THIS SALE DEED IS MADE AT RAWALPINDI ON ____ DAY OF

BETWEEN

BRIGADIER (R) MUHAMMAD ASHFAQ HUSSAIN son of Fazal

Ahmad, Resident of House No. FWO/B1, Race Course Road,

Rawalpindi, General Attorney of Mst. Naghma Azhar widow of

Muhammad Azhar, Resident of House No. 10, Westridge Bazar,

Rawalpindi vide General Attorney bearing No. 1546, Book No. 4,

Volume No. 47, Pages No. 86 its duplicate copy pasted on Additional

registered with the office of Sub-Registrar (U), Rawalpindi, hereinafter

Called the Lessor/Vendor, which expression shall include his legal

heirs, successors-in-interest, executors and assignees

AND
CAPTAIN FAHAD ASHFAQ son of Brig (R) Muhammad Ashfaq

Hussain, Resident of Shah Pur, Shamas Abad, Post Office Shah Pur,

Tehsil & District Attock, at present House No. 10/3, Westridge-1,

Main Valley Road, Rawalpindi Cantt, holding NIC No. 37405-

8915891-7, (hereinafter called the lessee) which expression shall

include his legal heirs, successors-in-interest, executors and

assignees

WHEREAS the said Mst. Naghma Azhar widow of Muhammad Azhar

is the Lease Rights Holder of House No. 10/3, constructed over plot

admeasured 476 sq yds, Survey No. 72/A/5-3, Westridge Housing

Scheme, within the limits of Cantonment Board, Rawalpindi Vide

Lease Deed Registered at No. 2863, Book No. 1, Volume No. 80, on

page No. 173, and its duplicate copy pasted in the Additional Book

No. 1, Volume No. 564, Pages from 308 to 314, dated: 21-07-2001,

registered in the Office of the Sub-Registrar Rawalpindi.

And whereas the Lessor being the General Attorney is competent to

sell and transfer the Lease Hold Rights of house, for which the

Vendor/Lessor has obtained NOC from MEO, Rawalpindi. The above

referred General Power of Attorney is still valid and the executants of

Attorney is still alive.

The above said lease hold rights of house is bounded as under:-


East By : Bungalow No. 10 (76’ – 9”)
West By : Plot No. 09, (79’ – 3”)
North By : Road 30 Feet wide (55’ – O”)
South By : Bungalow No. 10 (55’ – 0”)

AND WHEREAS the Lessor has agreed to sell the above said Lease

Hold Rights of House to the Lessee for a sum of Rs. 26,00,000/-

(Rupees Twenty Six Lacs Only) and the Lessee has also agreed to

purchase the same for the same amount.

NOW THIS DEED OF SALE WITNESSETH that in pursuance of

aforesaid verbal agreement and in consideration of the sum of

Rs.26,00,000/- (Rupees Twenty Six Lacs Only) has already received

by the Lessor from the Lessee before the witnesses at home, the

Lessor hereby conveys, transfers by way of sale with all the other

rights and easements to hold unto and to the use of the Lessees free

from all sorts of encumbrances. The Lessor has delivered the

possession of the above said Lease Hold Rights of House to the

Lessee at the spot. Lessee is now entitled to keep the same for his

personal use or to alienate the same in any manner he like, i.e. to

sell, gift, exchange, surrender, relinquish, rent-out or transfer in any

shape to any other person the same, the Lessor along-with his legal

heirs, have left with no interest with the above said sold the Lease

Hold Rights of House.

WHEREAS the Lessor shall be liable to make good the losses

suffered by the Lessee in the ownership, possession and title of the

said lease hold rights of above said house.

For the satisfaction of the Lessee the Lessor hereby assures his that

the said sold property is not transferred to anyone in any way. In

short it is free from all sorts of encumbrances, legal and factual

defects, should it be proved otherwise.

The Lessor hereby assures to the Lessee that if due to some legal

defects or otherwise, the whole or any part of the above said Lease

Hold Rights of House goes out of the possession of the Lessee or the

Lessee suffer any loss or this Sale Deed of Lease Hold Rights of

house stands cancelled the Lessor shall pay back the entire sale

amount along-with other expenses and damages to the Lessees.

NOC No. R-10/511/113 dated: 10.04.2007 has been granted by the

MEO Rawalpindi in Favour of the Lessee, as permission to transfer

by way of sale the lease hold rights of subject plot / bungalow in

favour of Captain Fahad Ashfaq son of Brigadier (R) Muhammad

Ashfaq Hussain through General Attorney by existing lessee .
