DEFINITION OF TERMS
Accredited Professional Organization — the integrated and accredited national

organization of Professional Electronics Engineers, Electronics Engineers and

Electronics Technicians.

Addressee. – refers to a person who is intended by the originator to receive the

electronic data message or electronic document.

Baccalaureate degree - means the same thing as a bachelor's degree from college. It

can also refer to a "baccalaureate service," which is a like a farewell ceremony for

graduating seniors from high school or college.

Board. – The Board of Examiners for Electronics and Communications Engineers.

Broadcast, Broadcasting — an undertaking the object of which is to transmit audio,

video, text, images or other signals or messages for reception of a broad audience in a

geographical area via wired or wireless means.

Commercial Establishment — shall include but not limited to office buildings, hotels,

motels, hospitals, condominiums, stores, apartments, supermarkets, schools, studios,

stadia, parking areas, memorial chapels/parks, watercraft and aircraft used for business

or profit, and any other building/s or area/s for business purposes, where electronic or

electronically-controlled machinery or equipment are installed and/or are being used,

sold, maintained, assembled, manufactured or operated.

Communications – The process of sending and/or receiving messages between two or

more points by radio, electronics, or other electrical devices.

Computer — any of a variety of electronic devices that is capable of accepting data,

programs and/or instructions, executing the programs and/or instructions to process the

data and presenting the results.

Computer. – refers to any device or apparatus which, by electronic, electro-mechanical

or magnetic impulse, or by other means, is capable of receiving, recording, transmitting,

storing, processing, retrieving, or producing information, data, figures, symbols or other

modes of written expression according to mathematical and logical rules or of

performing any one or more of those functions.

Construction and/or installation- is the act of putting together parts of a whole in

order to build-up; to form and/or to set or establish electronics equipment, systems or

facilities

Consulting Services — as used in this Act, shall include services requiring adequate

technical expertise, experience and professional capability in undertaking advisory and

review, pre-investment or feasibility studies, design, planning, construction, supervision,

management and related services, and other technical studies or special studies in the

field of electronics engineering.

Continuing Professional Education (CPE) - refers to the inculcation, assimilation and

acquisition of knowledge, skills, proficiency and ethical and moral values, after the initial

registration of a professional that raise and enhance the professional’s technical skills

and competence.

Design Service -is the act of conceptualizing, planning and projecting a scheme,

system and facility using the arts and science of electronics along with social, economic,

financial and technical considerations.

ECE Board members - is a team of ECE professionals elected to represent the

organization, they also make the questions in the board exams and make decisions on

the exam. The head of the board of directors is the chairman or chairperson of the

board.

Electronics — the science dealing with the development and application of devices and

systems involving the flow of electrons or other carriers of electric charge, in a vacuum,

in gaseous media, in plasma, in semiconductors, in solid-state and/or in similar devices,

including, but not limited to, applications involving optical, electromagnetic and other

energy forms when transduced or converted into electronic signals.

Electronics and Communications Engineer — a person who is qualified to hold

himself/herself out as a duly-registered/licensed Electronics and Communications

Engineer under Republic Act No. 5734.

Electronics Engineer — a person who is qualified to hold himself/herself out as a duly

registered/licensed Electronics Engineer under this Act and to affix to his/her name the

letters “ECE.”

Electronics Technician — a person who is qualified to hold himself/herself out as a

duly registered/licensed Electronics Technician under this Act and to affix to his/her

name the letters “ECT”

Electronic Data message. – refers to information generated, sent, received or stored

by electronic, optical or similar means.

Electronic document. – refers to information or the representation of information, data,

figures, symbols or other modes of written expression, described or however

represented, by which a right is established or an obligation extinguished, or by which a

fact may be proved and affirmed, which is received, recorded, transmitted, stored,

processed, retrieved or produced electronically.

Electronic key. – refers to a secret code which secures and defends sensitive

information that crosses over public channels into a form decipherable only with a

matching electronic key.

Electronic signature. – refers to any distinctive mark, characteristic and/or sound in

electronic form, representing the identity of a person and attached to or logically

associated with the electronic data message or electronic document or any

methodology or procedures employed or adopted by a person and executed or adopted

by such person with the intention of authenticating or approving an electronic data

message or electronic document.

Engineering Consultation - is the act of giving advice and information to a client in the

area of electronics engineering and its related fields in line with current internationally

accepted standards and practices.

en banc - (on bonk) French for "in the bench," it signifies a decision by the full court of

all the appeals judges in jurisdictions where there is more than one three- or four-judge

panel. The larger number sit in judgment when the court feels there is a particularly

significant issue at stake or when requested by one or both parties to the case and

agreed to by the court.

Ex-parte - refers to those proceedings where one of the parties has not received notice

and, therefore, is neither present nor represented. If a person received notice of a

hearing and chose not to attend, then the hearing would not be called ex-parte.

Gazette - A government official gazette, official journal, official newspaper or official

diary is a periodical publication that has been authorized to publish public or legal

notices.

Industrial Plant — includes all manufacturing establishments and other business

endeavors where electronic or electronically-controlled machinery or equipment are

installed and/or are being used, sold, maintained, assembled, manufactured or

operated.

Information and Communication System. –  refers to a system intended for and

capable of generating, sending, receiving, storing or otherwise processing electronic

data messages or electronic documents and includes the computer system or other

similar device by or in which data is recorded or stored and any procedures related to

the recording or storage of electronic data message or electronic document.

Information and Communications Technology — the acquisition, production,

transformation, storage and transmission/reception of data and information by electronic

means in forms such as vocal, pictorial, textual, numeric or the like; also refers to the

theoretical and practical applications and processes utilizing such data and information.

Intermediary. – refers to a person who in behalf of another person and with respect to

a particular electronic document sends, receives and/or stores or provides other

services in respect to that electronic document.

Maintenance - is the proper upkeep of electronics systems and equipment so as to

attain maximum safety and meet the desired grade of service.

Moral Turpitude - A phrase used in Criminal Law to describe conduct that is

considered contrary to community standards of justice, honesty, or good morals.

Operation- is the process of running or managing an electronics system, network,

services and peripheral facilities intended for the transmission, reception and delivery of

intelligence by wire, radio, fiber optics and any other futuristic media.

Originator. – refers to a person by whom, or on whose behalf, the electronic document

purports to have been created, generated and/or sent. The term does not include a

person acting as an intermediary with respect to that electronic document.

Practice of the Profession - doing works related to professional electronics engineer,

electronics engineer and electronics technician.

Professional Electronics Engineer — a person who is qualified to hold himself/herself

out as a duly registered/licensed Professional Electronics Engineer under this Act and

to affix to his/her name the letters “PECE.”

Professional Regulation Commission (PRC)

 created as a national government agency by Presidential Decree (P.D.) No. 223

dated June 22, 1973, signed by then President Ferdinand E. Marcos, mandated

to enforce the laws regulating the various professions.

 the Philippine government agency mandated to regulate and supervise the

practice of the professionals, the highly skilled manpower of the country.

Service provider. –refers to a provider of -

(i) On-line services or network access, or the operator of facilities thereof, including

entities offering the transmission, routing, or providing of connections for online

communications, digital or otherwise, between or among points specified by a user, of

electronic documents of the user’s choosing; or

(ii) The necessary technical means by which electronic documents of an originator may

be stored and made accessible to a designated or undesignated third party;

(iii) Such service providers shall have no authority to modify or alter the content of the

electronic data message or electronic document received or to make any entry therein

on behalf of the originator, addressee or any third party unless specifically authorized to

do so, and who shall retain the electronic document in accordance with the specific

request or as necessary for the purpose of performing the services it was engaged to

perform.

