Nature of Work:-Construction of Over Head Service Reservoir at Harmasra (400 KL) with

specified staging. The scope includes Aggregate, Sand,Workmen, Specified P&M, Shuttering,
Tools&Tackles, Consumables etc for construction work and other miscellaneous works as
mentioned in the scope of work and as per the approved drawings & instructions of Engineer
In-charge.

1.0 SCOPE OF WORK:


The scope of work covered by this Work Order for the Construction of Over Head Service
Reservoir with specified staging as per Table 1. The scope includes Aggregate, Sand,
Workmen, Specified P&M, Shuttering, Tools & Tackles, Consumables etc for construction work
and other miscellaneous works as mentioned in the scope of work and as per the approved
drawings & instructions of Engineer In-charge. The rates are inclusive of Hydro testing.
Necessary Pipes, Puddle Pipe, Valves, etc. will be provided by L & T free of cost but erection,
installation and inter connection will be in your scope. As per approved drawing and
specifications epoxy paints and others items will be in your scope. All necessary painting &
Name board for OHSR will be in your scope. Lightening arrestor with earthling arrangement,
providing and installation of Water level Indicators, Hand rail, Ladder, Manhole etc and plinth
protection will be in your scope. You shall mobilize sufficient & appropriate Tools & Tackles
Workmen, Materials, Specified P&M, Consumables etcfor the work will be completed within
mutually agreed period. OHSR Locations will be shown to your team by L&T as well as the
competent authority of Client .The work should be carried out with due diligence and all work
should be executed in a workman-like manner subject to the approval of the Project Manager
(PM) whose decision as to the rate of progress and the quality of work / material shall be final
and binding.
The L&T Formwork Doka tower staging upto staging height for formwork shall be issue FOC by
L&T with reconciliation but labor cost for Installation/dismantling shall be in the scope of
contractor. The shuttering materials along with the walkway jalis, supporting pipes, etc shall
be in your scope. The contractor may use own steel staging or L&T Doka tower staging
material ,will be issue up to staging height as per staging plan duration of the OHSR as
directed by the engineer in charge as per construction schedule. The same material shall be
return to store or any damage or lose or ideal of the material, the necessary cost will be
charged from your end. Any mishandling of the L&T provided Formwork shall be debited from
your running bills along with 20% overheads.

2.0 QUANTITY VARIATION:
The price is fixed on the basis of drawings provided by L&T.

3.0 TIME OF COMPLETION:


The completion period for entire work shall be Maximum 09 Months from the date of LOI.
Time is the essence of the contract .The work shall be executed as per the construction
program duly approved by our Planning / Construction manager .You shall strictly adhere to
the construction program thus drawn, and the same shall be reviewed periodically by the
engineer in charge.
You will be required to accommodate for front clearance, timings and co-ordination with the
other vendors working at site if required. Any claims pertaining to idling of your resources like
man, materials, machinery or any other financial claims of any other nature will not be
entertained by us for whatsoever reason.

4.0 PRICE:
The rates is Rs.5.65 per Liter and the same mentioned in the Work Order shall be firm and
shall not be subjected to any kind of escalation or variation till the completion of entire scope
of work covered by this Work Order and the subsequent amendments to be made.

5.0 TAXES & DUTIES:


The Prices are Inclusive of all taxes & duties, excluding Service Tax.
 Sub-Contractors shall be registered in West Bengal GST as works contractor.
 You shall submit the Royalty challan for work done quantities, otherwise Royalty
amount shall be recovered with penalty from your Bills.
 Tax invoice mentioningGST chargeable copy to be submitted by Sub contractor on the
work done.
 L&T could pre-agree that the invoice will be paid in two batches (a) Base Amount (b)
Tax Amount. Tax Amount will be paid only after supplier/subcontractor provides
sufficient proof that the GST amount charged in invoice is declared in its GSTR-1 and
GSTR-3 and payment of taxes has been made.
 L&T has the right to recover tax loss along with consequential interest and penalty
suffered by it due to any non-compliance of tax laws by the other party. Any GST
liability arising on the supplier on account of loss of GST credits for reasons such as
failure of the sellers to prove details for raising invoice with necessary particulars,
delay in payment of consideration beyond stipulated time period and the interest
thereon would be on the suppliers/subcontractor itself and L&T shall not be liable to
compensate the same.
 Workmencess won’t be deducted from your bills and isn’t considered in your scope.
 The Workmen Wages sheets and P.F. & ESI Remittance challans are to be submitted
to our office as per Labour laws.
 TDS as applicable will be deducted.
 Retention amount 5% shall be debited every bill.

