Salient HIGLIGHTS

 Single Window Clause 3 (b) : District Collector appointed as a nodal point for all licenses &
approvals required for setting up telecom infrastructure in District.

 Applicable to IP/ TSP/ ISP.

 This Policy will override existing Madhya Pradesh 4G Policy- 2013.

 The provisions of MP Bhoomi Vikas Niyam, 2012 would not apply on the infrastructure
setup done under this policy.

 Clause 5 - Establishment of “District Level Telecom Committee” headed by District

Collector. To facilitate establishment of Infrastructure in District.

 The validity of Permission is coterminous with the License/ registration period of the
applicant. ( For RJIL it is from 2013 to 2033) (Clause No-11)

Timeline

 Authority has to Issue NOC or reject within 21 days post which NoC will be
considered as Deemed NoC and final permission will be granted within 60
days from the date of application by District Collector. (Ref- Clause no- 9 & 11)

 NOC to be provided by Authority in Form II & License in Form- III.

 In case of Smart Cities – NOC shall be obtained from respective Smart City
Company.

APPLICATION
Application to Collector :

 FORM-I : Application for all Government & Private sites (Mandatory).

 FORM-I A : To be submitted in addition to Form-I for all GBM / GBT sites.

 FORM-I B : To be submitted in addition to Form-I for all Roof top Towers

(RTT)sites.

 FORM-I C : To be submitted in addition to Form-I for all Fiber Applications.

Application Fee of Rs.1,000/- to be submitted with every application to District

Collector.

Refusal to Issue of NOC (Clause No.10)

Authority can Refuse to Issue NOC on basis of 3 Reasons : (Clause-10)

1. Project has already been sanctioned on the proposed applied land / Location.

2. Telecom Infrastructure affect the use of land for which it is being used currently.

3. If proposed tower obstruct road, May cause for accidents/ hinder line of Sight or near to
high tension line.

 In case of refusal for NOC- Authority shall clearly mention the reason for rejection &
provide necessary documentary evidence to District collector.

 District Collector is not bound by Deppt opinion for Refusal if found contrary & will have
complete authority to issue NOC.

Area for Land Infrastructure (Clause No. 12 a (i))

Permission Feasible Locations (Clause No. 12 a (v,vi,vii))

 License can be given on land belonging to State government / Other Deptt / authority.

 Land belonging PSU / Corporation / Commission, etc.

 Permissions will not be provided in/on premises/buildings of Educational Institutions /

Government Hospitals/ Public Parks / Paly grounds.

 Permission on Govt Building can only be provided only for obtaining Safety Certificate from
Competent Engineer / Architect.

 Permission on Private land / Building will be provided on the basis of agreement between
the company & Owner.

License Fees (Clause No-13)

 The application processing fee of Rs.1000 per site to be submitted.

 A onetime license fee equivalent to 20% of the total current value of the land/property Same is for State
Government land & buildings or Collector Guideline rates.

 No license fee for underground infrastructure however applicant has to restore the land to a similar
condition.

 License fees for Public sector Undertaking, Authority, Corporation, Commission etc of Government of India,
will be decided by concerned authority.

 For private locations there is no License fees.

Removal of Infrastructure Clause No-16

Licensing Authority is empowered to remove Any structure/ Construction :

• If it violates the conditions on which the license was granted

• Structure which are unsafe with respect to Public Safety.

• Land Acquired for public purpose

• Prior intimation of 2 Weeks time will be given to applicant to submit reply, before action is taken.

• On Central govt Land ( PSU / Corporation / Authority) actin will be taken as per conditions on
which permission was provided.

OFC- Clause No. 12(c)

 Permission shall be provided for laying cable / Duct / Other Underground Infrastructure on
Government land.
 Minimum Possible width of Land Shall be considered while granting ROW permissions.

 For laying Underground infrastructure Micro-trenching technique in urban & other populated
areas to be used.

 License for ROW can also be issued on Land belonging to a PSU / Corporation / Commission
etc of Govt of India after taking due approval from respective authority.

 Refundable Bank Guarantee of 100 per cent of the total value of the restoration charges
determined by the concerned department to be submitted before permission to be granted.

 License on Private land can be given subject to the agreement with the Land owner &
Company.