Telecommunications — any transmission, emission or reception of voice, data,

electronic messages, text, written or printed matter, fixed or moving pictures or images,

words, music or visible or audible signals or sounds, or any information, intelligence

and/or control signals of any design/format and for any purpose, by wire, radio, spectral,

visual/optical/light, or other electronic, electromagnetic and technological means.

The Commission on Higher Education (CHED) - was created on May 18, 1994

through the passage of Republic Act No. 7722, or the Higher Education Act of 1994.

CHED, an attached agency to the Office of the President for administrative purposes, is

headed by a chairman and four commissioners, each having a term of office of four

years. The Commission en-banc acts as a collegial body in formulating plans, policies

and strategies relating to higher education and the operation of CHED.

The Technical Education and Skills Development Authority (TESDA) - is the

government agency tasked to manage and supervise technical education and skills

development (TESD) in the Philippines. It was created by virtue of Republic Act 7796,

otherwise known as the “Technical Education and Skills Development Act of 1994”

INTRODUCTION

Law refers to the system of rules that a particular country or community


recognizes as regulating the actions of its members and may enforce by the imposition
of penalties. In the Philippines, some pertinent laws, rules and regulations which
governs the conduct and standards of Electronics Engineering field are promulgated as
its construction conforms with the recommendations or content of the laws, rules, and
regulation from higher law making bodies or organizations.
Republic Act No. 9292 otherwise known as Electronics Engineering Law of 2004,
is an Act providing for a more responsive and comprehensive regulation for the
Registration, Licensing and Practice of Professional Electronics Engineers, Electronics
Engineers and Electronics Technicians, Repealing Republic Act No. 5734, Otherwise
Known as "The Electronics and Communications Engineering Act of the Philippines",
and for other purposes
An Electronics and Communications Engineering graduate need to take the
Electronic Engineering Licensure Examination before he/she can practice as an
Electronics and Communications Engineer. The examination is conducted by the Board
of Electronic Engineering under the supervision of the Professional Regulation
Commission (PRC). It is scheduled twice a year in the months of April and October. The
main subjects of the ECE Board exam are Mathematics, Electronics Engineering,
General Engineering and Applied Sciences (GEAS) and Electronics Systems and
Technologies.
This written report consists of different articles or sections regarding ECE Laws
and each of these laws consist of supporting laws which are of conformity in the
hierarchy of law making upon the recommendation or regulations from higher law
making body or organization governing the regulation promulgation of pertinent laws
regarding in the field of Electronics Engineering. This only means that a newly made
argument, order, memorandum or policy is not made without the presence of the higher
laws. The making of a policy is always based on the higher law or order coming from
the law making bodies or organizations that are higher as seen in statutory construction
hierarchy.

TOPIC PRESENTATION/DISCUSSION

Code of Ethics

RELATIONS WITH THE STATE

REQUIREMENTS:

1. Each and every engineer shall recognize and respect the supreme authority of
the State as expressed through its laws and implemented by its agencies, whenever
and wherever such laws do not infringe upon the rights and privileges of citizens as
guaranteed by the Constitution.

EXPLANATION:

Supreme authority of the state is someone with the power to settle matters at will.
Infringe is an actively break the terms of (a law, agreement, etc.). Right, privileges is a
moral or legal entitlement to have or obtain something or to act in a certain way, a
special right, advantage, or immunity granted or available only to a particular person or
group of people. Constitution is a body of fundamental principles or established
precedents according to which a state or other organization is acknowledged to be
governed.

2. He shall recognize that the well-being of the public and the interest of the State
are above the well-being and interest of any individual.

EXPLANATION:

Well-being of the public is the state of being comfortable, healthy, or happy. State
is a nation or territory considered as an organized political community under one
government.

3. In the interest of justice, he shall aid the State, if and when the technology is
needed for the prevention and/or prosecution of unjust, criminal, or unlawful acts.

EXPLANATION:

Justice is the quality of being fair and reasonable. Aid means help, typically of a
practical nature. Prevention is the action of stopping something from happening or
arising. Prosecution indicates the institution and conducting of legal proceedings against
someone in respect of a criminal charge. Unjust means not based on or behaving
according to what is morally right and fair. Criminal is the person who has committed a
crime. Unlawful acts indicate not conforming to, permitted by, or recognized by law or
rules.

4. In the interest of good government, he shall in every way possible extend


cooperation to the State in the accomplishment of its goals and objectives.

EXPLANATION:

Good government is a normative description of how government is supposed to


be constituted. Cooperation to the state is the process of working together to the same
end. Accomplishments is something that has been achieved successfully. Goals,
objectives indicate the object of a person's ambition or effort; an aim or desired result, a
thing aimed at or sought.

5. In the interest of social efficiency, he shall extend assistance, guidance and


training to all subordinates under his jurisdiction in order to increase their skill and
ability, knowledge and experience for the purpose of eventually increasing their
responsibilities.

EXPLANATION:

Social efficiency is an action designed to achieve something. Assistance,


guidance, and training refers to the action of helping someone with a job or task, advice
or information aimed at resolving a problem or difficulty, especially as given by someone
in authority, the action of teaching a person or animal a particular skill or type of

behavior. Subordinate means a person under the authority or control of another within
an organization. Jurisdiction is the official power to make legal decisions and judgments.
Skill and ability is the ability to do something well; expertise. Knowledge and experience
refers to the facts, information, and skills acquired by a person through experience or
education; the theoretical or practical understanding of a subject.

6. In the interest of the national economy and well-being, he shall always strive in
the execution of his work with optimum efficiency, economy and safety.

EXPLANATION:

National economy refers to the economy of a nation as a whole that is


an economic unit and is usually held to have a unique existence greater than the sum of
the individual units within it. Strive means making great efforts to achieve or obtain
something. Execution of work refers to the carrying out or putting into effect of a plan,
order, or course of action. Optimum efficiency indicates the best possible; producing the
best possible results. Economy refers to the wealth and resources of a country or
region, especially in terms of the production and consumption of goods and services.
Safety refers to the condition of being protected from or unlikely to cause danger, risk,
or injury

7. In the interest of national security, the State shall be given primary


considerations in all his inventions and/or devices on electronics and related fields that
are useful for national security and defense.

EXPLANATION:

National security and defense refers to posture capable of successfully resisting hostile
or destructive action from within or without, overt or covert. Primary considerations
indicate of chief importance; principal. Inventions is the action of inventing something,
typically a process or device. Devices are things made or adapted for a particular
purpose, especially a piece of mechanical or electronic equipment.

8. In the event of national emergency, he shall offer his technology, skill, ability
and experience to the service of the State, even if it will involve personal sacrifices.

EXPLANATION:

National emergency is a state of emergency resulting from a danger or threat of


danger to a nation from foreign or domestic sources and usually declared to be in
existence by governmental authority. Technology refers to the application of scientific
knowledge for practical purposes, especially in industry. Service of state is provided by
government to people living within its jurisdiction, either directly (through the public
sector) or by financing provision of services. Personal sacrifices mean giving up
something you want or something you desire for the greater good or to help others.

9. He shall interest himself in public welfare and be ready to apply his special
knowledge for the benefit of mankind.

EXPLANATION:

Public welfare refers to the statutory procedure or social effort designed to


promote the basic physical and material well-being of people in need. Special
knowledge refers to the expertise, special skill or knowledge that is acquired by training,
study, or practice. Benefit of mankind refers to a payment or gift made by an employer,
the state, or an insurance company

10. He shall guard against conditions that are dangerous or threatening to life,
limb or property on work for which he is responsible, or if he is not responsible, he shall
promptly call such conditions to the attention of those responsible so that the conditions
can immediately and effectively be corrected.