 You shall submit the Royalty challan for work done quantities, otherwise 5% of the
work done amount will be kept on hold from your Running bills on account of
Royalty. However same will be released on submission of Challans, once we verify the
genuineness.

6.0 WATCH &WARD FOR MATERIALS:


All transport and handling charges, storage charges, charges for watch &ward for your own
materials and the materials handed over to you from L&T Constructionare included in your
price and L&T will not entertain any claim on account of above at alter date .Formwork
materials should be given by L&T but If the material goes missing, the same shall be debited
from your running bills including a 20% amount towards handling and overheads expenses.

7.0 CONSUMABLES:
All other consumables required for the work to be provided by youas per client/consultants
specifications. Consumables required for the project shall be of standard quality and all the
material entry through DC should have Batch no along-with TC and should have guaranty. All
material must be inspected and passed by QA/QC Engineer of L&T –Construction before taking
in use.

8.0 PLANT & MACHINERY & MAINTENANCE:


All Specified Plant & Machinery and necessary consumables required for the work shall be
provided by you in good condition along with necessary permissions and clearances of Govt.
agencies to transport/engage them if required and approvable. All plant & Machinery will be
verified by our P&M in charge. The Maintenance work has to be planned in advance and
alternative arrangement has to be made to maintain the same progress and should be
informed to the L&T.

9.0 CODES AND STANDARDS:


The works shall be carried out as per the technical specifications/recommendation of
Engineer in charge (or by the Architects/Consultants). In the absence of specification, relevant
Indian Standard Code of Practice together with their latest revisions/amendments as
applicable on the date of work order shall be followed. In the absence of the relevant IS code
of practices also, the instruction of the Engineer in charge and/or standard engineering
practice shall be adopted. Qualityof works shall be as approved by our Client/Consultants.
Incase of Contradictions/conflicts between the specifications, the interpretation of the Project
Manager shall be final and binding on both the parities.

10.0 LABOURLAWS &FACILITIES:


You shall comply with all the labor laws of the State Government, Central Government and
Local authorities as applicable to the place of work. All records to be maintained under the
laws shall be maintained by you and produced to the concerned authorities as and when
directed to do so. No extra payment will be made to you to comply with these labourlaws by
us. All the labors engaged by you must have the Aadhaar Card issued by the Govt of India and a
Bank account. The details shall be submitted to our Time Keeper before engaging the labor at
site.

11.0 ACCOMMODATION&TRANSPORTATION:
Arrangements for food, water, accommodation, and site inter carting, transportation,
electricity and other expenses involved towards your workmen shall be wholesome
responsibility of yoursand the same shall be considered as included in your work order rates
and no additional payments shall be made by us. Accommodation of your workmen shall been
ensured by you for decent living conditions. The prerequisites are being provided along with
this for your needful implementation.

12.0 LOCAL PROBLEMS:


All local problems while executing your scope of work will be taken care by yourself. Necessary
support of Dept. officials shall be facilitated by us.

13.0 WATER:
Water for construction OHSR/GSLR will be arranged by you at your own cost & rates
inclusive of same. The water source for Hydro testing maybe provided by L&T but to conduct
the testing to ensure water tightness of the structure shall be in your scope, the contractor
shall arrange tanker and pumping of water to the tank including the all the charges for
Workmen , P&M, Tools & Tackles etc for hydro testing.

14.0 POWER:
Electricity for construction of OHSR/GS LR and hydro testingpurpose shall be arranged by
you at site.You shall work without causing hazard/inconvenience to inhabitants in surrounding
area of work and other agencies working in the same area. Necessary approval / license
required for running the generator of specified capacity as per State / Central government
guidelines shall be obtained by youmay be provided by L&T. Necessary support of Dept.
officials shall be facilitated by us. No extra payment will be made to you to comply with these
approval / license by us.

