1. What was the first Copyright Law that India enacted after Independence?

ANS. Copyright law as a gift from its colonial rule first introduced in British Period during
British east India company 1847, after independence copyright law of England was re
enacted in 1914 in India, further it was amended by salient treaties like WIPO Copyright
treaty and other conventions.

3. Is Register the Prima Facie evidence of Copyright?

ANS It is a rebuttable presumption, the section 48, register of copyright shall be a prima facie
evidence of the particulars entered and the documents therein purported shall be sealed with the
copyright office and certified too by registrar of copyright therefore such shall be admissible as
evidence in the courts without the any further evidence.

4. Is it mandatory to register ones Copyright?

ANS Registration of copyright is not mandatory. However, it is advisable to apply for


registration as the certificate for the registration of copyright which serve as the prima facie
evidence in the court of law with the dispute regarding ownership of copyright.

ANS. Yes ,India is signatory to the major convention dealing with intellectual properties
some of the conventions as follows

 the Berne convention for the protection of Literary & Artistic work
 patent cooperation treaty
 Trademark law Treaty
 WIPO Copyright treaty

1. Explain in brief, the procedure for registration of a Copyright?

ANS Copyright act 1957 provides protection section 14 states the meaning of copyright,
chapter X of copyright act and rule 70 of copyright rules 2013 laid down the procedure for
registration.

 the author can file an application for registration of copyright by himself or by


representative in copyright office or by speed post or by other mode
 each application shall be accompanied by form 1V by requisite fees

 information like name, address, nationality nature of work, title of work, language of
work, contact details, email address if it is a computer programme then it must be filed
with the source and object code. the application must be signed.
 second step involves the examination process within 30 days if its any objection is raised
the registrar gives an opportunity of hearing or if deem fit can reject the application too.
 if registrar is satisfied he shall enter the particulars of copyright in register of copyright &
further issue a copy of registration.

 Registration completes when the applicant is issued with the copy of entries made in the
Register of Copyrights.