EXPLANATION:

Guard conditions means to watch over in order to protect or control.


Dangerous/threatening indicates showing an intention to cause bodily harm. Promptly

indicates with little or no delay; immediately. Immediately and effectively corrected
means to put right (an error or fault); rectify.

RELATIONS WITH THE PUBLIC

11. He shall have due regard for the safety of life and health of the public who
may be affected by the work for which he is responsible.

EXPLANATION:

Due regard means that in making decisions and in its other day-to-day activities
a body subject to the duty must consciously consider the need to do the things set out in
the general equality duty: eliminate discrimination, advance equality of opportunity and
foster good relations. Life and health refers to a particular type or aspect of people's
existence, the state of being free from illness or injury. Affected by work indicates
influenced or touched by an external factor.

12. He shall endeavor to extend public knowledge of electronics engineering and


he shall strive to win or maintain the public confidence by discouraging the spread of
untrue, unfair and exaggerated statements regarding his profession.

EXPLANATION:

Endeavor indicates earnest and industrious effort, especially when sustained


over a period of time. Public knowledge is something that people know because it has
been reported in the news. Win, maintain refers to gain the support or favor of someone
by action or persuasion, cause or enable (a condition or state of affairs) to continue .
Public confidence is the feeling or belief that one can rely on someone or something;
firm trust. Untrue, unfair, exaggerated statements means not in accordance with fact or
reality; false or incorrect.

13. As a witness before a court, commission and/or other tribunal, he shall


express an opinion only when it is founded on adequate knowledge and honest
conviction.

EXPLANATION:

Court refers to a tribunal presided over by a judge, judges, or a magistrate in civil
and criminal cases. Commission refers to an instruction, command, or duty given to a
person or group of people. Tribunal refers to a court of justice. Adequate knowledge
indicates satisfactory or acceptable in quality or quantity. Honest conviction is a formal
declaration that someone is guilty of a criminal offense, made by the verdict of a jury or
the decision of a judge in a court of law.

14. He shall not issue statements on matters connected with public policy, any
ex-parte statements, criticisms, or arguments which are inspired or paid for by private
interest, unless he identifies on whose behalf he is making the statements.

EXPLANATION:

Ex-parte statements means with respect to or in the interests of one side only or
of an interested outside party. Criticisms is the expression of disapproval of someone or
something based on perceived faults or mistakes. Arguments means the expression of
disapproval of someone or something based on perceived faults or mistakes.

15. He shall refrain from expressing any public opinion on an engineering subject
unless he is fully familiar and knowledgeable with all the facts relating to the subject.

EXPLANATION:

Refrain means stop oneself from doing something. Public opinion are views
prevalent among the general public. Facts means the truth about events as opposed to
interpretation.

16. His integrity shall be unquestionable and he shall discharge his duties and
responsibilities with fidelity to the public, his employers and clients and with fairness and
impartiality to all.

EXPLANATION:

Integrity is the quality of being honest and having strong moral principles; moral
uprightness. Unquestionable means not able to be disputed or doubted. Fidelity
indicates faithfulness to a person, cause, or belief, demonstrated by continuing loyalty

and support. Fairness refers to impartial and just treatment or behavior without
favoritism or discrimination. Impartiality refers to equal treatment of all rivals or
disputants; fairness

RELATIONS WITH CLIENTS, EMPLOYER AND LABOR

17. He shall act in professional matters as a faithful or trustee, and treat as


confidential all matters and information concerning the business affairs, technical
processes, etc., of his clients and/or employers.

EXPLANATION:

Act in professional matters means having or showing the skill appropriate to a


professional person; competent or skillful. Faithful - the quality of being faithful; fidelity.
Trustee refers to an individual person or member of a board given control or powers of
administration of property in trust with a legal obligation to administer it solely for the
purposes specified. Confidential means entrusted with private or restricted information.
Business affairs are matters of commercial or public interest or concern; the
transactions of public or private business or finance: affairs of state. Technical processes
refer to designing the system, subsystems, and components, including the supporting or
enabling systems required to produce, support, operate, or dispose of a system.

18. He shall inform his client or employer of any financial interest on inventions,
devices, equipment or any other thing, before undertaking any engagement in which he
may be called upon to decide on the use thereof. 

EXPLANATION:

Financial interest generally refers to any pecuniary interests gained like salary or
other payments for services or equity interests like stocks, stock options, intellectual
property rights and the like. Undertaking a formal pledge or promise to do something.
Engagement an arrangement to do something or go somewhere at a fixed time.

19. He shall not accept any other compensation, financial or service or otherwise,
except from one interested party for a particular service or other services related
therewith without the consent of all parties concerned.

EXPLANATION:

Compensation the money received by an employee from an employer as a


salary or wages. Consent permission for something to happen or agreement to do
something.

20. He shall exercise fairness and justice when dealing with contracts between
his clients or employers and the contractors.

EXPLANATION:

Fairness and justice means impartial and just treatment or behavior without
favoritism or discrimination. Contracts refers to a written or spoken agreement,
especially one concerning employment, sales, or tenancy, that is intended to be
enforceable by law. Clients refers to a person or organization using the services of a
lawyer or other professional person or company. Employers generally refers to any
pecuniary interests gained like salary or other payments for services or
equity interests like stocks, stock options, intellectual property rights and the like.
Contractor refers to a person or company that undertakes a contract to provide
materials or labor to perform a service or do a job.

21. He shall not accept any commissions or allowances, directly or indirectly from
contractors, suppliers and all other parties dealing with his clients and/or employers in
connection with the work for which he is responsible.

EXPLANATION:

Commissions and allowances refers to an amount of money, typically a set


percentage of the value involved, paid to an agent in a commercial transaction, a sum of
money paid regularly to a person, typically to meet specified needs or expenses.

22. He shall not be financially interested in the bid or bids of contractors,


suppliers and other interested parties participating in a competitive work or job on which
he has been employed as engineer without full knowledge and consent of his clients or
employers.

EXPLANATION:

Financially interested means having a feeling of interest in a way that relates to


finance. Bid of contractors is the process of submitting a proposal (tender) to undertake,
or manage the undertaking of a construction project. The process starts with a cost
estimate from blueprints and material take offs.

23. He shall promptly inform his clients or employers of any business in which he
has any interest, business connection or affiliation which may compete with or affect the
business or the clients or employers.

EXPLANATION:

Promptly inform means punctually give (someone) facts or information; tell.


Business connection or affiliation.

24. He shall not allow any decision in connection with his work for which he has
been employed or on which he may be called upon to perform, to be affected by interest
in any business.

EXPLANATION:

In connection with means with reference to; concerning. Called upon to means to
ask formally for someone to do something. Affected by means influenced or touched by
an external factor.

25. He will present clearly the consequences to be expected from deviations
proposed if his engineering judgment is overruled by non-technical authority in cases
where he is responsible for the technical adequacy of engineering work.

EXPLANATION:

Consequences means a result or effect of an action or condition. Deviation is the


action of departing from an established course or accepted standard. Engineering
judgment is the ability to recognize and/or predict, through a combination of intuition,
insight and experience, the probable outcome of an analysis, design or process.
Overruled means to reject or disallow by exercising one's superior authority. Non-
technical authority means not relating to or involving science or technology. Technical
adequacy is the state or quality of being adequate.