15.0 MODE OF MEASUREMENT:


All the measurement shall be taken as per standard practices of civil works. You will be
submitting the Bill of Quantities for your scope of work and the same shall be certified by the
Engineer In-Charge.

16.0 RETENTION MONEY:


Retention @ 5% shall be deducted from each running bill. On completion of scope of works
and successful completion of water tightness test of the structure, the retention amount shall
be released.
17.0 INCOME TAX:
Income tax as per statutory norms shall be recoveredfrom your monthly bills. Necessary tax
deduction certificate will be issued to you, by our Accounts Department.

18.0 PROVIDENT FUND DEDUCTION:


You will have to obtain the PF registration for all your labor and submit the Proof as per the
prevailing Government rules. The liability and responsibility to clear off the PF dues as per
statutory norms shall be yours. Documentary proof of the same shall have to be produced on
monthly basis.

19.0 WORKMEN COMPENSATION:
No Workmen Compensation premium will be deducted from your bills. If applicable, ESIC rules
shall be complied by you, else deductions at applicable rates shall be made from running
account bills.
20.0 STAFF FOR EXECUTION:
You shall depute technically qualified supervisory staffat all work fronts to supervise the work
as per technical specifications. He shall be a competent person with a complete knowledge of
work and shall be responsible for progress and quality of works on behalf of you.
21.0 QUALITY CONTROL &TESTING OF MATERIALS:
Quality of the work/material executed by you will be randomly checked by the engineer in
charge /quality control person. In case of non-compliance of work/material to the required
specification, the entire work or the batch of materials, shall be rejected and the same shall be
done/replace, to comply with specification at your cost.

22.0 SAFETY RULES & REGULATIONS:


The “Sub-contractor” has to follow all safety regulation of L&T/ADB/PHED and shall follow
the permit system. All safety PPE’s like Helmets, safety belts, hand gloves, safety shoes etc.
shall be issued free of cost by L&T. If any safety material issued by L&T is found to be misused,
same shall be recovered from your running bills with additional 20% overheads.
You will abide by all safety standards, specifications and practices in construction and
instructions of Engineer In-Charge / EHS Engineer at site. You are responsible for the safety of
your staff and employees, employees of other agencies working in your area of operation.
You shall delegate the responsibility of implementation of safety rules to one of your staff.
In case of violation of safety rules and precautions by any workman, he will not be permitted
at site of work. Your authorized representative of safety shall attend all safety meetings
convened by L&T-Construction’s site Safety Engineer, and abide by his instructions.

23.0 TERMS OF PAYMENT:


No advance shall be paid on any account. Payments towards running bills shall be made on
monthly basis, based on joint measurement between your representative and our site in
charge. The payment shall be made stage wise based on the mutually decided stages of
payment. For processing of your bill, you shall submit the royalty challans, monthly labor
wages sheet and monthly reconciliation of all the materials issued by L&T on free basis.

24.0 FORCE MAJEURE:


None of the parties here to shall be liable for delay or failure to perform any of its obligations
set forth herein, if such delay or failure has been caused by Force Majeure including but not
limited tower, hostility, Acts of Public enemy, civil commotion, Sabotage, fires, floods,
explosion, epidemics, quarantine, restriction, lockouts and Acts of Gods or any circumstances
of whatever nature beyond the control of the concerned party that the Force Majeure has
affected his performance, shall give notice to the other party within fifteen days(duly
certified by the Statutory Authorities) from the date of occurrence there of neither party
have any claim for damage against the other in respect of such non-performance or delay in
performance. The work under the contract shall be resumed as soon as practicable after such
even as come to endorceasedto exist, and decision of the L&T as to whether the performance
of the work have been so resumed or not shall be final and conclusive. If the Force Majeure

situation continues, the parties here to shall meet and discuss the ways and means to cope
up with the situation.

