PART – C 2 * 15 = 30 MARKS

14. Sumanth has an account with ICICI Bank. In a get-together he boasted that he has in his account a
balance of not less than 10 lakhs of rupees. One of his friend Raghu went to the bank and enquired about
the same. The bank persons infromed Raghu that the balance in Sumanth’s account never exceeded ten
thousand rupees, since its opening. Raghu informed the same to many persons. Sumanth feels that he is
insulted. Can he make the Banker liable? Advice
15. A and B have a fixed deposit with Andhre Bank, payable jointly with interest payable every quarter. At
the end of the the first quarter, A approached the bank for interest. Bank paid him the interest. B claims
that the bank has no right to do so and therefore liable to pay him the interest. Is the bank liable?
16. Banker wrongly dishonoured the customer’s cheque who is a trader. Explain the consequences when a
person is a trader and non-trader.
17. Raju has taken a locker on hire from State Bank of India for keeping his valuables for safe custody.
Raju kept some of his jewellery in the locker. To his surprise the jewellery was found missing. Raju filed a
suit on the bank to recover the value. Decide.

14. Ramesh is a customer Bank of Baroda, having savings A/C, once credited a huge amount of 30 lakhs of
rupees in his account. Bank informed this to income tax department. Ramesh wanted to file a suit against
bank of baroda for not maintaining secrecy of his account. Advice.
15. A customer of a bank issues a cheque without sufficient funds. The payee of the cheque demands
payment or an endorsement of rejection of payment for want of sufficient funds. The bank refuses
payment as well as an endorsement. Discuss the rights and the payee against the drawer and the remedy
against the bank.
16. A promissory note is executed by Dileep in favour of Sujatha is consideration of Viswanadh, a relation
of Sujatha for bearing to sue on a prior promissory note executed by Sujatha in fovour of Viswanadh. Has
the note executed by Dileep in favour of Sujatha any lawful consideration?
17. A forged B’s signature on a cheque stolen by him from B and presented the same for payment to ‘X’
bank. The bank could not detect forgery and made payment. Can B recover that amount from ‘X’ bank?

15. Prakash pays in the current account a cheque which was received by him from Chandra Sekhar who is
a thief. The true owner claims the payment from the banker. Should the banker pay?
16. A current account holder instructs his bank to close his account and transfer the balance to another
branch. Later cheque is presented and returned with the objection ‘refer to drawer’. The account holder
sues the bank on the plea that his credit has been damaged. What is the position of the bank?
17. There is a credit balance in the account of Srinivas. The banker wishes to set this off against an
overdraft in the joint names of Srinivasu and Mohan Kumar. Examine the legal position of the banker.
18. A firm obtained a loan from ‘Hindu Bank’ on pledge of R.R’s (Railway Receipts) for obtaining delivery of
goods. The R.R’s were handed over to the firm by the Hindu Bank. The firm fraudulently used these R.Rs
for obtaining another advance from ‘Andhra Bank’ for the delivery of goods from Railway Co. Hindu Bank
filed a suit agaisnt Andhra Bank for damages for conversion. Decide as An Officer.

April,2019
14. Ramayamma an employee of State Government was dismissed from services for misappropriation of
government finances. Government enquires with a bank to give details of accounts of Ramayamma. The
bank refuses to give the required information. Advice the Government.
15. Divya took a loan of Rs. 100000/- from Maharaja Bank and did not pay. She also has a safe deposit
locker with the same bank. She went to the bank to take something from that locker. The bank did not
allow her to do so claiming “Lien”. Can bank succeed?
16. A customer of State Bank draws a cheque in favour of his friend basing on the entries in the pass book.
The friend presented the cheque in the bank for drawing money. The bank refused to honour the cheques
as there are insufficient amounts to honour or honour for lesser amount. Advice the Bank?
17. An Income Tax officer directly writes to bank to disclose certain details regarding certain customers of
the bank who have accounts. Is the banker under obligation to disclose? Discuss.