RELATIONS WITH ENGINEERS

26. He shall undertake only those engineering assignments for which he is


qualified. He shall engage or advise his employer or client to engage specialists and
shall cooperate with them whenever his employer’s or client's interest are served best
by such an arrangement.

EXPLANATION:

Engineering assignments refers to the process of defining, documenting and


maintaining requirements to the sub-fields of systems engineering and software
engineering concerned with this process. Specialists referring to a person who
concentrates primarily on a particular subject or activity; a person highly skilled in a
specific and restricted field. Cooperate is an act jointly; work toward the same end.
Arrangement refers to plans or preparations for a future event.

27. He shall individually or collectively with others in the profession protect the
profession from misunderstanding and/or misrepresentations.

EXPLANATION:

Individually means personally; in an individual capacity. Collectively refers as a
group; as a whole. Protect the profession means keep safe from harm or injury.
Misunderstanding/misinterpretation indicates a failure to understand something correctly
/ interpret (something or someone) wrongly.

28. He shall not directly or indirectly injure the professional reputation, prospects,
advancement and/or practice of other engineers. However, if he has proof or personal
knowledge that an engineer has been unethical and/or illegal in his practices, he shall
inform in writing the proper authorities for appropriate action.

EXPLANATION:

Reputation refers to the beliefs or opinions that are generally held about
someone or something. Prospects is the possibility or likelihood of some future event
occurring. Advancements is the process of promoting a cause or plan. Proof refers to
the spoken or written evidence in a trial, the action or process of establishing the truth of
a statement. Unethical/illegal refers to not morally correct / contrary to or forbidden by
law, especially criminal law.

29. He shall uphold the principle of appropriate and adequate compensation for
those engaged in the engineering profession, including those in the subordinate
capacities, in the interest of public service and maintenance of the standards of the
profession.

EXPLANATION:

Compensation refers to something, typically money, awarded to someone as a


recompense for loss, injury, or suffering. Public service refers to which is provided by
government to people living within its jurisdiction, either directly (through
the public sector) or by financing provision of services. Maintenance is the process of
keeping something in good condition. Standards of profession refers to ethical or legal
duty of a professional to exercise the level of care, diligence, and skill prescribed in the
code of practice of his or her profession, or as other professionals in the same discipline
would in the same or similar circumstances.

30. He shall not try to supplant another engineer in a particular employment after
becoming aware that definite steps have been taken toward the other’s employment. 

EXPLANATION:

Supplant means to supersede and replace something or someone. Definite steps


refer to clearly stated or decided; not vague or doubtful.

31. He shall not compete, by underbidding, through reduction in his normal fees
on the basis of charges for work, after having been informed of the charges submitted
by another engineer.

EXPLANATION:

Compete means strive to gain or win something by defeating or establishing


superiority over others who are trying to do the same. Underbidding refers to (in an
auction or when seeking a contract) make a lower bid than (someone). Reduction is the
action or fact of making a specified thing smaller or less in amount, degree, or size.
Normal fees are equal to the sum of average variable costs (total variable costs divided
by Q) plus average fixed costs (total fixed costs divided by Q).

32. He shall be fair and tolerant in his dealings with fellow engineers and give
credit to those to whom credit is properly due.

EXPLANATION:

Fair/tolerant means in accordance with the rules or standards; legitimate / able to


endure (specified conditions or treatment). Dealings refers to business relation or
transaction. Fellow engineers refer to a person in the same position, involved in the
same activity, or otherwise associated with another. Credit is a public acknowledgment
or praise, typically that given or received when a person's responsibility for an action or
idea becomes or is made apparent. Properly due refers to person’s right; what is owed
to someone.

33. He shall uphold the honor and dignity of his profession and avoid association
in responsibility for work with engineers who do not conform to ethical practices.

EXPLANATION:

Uphold honor and dignity refers to high respect; esteem / the state or quality of
being worthy of honor or respect. Conform means to comply with rules, standards, or
laws.

34. He will exercise due restraint in criticizing another engineer’s work in public,
recognizing the fact that the engineering societies and the engineering press provide
the proper forum for technical discussion and criticism.

EXPLANATION:

Restraint is a measure or condition that keeps someone or something under


control or within limits. Engineering societies refers to an organization or club formed for
a particular purpose or activity. Engineering press is a gathering of engineers, an
interview given to journalists by a prominent person in order to make an announcement
or answer questions. Proper forum refers to a place, meeting, or medium where ideas
and views on a particular issue can be exchanged.

RELATIONS TO THE PROFESSION

35. He shall cooperate in extending the effectiveness of the engineering


profession and endeavor to be well-informed of the latest development in the profession
by sharing or exchanging information and experience with other engineers, other
professionals and students; and by contributing to engineering publications and schools
and by participating in the activities of engineering societies.

EXPLANATION:

Effectiveness of engineering profession refers to a degree to which something is


successful in producing a desired result; success. Latest development - make
(something) more modern or up to date. Sharing or exchanging information means a
part or portion of a larger amount that is divided among a number of people, or to which
a number of people contribute. Engineering publication refers to the action of making
something generally known.

36. He shall cooperate in upholding the integrity, dignity and honor of the
profession by avoiding all conducts and practices that will be discrediting and injurious
to the profession.

EXPLANATION:

Conducts and practices refer to behaving in a specified way / the actual


application or use of an idea, belief, or method as opposed to theories about such
application or use. Discrediting means to arm the good reputation of (someone or
something). Injurious means causing or likely to cause damage or harm.

37. He shall be dignified and modest in explaining or discussing his work and/or
merit and shall refrain from self-laudatory advertising or propaganda.

EXPLANATION:

Dignified and modest refers to having or showing a composed or serious manner


that is worthy of respect / unassuming or moderate in the estimation of one's abilities or
achievements. Merit is the quality of being particularly good or worthy, especially so as
to deserve praise or reward. Self-laudatory advertising means (of speech or writing)
expressing praise and commendation to oneself in public. Propaganda refers to
information, especially of a biased or misleading nature, used to promote or publicize a
particular political cause or point of view.

RA 5734 Section 1

SECTION 1. Title of Act. – This Act shall be known and cited as the "Electronics and
Communications Engineering Law of the Philippines."

REQUIREMENTS:

1. The Act shall be known and cited as the "Electronics and Communications
Engineering Law of the Philippines."

EXPLANATION:

Electronics is the science dealing with the development and application of


devices and systems involving the flow of electrons or other carriers of electric charge,
in a vacuum, in gaseous media, in plasma, in semiconductors, in solid-state and/or in
similar devices, including, but not limited to, applications involving optical,
electromagnetic and other energy forms when transduced or converted into electronic
signals. Electronics and Communications Engineer is a person who is qualified to hold
himself/herself out as a duly-registered/licensed Electronics and Communications
Engineer under Republic Act No. 5734. RA 5734 is an act providing for the regulation
for the registration, licensing and practice of professional electronics engineers,
electronics engineers and electronics technicians.

STATUTORY CONSTRUCTION

1. Philippine Constitution, Article 2, Section 18 & 24

Section 18. The State affirms labor as a primary social economic force. It shall protect
the rights of workers and promote their welfare.

JUSTIFICATION:

As an engineer, there are sets of requirements that needs to be considered and


fulfilled. There are certain regulations that an applicant for this career must follow which
are listed and discussed in RA 5734. There is a process on how to become an
electronics technician, electronics engineer and professional electronics engineer.
These personnel have a vital role in the economy of the country, thus they belong to the
primary social economic force. They have the rights to as engineers, thus the process to
become one of them must be more responsive and comprehensive as stated by the RA
5734. Due to this, the welfare of these individuals must be protected to agree to the
Philippine Constitution. Also, considering the process of application, such as the
registration and licensing as well as the practice of the career, the regulations
considered by the RA 5734 must be able to protect the rights and welfare of the
applicants in return.