25.0 RESOLUTION OF DISPUTES:


All disputes of difference of opinions, on account of interpretation of clauses, technical
Specifications etc. Shall be resolved through direct and mutual discussions at site level. In the
case of difference of opinion still persisting, then the decision of the Cluster Head & Segment
Head, will be final and binding to both the parties.

26.0 CONTRACTOR’S OBLIGATIONS:


1. You shall provide all skilled and unskilled workmen and supervisory personnel necessary
for the satisfactory completion of the work. Accommodation for your staff and your
workmen shall be as per the workmen policies of L&T Construction.
2. The Transportation of your man, materials, tools and tackles and equipment’s to site for
work is your responsibility.
3. You have to strictly follow all the rules & regulations applicable for this project. You
should ensure adequate housekeeping at site allotted to you regularly and
continuously. No separate payment for performing the housekeeping works shall be
payable. Such effort is construed to be part of your regular works only.
4. L&T /EIC- at site have the right to instruct for withdrawal / replacement of any person
at any time not considered suitable by them for the job.

27.0 ARBITRATION:
All disputes arising out of this work order failing amicable settlement shall be referred to the
Arbitration of two Chartered Engineers, one to be appointed by L&T and the other to be
appointed by the Agency. The Arbitrators shall appoint an umpire. In the event of the
arbitrators not reaching an agreement, the decision of the umpire shall be final and conclusive.
The arbitration proceedings shall be governed in accordance with the Indian Arbitration Act
1996 or any statutory modifications thereof for the time being in force and such arbitration
shall take place in Chennai.

28.0 TERMINATION OF THE CONTRACT:
In case of poor progress of your work affecting our contract with our employer and/or if the
Quality of your work falls below the expected standards in such cases, we reserve the right
to suspend your operation, fully or partly, without assigning any reason. Payment on such a
contingency shall be made to you for the actual work done at that stage after the completion
of work of that particular structure by other contractor/L&T after deducting any loss that we
may have to suffer due to your fault as per the calculations by EIC. On such occasions, decision
of project manager shall be final.
All disputes arising out of this work order failing amicable settlement at site shall be referred to
the Cluster Head – East Cluster, L&T Construction – WET IC , WSD BU at Kolkata and the
decision is final and binding both parties. In case it fails, the dispute shall be referred to
arbitration. The arbitration proceedings shall be governed in accordance with the Indian
Arbitration Act 1996 or any statutory modifications thereof for the time being in force and such
arbitration shall take place in Chennai.
29.0 CONFIDENTIALITY OF DOCUMENTS:
You shall treat all documents, specifications, drawings and contents therein as private and confidential.
30.0 STORAGE OF MATERIALS & TRANSPORTATION:
Contractor shall have to make his own arrangement for Transport the materials by using of Double
Axle tractor / truck/ trailer, yard for materials stacking, Site office, etc., and ancillaries at his own
cost. The store should be of adequate capacity for storing materials, taking all safety measures against
theft, deterioration of materials etc and security staff also provided by you at your own risk.
31.0 TAKING OVER:
After completion of the work you shall have to dispose of all excess material to suitable location far
away from the site shown by engineer-in charge. After completion of total work including dispose of
excess material you have to inform our Engineer in charge in writing.
32.0 FINAL BILL:
The final bill will be certified and payment released only after the completion of whole works
awarded to you under your work order and as per the final certification and clearance from client to
us. All the necessary final bill formats such as no claim certificate, store clearance certificate and other
Legal / Statutory obligations required by L&T to followed by you for
34.0 SUB LETTING OF WORK:
No part of sub-contract nor any share or interest thereof shall in any manner of degree be transferred,
assigned or sublet by Sub-Contractor directly or indirectly to any firm or corporation whatsoever
without the prior consent in writing of LTCD.
35.0 SUPPLEMENTARY CONDITION:
We reserve the right to issue additional condition, specifications, amendments etc. if necessary to you.
36.0 CLEARANCE OF SITE:
On the completion of the work you shall clear away and remove all surplus materials, rubbish from
your site of work and grade the area to the ground level as instructed by the site in-charge.
37.0 OTHER TERMS & CONDITION:
All other terms and conditions shall be as per L&T terms and conditions applicable particular to this
project.
