2. caretakers of that parcel of land situated at Barangay Sonlon, Asuncion,
Davao del Norte, covered and embraced by KATIBAYAN NG ORIHINAL NA TITULO
BLG 55705 registered under the name of CRISTITA URBUDA;
3. As one of the caretakers and occupants of the above-mentioned parcel of
land, I have personal knowledge that the same is planted with hundreds of
various fruit bearing trees and constructed with buildings and improvements
by the URBUDAS;
4. I also have personal knowledge that Barangay Captain ALFAR is fervently
assailing the URBUDAS' peaceful ownership over their land because ALFAR
obsessively desires to construct a Barangay terminal thereon, and since
ALFAR could not wrest possession of the said property from the URBODAS, he
is harboring frustration and hatred against the URBODAS;
5. Sometime in 2012 and during the road construction conducted by the Barangay
Sonlon, such hatred towards the URBUDAS was manifested by ALFAR when he
unlawfully and unjustly ordered the bulldozer operator to cause the
demolition of the URBODAS’ wall-barrier, made of cacao trees, on their
private property subject of this case; however, in order to not escalate
the dispute, the URBODAS remained non-confrontational and did not file an
action in court for the redress of a wrong committed by ALFAR against them;
6. Recently, in the morning of 17 July 2017, I personally witnessed our
incumbent Barangay Captain JOSE ALFAR, together with four men, trespassing
the said parcel of land and maliciously destroying the trees planted and
improvements built thereon by the URBUDAS;
7. On the same occasion, I personally heard and witnessed Barangay Captain
JOSE ALFAR, fuming mad and angrily shouting “MGA URBODA! PAHAWA KAMO
NIINING LUGARA. KUNG DILI MO MUHAWA, PAMATYON TAMONG TANAN. ANG IGSOON UG
PAG-UMANGKON NA MUBABAG, AKONG BITAYON PATIWARIK.” (YOU URBODAS! GET OUT OF
THIS PLACE. IF YOU WON’T LEAVE THIS PLACE, I WILL KILL YOU ALL. ANY
RELATIVE WHO WILL RESIST, I WILL HANG HEAD DOWN);
8. Further, on that same occasion, I intended to video capture Barangay
Captain JOSE ALFAR’s but my phone run out of memory storage; I was only
able to take few pictures of ALFAR and his men while they were maliciously
destroying the fruit bearing trees and improvements in the above-said
private property of the URBUDAS;