Therefore, the Philippine Constitution, Article 2, Section 18 is an implied


construction of the RA 5734.

Section 24. The State recognizes the vital role of communication and information in
nation-building.

JUSTIFICATION:

Electronics engineers are the people or professionals whose line of work is the
communication and information. The transfer of information through a medium is known
as the communication. This is the main purpose why electronics engineers exist. The
Philippines recognizes the vital role of communication and information in nation building
as stated in the constitution. This means that the electronics engineers who are the
professionals in communications and information play a vital role in the society.

Therefore, the Philippine Constitution, Article 2, Section 24 is a direct


construction of the Republic Act 5734.

2. Regulation ITU-T A.1

This Recommendation describes general work methods for ITU-T study groups.
It provides guidelines related to work methods, such as the conduct of meetings,
preparation of studies, management of study groups, joint coordination groups, the role
of rapporteurs and the processing of ITU-T contributions and TDs.

JUSTIFICATION:

The ITU-T has its composition of study groups which provides the guidelines
related to work methods. The RA 5734 is considering the personnel whom are
electronics engineer. The people concerned in the telecommunication system is mainly
of the track that an electronics engineer has. Thus, the study groups that the ITU-T has
consist of electronics engineer. The RA 5734 is made for the regulations and rules that
an electronics engineer must know to be enable to be considered as part of the study
group of the ITU-T. The Regulation ITU-T A.1 is mainly concerned of people who will be
part of the development of the telecommunications department thus they need qualified
electronics engineer for this.

Therefore, the Regulation ITU-T A.1 is a direct construction of the RA 5734.

Republic Act 9292

RA 9292, Article I, Section 1 and 2

SECTION 1. Short Title. - This Act shall be known as the "Electronics Engineering Law
of 2004".

SECTION 2. Statement of Policy. - The State recognizes the importance of electronics


engineering in nation-building and development. The State shall therefore develop and
nurture competent, virtuous, productive and well-rounded Professional Electronics
Engineers, Electronics Engineers and Electronics Technicians whose standards of
practice and service shall be excellent, qualitative, world-class and globally competitive
through inviolable, honest, effective and credible licensure examinations and through

professional education, development and growth.

2. The state recognizes the importance of electronics engineering in the nation


building and development.

An electronics engineer is personnel that is tasked to do electrical circuits and


connections that are of small unit or micro level. They are the ones that have great
potentials regarding the improvement and development of the nation. Thus they play
vital role in the nation building and development.

3. The State shall therefore develop and nurture competent, virtuous, productive
and well-rounded Professional Electronics Engineers, Electronics Engineers and
Electronics Technicians whose standards of practice and service shall be excellent,

credible licensure examinations and through regulatory measures, programs and

Civil Service Commission Guidelines

The Civil Service Commission (CSC) is the central personnel agency of the
Philippine government. One of the three independent constitutional commissions with
adjudicative responsibility in the national government structure, it is also tasked to
render final arbitration on disputes and personnel actions on Civil Service matters.

STATUTORY CONSTRUCTION

1. EXECUTIVE ORDER NO. 292, Section 2, (11)

Regulatory agency refers to any agency expressly vested with jurisdiction to


regulate, administer or adjudicate matters affecting substantial rights and interests of
private persons, the principal powers of which are exercised by a collective body, such
as a commission, board or council.

JUSTIFICATION:

The Civil Service Commission(CSC) is a regulatory agency of the Republic of the


Philippines. They are tasked to render the final arbitration on the disputes and
personnel actions. As the EO. 292 states, a regulatory agency shall regulate, administer
or adjudicate matters affecting the substantial rights and interests of private persons.
The main considerations and concerns affected by the Civil Service Commission are the
private persons. Thus the EO. 292’s main concern matches with the main concern of
the CSC.

Therefore, the Executive Order No. 292 is a direct construction of the CSC
Guidelines made by the commission.

2. Philippine Constitution, Article 9(B), Section 3

The Civil Service Commission, as the central personnel agency of the


Government, shall establish a career service and adopt measures to promote morale,

efficiency, integrity, responsiveness, progressiveness, and courtesy in the civil service.
It shall strengthen the merit and rewards system, integrate all human resources
development programs for all levels and ranks, and institutionalize a management
climate conducive to public accountability. It shall submit to the President and the
Congress an annual report on its personnel programs.

JUSTIFICATION:

The guidelines set by the commission are required to promote morale, efficiency,
integrity, responsiveness, progressiveness, and courtesy. The guidelines before having
the CSC examinations promotes these characteristics. These characteristics are directly
stated in the Philippine Constitution, Article 9(b), Section 3. Since the guidelines set by
the CSC require the applicants to be having good moral characters, no records of
criminal case and promoting integrity and courtesy, and since the Philippine Constitution
also requires this characteristics, we can obtain a conclusion that the CSC Guidelines
made by the commission is a direct construction of the Philippine Constitution, Article
9(b), Section 3

Pledge of ECE

RA 9292 ARTICLE III, SEC. 22.


Professional Oath. — All successful examinees and all those who have qualified
for registration without examination shall be required to take a professional oath before
any member of the Board or any person authorized by the Commission before he/she
can be registered and issued a Certificate of Registration and Professional Identification
Card, and as a prerequisite to practicing as a Professional Electronics Engineer,
Electronics Engineer or Electronics Technician.

1. All successful examinees shall be required to take a professional oath before
any member of the Board or any person authorized by the Commission before
he/she can be registered and issued a Certificate of Registration and
Professional Identification Card.

declaring that promise and vow upon something or someone sacred to the person

is taken, the maker is expected to do everything to keep that promise. Those failing to
make true to their oath are expected to face divine displeasure. Being unable to fulfill
the duties and responsibilities involved in the oath is something that illicit displeasure
and great disappointment.
As stated in the requirements in RA 9292 ARTICLE III, SEC. 22, it is mandatory
and a prerequisite that a successful examinee of the Electronics Engineering Board
Exam of the Philippines should be present in the Oath taking ceremony before he/she
can be registered and issued a Certificate of Registration and Professional Identification
Card. Attendance in Oath taking ceremony is a must as mandated in this section of this
Act.

The Board Examination


RA 9292 ARTICLE III Sec 13-17
EXAMINATION, REGISTRATION AND LICENSURE

1. All applicants seeking to be registered and licensed as Electronics Engineers and


Electronics Technicians, shall undergo the required examinations to be given by
the Board in such places and dates as the Commission may designate in
accordance with the provisions of Republic Act No. 8981.

EXPLANATION:
An applicant for ECE and technician exam must take the exam and pass the
exam given by the Board.

2. In order to be allowed to take the examination for Electronics Engineer or


Electronics Technician.
Requirements:
(a) He/She is a citizen of the Philippines or of a foreign country qualified to take
the examination as provided for in Section 33 of this Act;
(b) He/She is of good moral character and had not been convicted by a court of
law of a criminal offense involving moral turpitude;
(c) For the Electronics Engineering examinations, he/she is a holder of a degree
of Bachelor of Science in Electronics and Communications Engineering or
Electronics Engineering, or subject to compliance with minimum requirements to
be prescribed by the Board, such equivalent and/or related engineering course or
program from any school, institute, college, or university recognized by the
Government or the State where it is established, after completing a resident
collegiate course equivalent to that of a full baccalaureate degree;

(d) For the Electronics Technician examinations:
(1) is a graduate of an Associate, Technician, Trade or Vocational course
in electronics or, subject to the evaluation of the Board, such equivalent
and/or related formal or non-formal course or program from any school,
college, university or training institution recognized by the Government or
the State where it is established, after completing a resident course or
program of not less than two (2) years, or
(2) has completed at least the minimum third-year equivalent of a
Bachelor of Science program in Electronics and Communications
Engineering or Electronics Engineering program according to CHED
guidelines, or, subject to the evaluation of the Board such equivalent
and/or related engineering course or program from any school, institute,
college or university recognized by the Government or State where it is
established;

EXPLANATION:
Examinee must be qualified to take the ECE board exam. Following
requirements are stated in this section, failure to pass these requirements then one
can’t take the exam.

