APPLICANT ABOVE NAMED 

Most respectfully sheweth -: 

1. The accompanying SLP has been preferred against the final judgment and order dated
08.12.2016 passed by the Hon’ble High Court of Madhya Pradesh , bench at Gwalior in F. A.
No. 101 of 1999.

2. The facts and circumstances giving rise to the accompanying Petition are set out therein in
detail and are not repeated here for the sake of brevity. The Petitioners crave leave of this
Hon’ble Court to treat the same as an integral part of the present application as well. 
3. That despite the best efforts by the Petitioner the Respondent No.1, Andhra Bank, remained
unserved. This Hon'ble Court by order dated 25.10.2018 had granted time to the Petitioner to
serve Respondent No.1 by by filing fresh particulars of the said respondent. The Petitioner had
the details of the respondent’s address as Andhra Bank, (Body Corporate), Central Office
Hyderabad, Regional Office Santi Chambers, Poosaa Road, Karolbag, New Delhi, Branch
Office Kampoo Road, Lashkar. However after making further inquiry after the postal remarks as
‘unserved’ it has been learnt by the petitioner that the new address for the Respondent No. 1 is
31/80, SARAFA BAZAR, GWALIOR – 47400 1.

4. The Petitioners have a prima facie case in their favour. The balance of convenience also
leans heavily in favour of the Petitioners. Irreparable loss would be caused to the Petitioners if
the present application is not allowed. 

PRAYER

In the facts stated above, the Petitioners most respectfully pray that this Hon’ble Court may be
pleased to: 

a) pass an order allowing the Petitioner to serve the unserved Respondent No.1 at his new
address.

b. pass any other such order(s) as this Hon’ble Court may deem fit in the facts and
circumstances of the case.

AND FOR THIS ACT OF KINDNESS THE PETITIONERS AS IN DUTY BOUND SHALL EVER
PRAY.
