived from any obligation mentioned in all particular
specifications, drawings, or any further requirement arisen in detailed engineering to fulfil
complete process demands in plant expansion.
D. Under PS 7.1.3 ‐ Miscellaneous Works ‐ Any other work under tender documents (specs,
drawings, and bills of quantity).
E. Clauses in SCHEDULE 19a ‐ PRICING PREAMBLES.
Clause 1.2 The Price Schedules herein, including all notes and instructions, form an integral
part of the Contract Documents. However, the descriptions contained in the Schedule of
Prices for each item are not necessarily complete. The Contractor is referred to the
Conditions of Contract and other Documents, Specification, Schedules and Drawings as well
as relevant Standards and Codes of Practice for further information as no claim or variation
shall be considered on account of the Contractor's failure to do so.
Clause 1.3 The Contractor is cautioned to familiarize himself with the full content of other
Contract Documents including the Tender Form, General Conditions, Particular Conditions,
Tender Drawings, Specification and Schedules or any other information that can be
reasonably inferred from any of them and all obligations contained in the documents shall
be included in the item rates and sums.
Clause 1.4 Drawings, Specification, Schedules and Schedule of Prices and all other Contract
Documents are complementary and if any item is included in any of them, it shall be
deemed included in all.
Clause 1.6 The Contractor shall not use this Schedule of Prices as the basis for a
construction programme or for the purposes of ordering Materials or arranging sub‐
contracts or assessing the required quantities, types or descriptions of Materials. The
references for these matters shall be the Specification and drawings and any instructions
issued by the Engineer.
Clause 3.2 The prices shall be comprehensive and shall include for complying in all respects
with the Conditions of Contract, Specification and Drawings and for all matters and things
necessary for the proper construction, completion, and maintenance of the whole of the
Plant. No claims for additional payment shall be allowed for any error or
misunderstanding by the Contractor of the work involved.
Clause 3.3 The prices inserted in the Schedule of Prices are deemed to include for the
following:

required for completion of the works.

Conclusion:
According to the above contract clauses, it can be concluded as below:
‐ Particular Specification describes the minimum requirements. The contractor scope of work
shall be extracted from the whole of the tender documents.
‐ The Contractor’s process design and equipment selections should provide all the
operational flexibility, functionality, and redundancies as shown in the P&IDs that are
included with the Contract Drawings.
‐ Items not specifically mentioned but required to make the system complete shall be treated
as included, supplied, and installed under contractor scope of work.
‐ Contractor scope is derived from any obligation mentioned in all particular specifications,
drawings, or any further requirement arisen in detailed engineering to fulfil complete
process demands in plant expansion.
‐ The Contract price shall include any missing items and not mentioned in BOQ but are
required according to the Conditions of Contract and other Documents, Specification,
Schedules and Drawings as well as relevant Standards and Codes of Practice No claim or
variation shall be considered on account of the Contractor's failure to do so.
Hence, according to the above, the two valves MV 039 and MV 040 shall be provided by
EPPM.