3. The examination for Electronics Engineers shall consist of written tests which
shall cover subjects prescribed by the Board but including at least the following:
Mathematics,
Applied Sciences
Engineering Economics
Laws and Ethics,
Electronics Communications,
Computers and Information and Communications Technology.

The examinations for Electronics Technician shall consist of written and/or


practical tests covering subjects to be prescribed by the Board and shall cover
subjects specific to the practice of Electronics Technicians.
As urgent and important need arises so as to conform to technological and
modern changes, the Board may re-cluster, rearrange, modify, add to or exclude
any subject and prescribe the number of final examination/s per year after
approval by the Commission. The PRC Board resolution thereon shall be
officially published in the Official Gazette or major daily newspapers of general
circulation and also circularized and disseminated to all colleges.

EXPLANATION:
In this section states the following subjects to be taken by an examinee, subjects
like Mathematics, Applied Sciences, Engineering Economics, Laws and Ethics,
Electronics Communications, Computers and Information and Communications
Technology are the scope of the ECE board exam.

4. To pass the licensure examination, a candidate for Electronics Engineer or


Electronics Technician must obtain a passing rating of seventy percent (70%) in
each subject given during the examination: Provided, however, That a candidate
who obtains a passing rating in the majority of the subjects but obtains a rating in
the other subject/s below seventy percent (70%) but not lower than sixty percent
(60%), shall be allowed to take one removal examination on the subject/s where
he/she failed to obtain the passing rating: Provided, finally, That should the
examinee fail to obtain a passing rating in the removal examination, he/she shall
be considered as having failed the entire licensure examination.

EXPLANATION:
Passing rate as stated in these section is 70% for all the subjects taken by the
examinee. Lower than 70% in any subject means failure in the exam, but some
conditions and chances are given by the commission to an examinee if 1 subject is
lower than 70% but not also lower than 60%, retake on that subject can be granted as
second chance. Failure on the second chance given then retake on all subject is the
final chance.

5. The Board and the Commission shall correct and rate the licensure examination
papers and shall release the examination results within fifteen (15) days after the
said examination.

EXPLANATION:
Results of the Board examination will be released within 15 days after the
examination and examinees who passed the examination will be from that day is a
Licensed Electronics and Communications Engineer.

Regulating the ECE Profession (PRC)

REPUBLIC ACT NO. 8981, Section 3


“Professional Regulation Commission – There is hereby created a three-man
commission to be known as the Professional Regulation Commission, hereinafter
referred to as the Commission, which shall be attached to the office of the President for
general direction and coordination.”
REQUIREMENT:
1. There is hereby created a three-man commission to be known as the
Professional Regulation Commission, hereinafter referred to as the Commission,
which shall be attached to the office of the President for general direction and
coordination.”
EXPLANATION:
The Professional Regulation Commission (PRC) is the Philippine government
agency mandated to regulate and supervise the practice of the professionals, the highly
skilled manpower of the country. The PRC has one of the most daunting mandates in
national development, as it regulates and supervises the practice of the professionals
who constitute the highly skilled manpower of the country. As the agency-in-charge of
the professional sector, the PRC plays a strategic role in developing the corps of
professionals for industry, commerce, governance, and the economy.

Republic Act No. 9292, Article 2, Section 6-12

Section 6. Composition of the Board

“There is hereby created a Professional Regulatory Board of Electronics and


Engineering, hereinafter referred to as the board, under the administrative control and
supervision of the Professional Regulation Commission, hereinafter referred to as the

Commission, composed of a chairman and two (2) members who shall be appointed by
the President of the Philippines from the three (3) recommendees per position chosen
and ranked by the Commission, which recommendeEs shall in turn be chosen from the
five (5) nominees for each position submitted by the accredited professional
organization, in accordance with rules and regulations presently in existence or that
may be promulgated for such purpose.

Requirement:
Professional Regulatory Board of Electronics and Engineering hereinafter
referred to as the Commission, composed of a chairman and two (2) members who
shall be appointed by the President of the Philippines from the three (3) recommendees
per position chosen and ranked by the Commission, which recommendees shall in turn
be chosen from the five (5) nominees for each position submitted by the accredited
professional organization.

Explanation:
The Professional Regulatory Board of Electronics and Engineering which is
under the administrative control and supervision of PRC is mandated to regulate and
supervise the practice of Professional Electronics Engineer (PECE), Register
Electronics Engineer (ECE), and Electronic Technician (ECT) of the Philippines. As the
regulatory board of electronics and engineering they play a strategic role on developing
the corps of professionals for industry, commerce, governance, and the economy. The
commissioners must be of unquestioned integrity and recognized prominence in
previous public and/or private employment, and of competent in all aspects of
communications, preferably one of whom was a lawyer and the other an economist.

Section 7. Powers and Function of the Board


The Board is vested with the authority to:
(a) Administer/Implement the provisions of this Act;

(b) Administer oaths in connection with the administration of this Act;

(c) Adopt an official seal of the Board;

(d) Issue, suspend or revoke Certificates of Registration and accordingly the
Professional Identification Cards of Professional Electronics Engineers,
Electronics Engineers or Electronics Technicians, or otherwise suspend the
holder thereof from the practice of his/her profession, for any justifiable cause
and after due process;

(e) Maintain a roster of Professional Electronics Engineers, Electronics


Engineers and Electronics Technicians;

(f) Issue, suspend and/or cancel special permits to foreign Professional


Electronics Engineers, Electronics Engineers or Electronics Technicians in
accordance with the provisions of this Act;

(g) Prescribe, amend or revise the requirements for licensing of Professional


Electronics Engineers, and prepare, adopt and issue the syllabi of the subjects
for the licensure examination for Electronics Engineers and Electronics
Technicians, and prepare the questions therefore, in strict conformance with the
scope of the syllabi;

(h) Adopt a program for the full computerization of the licensure examination;

(i) Grant registration without examination, subject to review and approval by the
Commission, in accordance with the provisions of this Act;

(j) Study, examine and recommend, in coordination with the Commission on


Higher Education (CHED) and the Technical Education and Skills Development
Authority (TESDA), and in consultation with other concerned government entities
and the accredited professional organization, the essential requirements as to
curricula and facilities of schools, colleges or universities, seeking permission to
open courses or programs or already offering courses or programs in electronics
engineering, electronics technician and related courses or programs and to see

to it that these requirements, including employment of qualified faculty members,
are properly complied with: Provided, That within three (3) years after the
effectivity of this Act, the Board shall, in coordination with CHED, TESDA, and in
consultation with other concerned government entities and the accredited
professional organization, review and define/re-define the curricula for electronics
engineering, electronics technician and/or allied courses or programs for the
purpose of re-aligning, revising and/or consolidating the same and/or otherwise
defining the minimum requirements by means of which graduates of related or
allied courses or programs can qualify to take the Electronics Engineer and
Electronics Technician licensure examinations;

(k) Inspect educational institutions and based on their findings thereon,


recommend to CHED and/or the TESDA and/or other government entities
concerned with the granting of school permits or authorization, the opening,
improvement/upgrading or closure of colleges or schools and universities offering
electronics engineering and electronics technician courses or programs;

(l) Adopt and administer a Code of Ethics and a Code of Technical Standards of
Practice for Professional Electronics Engineers, Electronics Engineers and
Electronics Technicians in the Philippines;

(m) Promulgate rules and regulations on the scope of practice of Professional


Electronics Engineers, Electronics Engineers and Electronics Technicians;

(n) Promulgate a program for continuing professional education and/or


development of Professional Electronics Engineers, Electronics Engineers and
Electronics Technicians;

(o) Prescribe the minimum manning and manpower requirements for


Professional Electronics Engineers, Electronics Engineers and Electronics
Technicians in industrial plants and commercial establishments for purposes of

ensuring compliance with the provisions of this Act and all other ordinances,
laws, rules and regulations that may be enacted hereinafter;

(p) Formulate, prescribe and adopt such rules and regulations for electronics
installations in industrial plants, commercial establishments and other buildings
or structures covered by the National Building Code of the Philippines, in
coordination with the Department of Public Works and Highways (DPWH), other
concerned agencies, representatives of industry and the Accredited Professional
Organization;

(q) Study the conditions affecting the Professional Electronics Engineering,


Electronics Engineering and Electronics Technician professions in the
Philippines, and whenever necessary, exercise the powers conferred by this and
other Acts, and adopt such measures as may be deemed proper for the
enhancement and advancement of the professions and/or the maintenance of
high professional, ethical and technical standards, and for this purpose, the
Board may personally or through subordinate employees of the Commission or
member/s of the Accredited Professional Organization, duly authorized by the
Board and approved by the Commission, conduct ocular inspection or visit
industrial plants and commercial establishments where Professional Electronics
Engineers, Electronics Engineers and Electronics Technicians are employed for
the purpose of determining compliance with the provisions of law relative thereto,
in accordance with established policies promulgated by the Commission;

(r) Hear and decide violations of this Act, its implementing rules and regulations,
the Code of Ethics and the Code of Technical Standards of Practice for the
profession, and for this purpose, issue subpoena ad testificandum and/or
subpoena duces tecum to secure attendance of witnesses and the production of
documents in connection with the charges presented to and/or any investigation
pending before the Board;

(s) Delegate the hearing or investigation of administrative cases filed before it to
authorized officers of the Commission, except in cases where the issue involved
strictly concerns the practice of the Professional Electronics Engineering,
Electronics Engineering and Electronics Technician Professions, in which case
the hearing shall be presided over by at least one (1) member of the Board
assisted by a Legal or Hearing Officer of the Commission;

(t) Promulgate resolutions, orders and/or decisions on such administrative cases:


Provided, That such resolutions, orders and/or decisions shall be subject to
appeal within fifteen (15) days from receipt thereof with the Commission, which
may affirm or reverse the same, dismiss the case, deny the appeal or remand the
case to the Board for further action or proceeding: Provided, further, That if after
fifteen (15) days from the receipt of such decision no appeal is taken therefrom to
the Commission, the same shall become final and immediately enforceable;

(u) Submit an annual action plan and corresponding report at the beginning and
close of each fiscal year on the activities, proceedings and accomplishments of
the Board for the year, incorporating therein any recommendation to the
Commission; and

(v) Discharge such other powers and functions as the Board and the Commission
may deem necessary for the practice of the profession and the upgrading,
enhancement, development and growth of the Professional Electronics Engineer,
Electronics Engineer and Electronics Technician professions in the Philippines.
Except those in administrative cases, all resolutions embodying rules and
regulations and other policies and measures issued and/or promulgated by the
Board shall be subject to the review and approval by the Commission.
Section 8. Qualifications of Board of Members
The chairman and members of the Board must possess the following
qualifications at the time of their appointment:

(a) Be a citizen and a resident of the Philippines for at least five (5) consecutive
years prior to his/her appointment;

(b) Be of good moral character and integrity;

(c) Be a holder of a valid Certificate of Registration and a valid Professional


Identification Card as a Professional Electronics Engineer, duly qualified to
practice as a Professional Engineer in the Philippines;

(d) Be a member of good standing of the Accredited Professional Organization;

(e) Be in active practice of the electronics engineering profession for at least ten
(10) years prior to his appointment, either in self-practice, or employment in
government service and/or in the private sector;

(f) Must not have any pecuniary interest, directly or indirectly, in any school,
academy, college, university or institution conferring an academic degree and/or
certification/accreditation necessary for admission to the practice of Electronics
Engineering and/or Electronics Technician or where review classes in
preparation for the licensure examination are being offered or conducted nor
shall he/she be a member of the faculty or of the administration thereof prior to
taking his/her oath of office; and

(g) Must not have been convicted of an offense involving moral turpitude.

Section 9. Term of Office


“The members of the Board shall hold office for a term of three (3) years from
date of appointment or until their successors shall have been appointed and qualified
and may be re-appointed once for another term. Any vacancy occurring within the term
of a member shall be filled for the unexpired portion of the term only: Provided, That the
member appointed to serve the unexpired term may be re-appointed more than once for
as long as his/her continuous tenure shall not exceed six (6) years. Each member of the
Board shall take the proper oath prior to the assumption of office.”

Requirement:
The members of the Board shall hold office for a term of three (3) years from

Section 10. Compensation & Allowances of the Board


“The Chairman and members of the Board shall receive compensation and
allowances comparable to that being received by the Chairman and members of
existing regulatory boards under the Commission as provided for in the General
Appropriations Act.”

Requirement:
The Chairman and members of the Board shall receive compensation and
allowances comparable to that being received by the Chairman and members of
existing regulatory boards.

Explanation:
Compensation and benefits (abbreviated “C&B”) is a sub-discipline of human
resources, focused on employee compensation and benefits policy-making. Therefore
for every person who offers services whether in public or private has the right to have its
own salary or wages for a living.

Section 11. Removal of Board Members


“The President of the Philippines, upon recommendation of the Commission, may
suspend or remove any member of the Board for neglect of duty, incompetence,
manipulation or rigging of the licensure examination results, disclosure of secret
information or the examination questions prior to the conduct of the said examination, or
tampering of the grades therein, for unprofessional or unethical conduct, or for any final
judgment or conviction of any criminal offense by the Courts, after having given the
member concerned an opportunity to be heard and/or to defend himself/herself in a
proper administrative investigation.”

Requirement:
President of Philippines, upon recommendation of Commission, may suspend or
remove any member of the Board for neglect of duty and other violations.

Explanation:
According to article 2 - section 8, board of members must be of good moral
character and integrity. This qualification must possess at the time of their appointment.
Any violation of the said rules and regulations will be suspended or may be remove but
the member of the board have the opportunity to be explain him/herself in a proper
administrative investigation.

Section 12. Custodian of Board Records, Secretariat and Support Services.


“All records of the Board, including applications for examination, administrative
cases involving Professional Electronics Engineers, Electronics Engineers and
Electronics Technicians shall be kept by the Commission.

The Commission shall designate the Secretary of the Board and shall provide the
secretariat and other support services to implement the provisions of this Act.”

Requirement:
All records of the Board shall be kept by the Commission. The Commission shall
designate the Secretary of the Board and shall provide the secretariat and other support
services to implement the provisions of this Act.

Explanation:
Records are very important when a sudden problem occurs. It provides evidence,
confirmation, documentation and testament that can be used as legit bases for a certain
situation.
The Commission must assign the Secretary of the Board and must provide the
secretariat and support services to implement the provision of RA 9292.

known as the "Electronics and Communications Engineering Act of the Philippines",
and for other purposes.

Justification:
For the regulating of ECE profession, Professional Regulatory Board of
Electronics and Engineering which is under the administrative control and supervision of
the Professional Regulation Commission must be in charge of the practice of PECE,
ECE, and ECT. Sections 6-12 includes the composition of the board, powers and
functions of the board, qualifications of board members, the member’s term of office,
compensation and allowances of the board, removal of board members if any of the
rules and regulations are violated, and lastly custodian of board records, secretariat and
support services to have a legal basis if problem occurs.

Practicing the ECE Profession


RA 9292, Article IV Sec. 27-30
Sec. 27. Practice of the Profession
No person shall offer himself/herself in the Philippines as, or use the title
“Professional Electronics Engineer” (PECE),” Electronics Engineer” (ECE) or
“Electronics Technician” (ECT), or use any word, letter, figure, or sign without holding a
valid Certificate of Registration and a valid Professional ID card.

Section 28. Prohibitions and Limitations on the Practice of Electronics


Engineering and Electronics Technician Profession
Unless otherwise prescribed by any supervening law, the practice of electronics
engineering and electronics technician shall be a professional service, admission to
which must be determined on the basis of the individual's personal qualifications.
Hence, no firm, company, partnership, association or corporation may be registered or
licensed as such for the practice of electronics engineering and electronics technician.
However, persons properly registered and licensed as Professional Electronics
Engineers, Electronics Engineers or Electronics Technicians may, among themselves or
with any other allied professionals, form a partnership or association or corporation and

collectively render services as such: Provided, that individual members of such
partnerships or associations or corporations shall be responsible for their own
respective acts.

Section 29. Seal of the Professional Electronics Engineers.


All licensed Professional Electronics Engineers shall obtain and use a seal of a
design prescribed by the Board bearing the registrant's name, registration number and
title. Plans, drawings, permit applications, specifications, reports and other technical
documents prepared by and/or executed under the supervision of, and issued by the
Professional Electronics Engineer shall be stamped on every sheet/page with said seal,
indicating therein his/her current Professional Tax Receipt (PTR) number, date/place of
payment and current membership number in the Accredited Professional Organization,
when filed with government authorities or when used professionally.

Section 30. Code of Ethics and Code of Technical Standards of Practice.


  The Board shall adopt a Code of Ethics and the Code of Technical Standards of
Practice for Electronics Engineers and Electronics Technicians, which shall be
promulgated by the Accredited Professional Organization.

REQUIREMENTS:

1. Professional Electronics Engineer” (PECE),” Electronics Engineer” (ECE) or


“Electronics Technician” (ECT) shall have his/her own valid professional ID or certificate
of registration before offering his/her service to the Philippines.
EXPLANATION:
This Section of Article IV states that only a person with valid Professional ID Card
and Certification of Registration shall use the title Electronics Engineer, Electronics

Technician and Professional Electronics Engineer. Any ID aside from the valid
Professional ID Card usage while practicing the profession is considered illegal.

2. The practice of electronics engineering and electronics technician shall be a


professional service, admission to which must be determined on the basis of the
individual's personal qualifications.
EXPLANATION:
This Section of Article IV states that only a person with valid professional ID and
Certificate of Registration shall practice the ECE, PECE and ECT profession. An
organization or association that is allied with an ECE, PECE and ECT however, is
allowed to do something in relation with ECE profession as long as they are aware of
their responsibilities in their acts and are ready for the consequences in case they
violate acts in relation to ECE, PECE and ECT Profession.

3. All licensed Professional Electronics Engineers shall obtain and use a seal of a
design prescribed by the Board bearing the registrant's name, registration number and
title.
EXPLANATION:
There is a seal of design prescribed by the board that shall be used by a
Professional Electronics Engineer with his/her name, registration number and title which
is the only seal valid seal he/she can use in his plans, permit application, reports and
other documents in relation to practice of his/her profession. Using other seal aside from
what is prescribed is considered invalid and not accredited for use. Documents with
unaccredited seal will also be then considered invalid.

4. The Board shall adopt a Code of Ethics and the Code of Technical Standards
of Practice for Electronics Engineers and Electronics Technicians, which shall be
promulgated by the Accredited Professional Organization.

EXPLANATION:

Like any other professionals, an Electronics Technician, Electronics Engineer
and Professional Electronics engineer must follow the Code of Ethics and The Code of
Technical Standards in relation to the practice of their profession. This Code of Ethics
shall be widely considered by APO (Accredited Professional Organization) to be valid.

STATUTORY CONSTRUCTION
1. Philippine Constitution Article II, Section 18
Section 18. The State affirms labor as a primary social economic force. It shall
protect
the rights of workers and promote their welfare.
JUSTIFICATION:
Section 18 protects the rights and welfare of workers. Any violation against it is
punishable by law. Article IV section 27,28 and 29 implies that there shall no other
workers that can practice ECE, ECT and PECE unless he/she has a valid professional
ID and certificate of registration. Practicing the ECE profession without any license and
use of invalid seal is considered fraud and does violate section 18 of the Philippine
Constitution.

Therefore, Section 18, Article II of the Philippine Constitution is an implied


construction of Article IV of RA 9292.

2. ITU-Development Sector, Section 69


Section 69: Any person who, fraudulently, plays a leading role in the design,
organization or execution of the practices mentioned in Section 5 (1) and (2) of this law
shall be punished with 6 (six) months to 2 (two) years of imprisonment.

Section 69 of ITU-D states practice that compromises telecommunication market


shall be prohibited and an enterprise or group shall be prohibited from abusive position
in the market. Section 69 states that there shall be no person allowed to use
fraudulence in design or any organization for his or her gain which means almost the

same as what section 27,28,29 of RA 9292 implies. There shall be no other persons
aside from a valid and registered ECT, ECE and PECE shall practice the profession.

Therefore, section 69 of ITU-D is a direct construction of Article IV of RA 9292.

SUMMARY

In this written report, it consists of different articles or sections regarding ECE


Laws and each of these laws consist of supporting laws which are of higher level. This

application of the electronics engineering science and technology in the field of
consultation, design, construction and installation, inspection, appraisal and
acceptance, operations, maintenance, research and development, education and
manufacturing. According to RA 9292, licensed professional electronics engineer are
authorized to render engineering consultation services, design services related to
electronics. Also, registered electronics engineers can take charge or supervise
electronics construction, installation and operation. Therefore, only electronic engineers
with valid certificate of registration and a valid professional identification card are
qualified to perform the work of a Professional Electronics Engineer
Therefore, RA 9292 is an act providing for a more responsive and
comprehensive regulation for the registration, licensing and practice of professional
electronics engineers, electronics engineers and electronics technicians, repealing

must pay great attention in observing and compliance with the hierarchy of statutory
construction in the making of a law, rules or regulation for further knowledge and
understanding. Knowledge and deeper understanding of pertinent law, rules or
regulations related to a promulgated law governing the conduct and standards in the
Electronics Engineering field ensures the organization of the parties or individuals
involved. The group also recommends that concerned individuals to look after and be
updated for the revisions made for some of the pertinent rules law, rules and regulations
coping with the necessary revisions as technology and modern day advances.

Pledge of an Electronics Engineer

I am an Electronics Engineer. In my profession, I take deep pride, but without


vainglory; to it I owe solemn obligations that I am eager to fulfill.

As an Electronics Engineer, I will participate in none but honest and legal

utmost of performance and fidelity.
